Trump\u2019s\u2064 attempt to \u2063scuttle\u2064 a \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/broward-county-school-board-member-admits-she-was-intimidated-into-covering-up-safety-failures-that-contributed-to-marjory-stoneman-douglas-massacre\/\" title=\"Broward County School Board Member Admits She Was \u2018Intimidated\u2019 Into Covering Up Safety Failures That Contributed To Marjory Stoneman Douglas Massacre\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrat-official-who-pulled-knife-on-trump-supporters-indicted-on-weapons-charges-media-tries-to-frame-him-as-victim\/\" title=\"Democrat Official Who Pulled Knife On Trump Supporters Indicted On Weapons Charges; Media Tries To Frame Him As Victim\">grand jury<\/a> report<\/a>\u200d in Fulton\u200b County on the 2020 presidential election \u2062in\u200b that state.<\/p>\n<p>The July 17 decision follows\u2063 his repeated attempts to quash that\u200d <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trumps-petition-to-quash-fulton-county-report-on-2020-election-denied-by-georgias-supreme-court\/\" title=\"Georgia's Supreme Court denies Trump's request to dismiss Fulton County's 2020 election report.\">special \u200bpurpose grand \u200bjury report<\/a>, which could\u2064 lead\u2062 to another criminal indictment for the previous\u2064 commander-in-chief.<\/p>\n<p>\u200b  <\/p>\n<p>Mr. Trump first sought to challenge the report \u2062in March. \u2062A <a href=\"https:\/\/www.documentcloud.org\/documents\/23718285-trump-motion-to-squash-march-20-2023\">petition<\/a> to\u2064 the Fulton County Superior Court\u2063 from \u200chis\u200b attorney, \u200bprominent criminal defense lawyer \u2062Drew\u2064 Findling, asserted\u200d that \u2063the statutes \u200cunder which the investigation was being conducted were unconstitutional.<\/p>\n<p>It also\u200d drew attention to \u2064actions \u200cby the\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/grand-jury-indicts-white-police-officer-in-shooting-death-of-andre-hill-an-unarmed-black-man\/\" title=\"Grand Jury Indicts White Police Officer In Shooting Death Of Andre Hill, An Unarmed Black Man\">grand jury\u2019<\/a>s forewoman, Emily \u200dor Emma Kohrs. Ms. Kohrs\u2063 <a href=\"https:\/\/www.theepochtimes.com\/trump-attorney-trump-investigation-in-georgia-compromised_5085542.html\">spoke<\/a>\u2064 to\u2062 various \u200bmedia outlets, including in a \u2062highly publicized appearance on CNN, \u2062raising \u200dconcerns of\u2063 a\u2062 compromised investigation \u2062process due to \u2064the <a\u200d href=\"https:\/\/www.youtube.com\/watch?v=_qyEG7Wr7tY\">public remarks<\/a> \u2064by\u2064 the \u200cforewoman \u2064as the trial was ongoing.<\/p>\n<p> \u200c \u200d<\/p>\n<blockquote><p>\n\u200c 2021.<\/p>\n<p>Shortly before requesting that \u2064a special purpose \u200bgrand jury \u2062be impaneled, Ms. Willis told The\u2062 Associated Press that her \u200bprobe concerned, among other \u2062events,\u2064 Mr. Trump\u2019s Jan. 2, 2021, phone call with Georgia Secretary of\u200b State\u2063 <a href=\"https:\/\/www.theepochtimes.com\/trump-georgia-secretary-of-state-unable-to-answer-questions-about-ballots-under-table_3641550.html\">Brad Raffensperberger<\/a>.<\/p>\n<p>\u201cI\u2064 just\u2062 want to find 11,780 votes, which is one more than\u2064 we\u200b have,\u201d then-President Trump <a href=\"https:\/\/www.theepochtimes.com\/trump-says-election-phone-call-with-raffensperger-was-perfect-da-willis-basing-probe-on-tiny-word-or-phrase_4741836.html\">said<\/a> to\u2063 Mr. \u201cpersonal involvement and\u2064 interest\u201d in the case \u2062to boost \u200cher\u2062 political profile.<\/p>\n<p> \u2064 <\/p>\n<p>Ms. Willis <a href=\"https:\/\/www.documentcloud.org\/documents\/23813609-willis-response-to-trump-request-to-end-investigation\">responded in May<\/a>, \u2062arguing that \u200bthe filing and \u2063a similar\u200b motion did not show that the relevant statutes are\u2064 unconstitutional and that the standards to \u2064disqualify her have not been met.<\/p>\n<p>Those filings, according to Ms.\u2064 Willis, \u201ccannot succeed because their requested remedies have\u2064 no \u200cbasis in\u2063 the\u2063 law and, \u200din \u200cfact, fly in\u200d the\u2063 face of the orderly\u200d administration of \u200cthe\u2064 laws\u200b of \u200cthe State of Georgia.\u201d<\/p>\n<p>  \u2063<\/p>\n<p>\u201cIf an\u2063 investigation results in actual criminal charges against\u2064 the Movants\u200c [Mr.\u200d Trump], \u2063the justice system ensures\u200b they will have no shortage\u200c of available remedies to pursue,\u201d\u200b it continues.<\/p>\n<p> \u2062 <\/p>\n<p>The supervising judge \u2062in the \u2062case, Robert McBurney, has not\u2064 yet ruled on Mr. Findling\u2019s motion. \u2064The \u2064filing \u200bhad asked \u2062that\u2063 someone other than Mr.\u2062 McBurney \u200bhear \u2064it.<\/p>\n<p>  \u2062<\/p>\n<p>Mr. Findling has made \u200ca \u2062new \u2064<a\u2062 href=\"https:\/\/www.democracydocket.com\/wp-content\/uploads\/2023\/07\/s23o1134_trump-scoga-petition.pdf\">attempt<\/a> at quashing \u2063the report with Georgia\u2019s \u200cSupreme \u2064Court \u2063while making\u200c a second, \u2062similar \u2062<a href=\"https:\/\/www.fultonclerk.org\/DocumentCenter\/View\/2046\/2023CV382670\">request<\/a> to\u2063 the \u2064Fulton County Superior Court.<\/p>\n<p>The filings seek \u200da \u200b\u201cwrit \u2063of mandamus and\u2062 prohibition\u201d\u2064 against \u2062Ms. \u200cWillis and Mr. \u200bMcBurney\u2013in \u200dsimpler\u2062 terms, to command them to\u200d do\u200d their jobs as defined by law.<\/p>\n<p>\u200b  <\/p>\n<figure id=\"attachment_5405142\" style=\"width: 600px\" class=\"wp-caption alignnone\">\n  \u2063  <a class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption>\u2063  \u200c<\/a><br \/>\n  <\/figure>\n<p>Filed on July 13, \u2063the Supreme Court petition states that Ms.\u200c Willis has \u201csignaled \u2062that she\u200c will use\u200b the report\u200c \u2026 to secure an\u200b indictment against\u200b Petitioner\u2064 [Mr. Trump] within weeks, if not days.\u201d<\/p>\n<p>\u200d  <\/p>\n<p>A\u200d new\u200d grand jury\u2063 was sworn\u200b in to consider the case earlier this month.<\/p>\n<p> \u2063 <\/p>\n<p>Mr. Findling\u2019s filing argues that the allegedly \u2063improper conduct could harm \u2062Mr. Trump\u2019s reputation \u201cas he seeks his party\u2019s\u200d nomination for the Presidency\u200c of the United\u2064 States via a flagrant disregard for and \u200dviolation \u200bof his\u2062 fundamental constitutional\u2064 rights.\u201d<\/p>\n<p> \u200b <\/p>\n<p>It also urged Georgia\u2019s\u200d high \u200dcourt \u200bto grant extraordinary\u2063 relief despite Mr.\u200d McBurney\u2019s\u2062 court\u200b not having ruled yet.<\/p>\n<p>The Supreme\u200d Court\u2019s\u200c ruling disagreed, arguing that Mr. \u2063Trump has not \u2063shown he is\u200c being unfairly\u2063 barred \u2063from\u200c the \u201cordinary\u200b channels.\u201d<\/p>\n<p>\u201cAlthough he complains that \u2062Judge McBurney\u200d has yet \u200cto \u200drule on those\u2062 [his] motions, he\u200d is not asking \u200bthis Court\u200b to \u200dcompel Judge McBurney\u2063 to rule. Instead, he is\u2062 asking this Court to \u2063step in\u200c and itself decide \u2062the motions\u200b currently \u200dpending in the\u200d superior\u200b court,\u201d the decision states.<\/p>\n<p>\u2063  \u2062<\/p>\n<p>The Supreme Court decision\u200c states \u200dthat\u200d the \u2062petition lacks\u2062 \u201ceither the facts or the law necessary to mandate Willis\u2019s disqualification by \u2064this \u200bCourt at this time on this\u2062 record.\u201d<\/p>\n<p> \u2062 <\/p>\n<p>It also questions\u2062 the\u2064 decision to seek\u2064 a\u200d writ \u200cof mandamus in the Supreme Court and the Fulton County court simultaneously.
