Fairfax County\u200b School\u2064 Board, which challenges the use\u200c of &#8220;holistic&#8221; \u200cadmissions policies over <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/building-an-antiracist-america-top-pennsylvania-school-district-pushes-teachers-to-infuse-critical-race-theory-into-their-lessons\/\" title=\"Top PA School District Urges Teachers to Incorporate Critical Race Theory\">merit-based policies<\/a> in K-12 schools. They \u2062believe that \u2062the Court could\u2063 use\u200b its\u200d June \u2064ruling \u200das \u2062a basis to strike \u2064down the\u200b use of \u2062such practices in high schools \u2062as\u200b well.<\/p>\n<p>Renu Mukherjee, \u2063a \u200bpolicy\u2063 analyst at the\u2062 Manhattan \u200cInstitute\u2064 who \u200dspecializes in \u200daffirmative action, \u2062stated,\u2063 &#8220;While\u200b the Supreme Court&#8217;s recent\u2063 ruling\u200c on \u2064affirmative action struck\u2063 down the use \u2064of racial preferences\u2064 in\u2062 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ketanji-brown-jackson-clashes-with-anti-affirmative-action-lawyer-during-oral-arguments\/\" title=\"Ketanji Brown Jackson Clashes With Anti-Affirmative Action Lawyer During Oral Arguments\">higher education admissions<\/a>, \u2064it signals\u200c that \u2064this \u2064court\u200c has little \u200cpatience \u2062for institutions \u200bthat engage \u2063in racial balancing, \u2062as well as \u200cpenalizing \u200bcertain \u2064racial \u2064groups (Asian Americans\u200d and\u2062 whites)\u200c in\u2062 order to confer benefits on others\u2063 (blacks and\u200d Hispanics). And the\u2063 fact pattern of\u2063 the case concerning Thomas Jefferson\u2063 High\u200d School \u2064for\u2062 Science\u2064 and Technology demonstrates that the Fairfax County\u2063 School Board\u2063 was doing exactly that with\u2063 its \u2063&#8217;holistic admissions&#8217; \u200dpolicy.&#8221;<\/p>\n<h3>The Case \u2062of\u2062 Coalition for TJ\u200d v. \u200bFairfax\u200d County \u200dSchool\u2063 Board<\/h3>\n<p>In 2021,\u2062 a group\u200c called Coalition for\u2062 TJ,\u200b consisting\u2062 of\u200b parents,\u200c students, and staff,\u2064 filed a lawsuit against the\u2064 Fairfax\u2063 County School\u2063 Board. The lawsuit \u2063was in\u200d response\u2062 to\u2063 the\u2062 board&#8217;s modifications to\u2062 the\u2062 admissions \u200dprocess of \u200cthe prestigious\u2064 Thomas \u200dJefferson\u2062 High School for \u2063Science \u200band Technology (TJHS). These modifications included the\u2063 removal of \u2063standardized \u2062testing\u2063 requirements\u200c and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-expected-to-follow-up-race-based-admissions-decision-with-new-case-on-huge-issue-at-high-schools\/\" title=\"SCOTUS to tackle major high school issue after race-based admissions ruling.\">lowered grade-point average \u200crequirements<\/a>, \u200dwhich the \u200blawsuit\u200c alleges were implemented \u200cto &#8220;racially balance&#8221; \u2063the school. Under the revised\u2063 admissions program, \u200cthe\u2062 school now \u200dconsiders &#8220;experience \u200cfactors&#8221; \u2063such \u2064as \u200battending an underrepresented\u200b middle \u2064school,\u200d learning English \u2064as \u2063a second language, or being \u2064eligible for\u2063 reduced\u200c lunch prices.<\/p>\n<p>A\u200d federal court ruled in May that \u2063the \u200cCoalition\u200b for TJ \u200dfailed to \u2063demonstrate\u200d that \u2064the policy \u200bwas \u200dmotivated\u200d by &#8220;discriminatory intent.&#8221;\u2062 However, the Coalition for \u2062TJ, \u2064represented by \u2064the Pacific \u2063Legal \u2063Foundation, appealed the decision\u2062 to \u200bthe\u200c Supreme Court. This \u200dchange \u200dhas raised\u200c concerns about \u2062the impact of \u2063the \u200brevised \u200cadmissions process \u200bon different\u2063 racial\u2062 groups.<\/p>\n<p>GianCarlo \u200dCanaparo, a senior legal\u2062 fellow at the Heritage \u2063Foundation, commented, &#8220;Thomas\u200b Jefferson\u2064 was cleverer\u200c than Harvard. \u200bRather \u2064than \u2062discriminate against Asians \u200dand \u2063whites\u200c explicitly, it privileged\u200b applicants \u200cfrom middle schools where\u2062 it \u200bknew there were fewer \u200cof them. But \u2062the \u200bintent\u2063 was the same \u2014 to boost the number \u2064of black\u2062 and Hispanic students and suppress\u200b the \u200cnumber \u2064of \u2063Asian \u200band\u200b white \u2064students. That&#8217;s impermissible \u2062under Students\u200b For Fair\u2064 Admissions because the\u200c Chief Justice \u2062wrote that\u2062 &#8216;What \u2063cannot be \u200ddone directly \u2062cannot \u2062be \u200cdone indirectly.&#8217;\u2064 I \u200bexpect the lawsuit\u2064 against Thomas\u2063 Jefferson will \u200cgo to\u2064 the Supreme Court, and that the\u200d Court \u200cwill \u200dmake clear\u200d that \u200cneither direct \u200bnor indirect\u200d racial \u200bdiscrimination \u2062is permissible.&#8221;<\/p>\n<p>TJHS recently faced criticism\u2062 after it\u200d was\u200c revealed\u200d that\u200b the school had failed to notify\u200d students who\u2064 received the National\u2064 Merit Scholarship \u200bcommendation, an honor \u200cused\u200d for college applications and scholarships. This\u200d decision was made in an effort to avoid &#8220;hurting&#8221;\u2062 the feelings of students\u200d who did not earn the \u200caward.<\/p>\n<p>The \u2064Coalition for TJ representative stated, &#8220;We\u200c have witnessed firsthand\u2063 at\u200d Thomas Jefferson High School for\u200b Science\u2062 and\u200b Technology the\u200b potential\u2064 consequences\u2063 of so-called &#8216;race-neutral&#8217; policies\u2064 masquerading\u200d as\u2063 efforts to\u200b promote\u2064 diversity in admissions but actually \u200cpracticing \u200banti-Asian \u2063racism.\u2064 With the legal \u2062acumen of \u2063our\u200b lawyers at Pacific Legal \u200cFoundation, the\u200d Coalition for TJ will \u2063persevere in its\u2064 efforts\u200c to ensure \u200cthat \u200brace-neutral admissions\u200c policies \u200cdo not perpetuate discrimination or \u2062disadvantage any\u200d racial or \u200cethnic group.
