Many indicted defendants have demanding jobs that require a considerable amount of time and energy, or a significant amount of travel,\u201d he wrote.<\/p>\n<figure id=\"attachment_5324717\" style=\"width: 640px\" class=\"wp-caption aligncenter\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript> Special counsel Jack Smith delivers remarks on a recently unsealed indictment against former President Donald Trump at the Justice Department in Washington on on June 9, 2023. (Alex Wong\/Getty Images)<\/figcaption><\/figure>\n<p>Last month, Mr. Trump was arrested and charged with 37 counts, making it the <a href=\"https:\/\/www.theepochtimes.com\/trump-pleads-not-guilty-in-historic-federal-case_5329816.html\">first time<\/a> a former or current U.S. president has been formally accused for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cdc-exposed-inflated-covid-deaths-by-1600-throughout-the-election-violated-multiple-federal-laws-peer-reviewed-study-findsstate-local-governments-must-act\/\" title=\"CDC Exposed: Inflated Covid Deaths By 1600% Throughout The Election, \u201cViolated Multiple Federal Laws\u201d Peer-Reviewed Study Finds\u2026State, Local Governments Must Act\">violating federal law<\/a>. Mr. Trump pleaded not guilty on all counts, and the first pretrial hearing before District Judge Aileen Cannon takes place in the afternoon on July 18.<\/p>\n<p>Christopher M. Kise, attorney representing Mr. Trump, <a href=\"https:\/\/courtlistener.com\/docket\/67490070\/66\/united-states-v-trump\/\">wrote<\/a> in their request to delay trial, \u201cThe Court now presides over a prosecution advanced by the administration of a sitting President against his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/everything-you-need-to-know-about-the-durham-probe\/\" title=\"Everything You Need To Know About The Durham Probe\">chief political rival<\/a>, himself a leading candidate for the Presidency of the United States. Therefore, a measured consideration and timeline that allows for a careful and complete review of the procedures that led to this indictment and the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-lawyers-ask-federal-judge-to-delay-classified-documents-trial-scheduled-for-december\/\" title=\"Trump's lawyers request a delay in the December trial for classified documents.\">unprecedented legal issues presented<\/a> herein best serves the interests of the Defendants and the public.\u201d<\/p>\n<h2>800,000 Pages of Discovery<\/h2>\n<p>The sheer amount of material in discovery was cited as one reason to delay the trial.<\/p>\n<p>\u201cThe Government\u2019s investigation into the matters at issue in the indictment has been ongoing for over a year. During that time, the Government collected many hundreds of thousands of documents, interviewed dozens of witnesses, and presented many witnesses before two separate Grand Juries. The Defendants will require ample time to fully study that entire process,\u201d Mr. Kise wrote.<\/p>\n<p>But Mr. Harbach says although the government provided \u201cover 800,000 pages, the set of \u2018key\u2019 documents was only about 4,500 pages.\u201d<\/p>\n<p>He further added that a third of those 800,000 pages were email headers and footers, without content, and that the \u201cnine months of CCTV footage\u201d was not from nine continuous months.<\/p>\n<p>The case began more than two years ago when the National Archives and Records Administration (NARA) requested Mr. Trump return certain documents, and NARA said it <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-says-trumps-motion-to-delay-trial-until-after-elections-is-borderline-frivolous\/\" title=\"DOJ deems Trump's request to postpone trial until after elections as 'almost frivolous'.\">found documents marked \u201cclassified<\/a>,\u201d though Mr. Trump maintains he had declassified the materials as president. This led to the FBI searching Mar-a-Lago.<\/p>\n<p>Mr. Kise had also argued that due to the sensitive nature of the discovery documents and the difficulty of selecting an impartial jury during a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mainstream-media-and-big-techs-seismic-shift-to-the-left\/\" title=\"Mainstream Media and Big Tech\u2019s Seismic Shift to the Left\">national presidential election<\/a> it was prudent to wait.<\/p>\n<p>Mr. Harbach dismissed the arguments, writing that the \u201cmore time-consuming\u201d process of putting together this jury was a reason to start the trial sooner rather than later, and that the defense had enough time to review all materials.<\/p>\n<h2>DOJ in Other Cases<\/h2>\n<p>Mr. Trump is involved in several other ongoing cases.<\/p>\n<p>On Tuesday, the DOJ stepped in on a civil lawsuit and said it would no longer shield him from a defamation case brought by columnist E. Jean Caroll.<\/p>\n<p>\u201cThe Department has determined that there is no longer a sufficient basis to conclude that the former President was motivated by \u2018more than an insignificant\u2019 desire to serve the United States Government,\u201d it wrote.<\/p>\n<p>Mr. Trump is also set to <a href=\"https:\/\/www.theepochtimes.com\/judge-says-trump-can-be-deposed-in-former-fbi-agent-peter-strzok-lawsuit_5379830.html\">testify<\/a> in a case brought against the DOJ by former FBI agent Peter Strzok, despite th<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Justice Department special counsel Jack Smith, assigned to probe Donald Trump soon after his reelection campaign began, opposes Trump&#8217;s plea to postpone the trial until after the 2024 elections.
