Manchin accuses court of 'illegal' action in halting WV pipeline construction.\">federal appeals court siding<\/a> with environmental groups despite Congress giving the project a green light, drawing the ire of Sen. Joe Manchin (D-W.Va.), who accused the court of unlawful conduct.<\/p>\n<p>The 4th Circuit Court of Appeals issued a <a href=\"https:\/\/www.scribd.com\/document\/658469943\/23-1384-Order-Granting-Stay-7-11-2023\">stay of construction<\/a> on July 10 while it evaluates the legality of permit approvals for the Mountain Valley Pipeline (MVP).<\/p>\n<p>The court\u2019s order stops construction on any part of the 304-mile pipeline route, which runs from northwestern West Virginia to southern Virginia.<\/p>\n<p>The stay includes no explanation of the rationale behind the court\u2019s decision, which remains in effect until a full ruling is made on the merits of the case.<\/p>\n<p>The construction authorizations for the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/manchin-not-comfortable-hosting-hearing-for-biden-energy-commission-nominee-2\/\" title=\"Manchin \u201cNot Comfortable\u201d Hosting Hearing for Biden Energy Commission Nominee\">interstate natural gas pipeline<\/a> were granted by Congress as part of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bipartisan-caucus-proposes-plan-to-avoid-default-if-biden-mccarthy-fail-to-reach-debt-ceiling-deal\/\" title=\"Bipartisan Caucus Proposes Plan to Avoid Default If Biden, McCarthy Fail to Reach Debt-Ceiling Deal\">debt-ceiling deal<\/a>, which also stripped the 4th Circuit from jurisdiction over the case.<\/p>\n<p>Environmental groups sued, however, arguing that Congress overstepped its authority and violated the constitutional separation of powers by including the pipeline approvals in the <a href=\"https:\/\/www.theepochtimes.com\/heres-whats-in-the-debt-ceiling-deal-and-who-benefits_5299920.html\">Fiscal Responsibility Act of 2023.<\/a><\/p>\n<h2>Permit Controversy<\/h2>\n<p>The groups alleged violations of multiple environmental laws in connection with defective approvals for the pipeline by the U.S. Forest Service and the Bureau of Land Management.<\/p>\n<p>Their lawsuit challenged the constitutionality of Section 324 of the Fiscal Responsibility Act, which a group of Virginia House Democrats <a href=\"https:\/\/mcclellan.house.gov\/media\/press-releases\/virginia-house-democrats-submit-amendment-strip-mountain-valley-pipeline\">unsuccessfully sought<\/a> to strip from the final version of the bill.<\/p>\n<p>\u201cThis provision is a free pass for the pipeline and sidesteps our nation\u2019s environmental laws and judicial review processes,\u201d the lawmakers said at the time.<\/p>\n<p>The White House supported the provision as a concession to\u00a0Mr. Manchin, an ardent backer of the pipeline.<\/p>\n<p><strong>Mr. Manchin issued a critical statement on Monday night\u2019s court decision, saying that Americans should be alarmed.<\/strong><\/p>\n<p>\u201cThe law passed by Congress &#038; signed by POTUS is clear \u2013 the 4th Circuit no longer has jurisdiction over MVP\u2019s construction permits,\u201d Mr. Manchin said in the statement. \u201cThis new order halting construction is unlawful, &#038; regardless of your position on MVP, it should alarm every American when a court ignores the law.\u201d<\/p>\n<p>The 4th Circuit Court of Appeals did not immediately return a request for comment on Mr. Manchin\u2019s allegations that it acted unlawfully in issuing the stay.<\/p>\n<figure id=\"attachment_5123014\" style=\"width: 640px\" class=\"wp-caption alignnone\">\n\t\t<a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2023\/03\/14\/Joe-Manchin-GettyImages-1247623528-e1678836569478-1200x727.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a><br \/>\n\t<\/figure>\n<p>Equitrans Midstream Corporation, the company that is set to construct the pipeline as part of a joint venture with other partners, issued a statement that accused the court of exceeding its authority.<\/p>\n<p>\u201cWe are disappointed with the U.S. Court of Appeals for the Fourth Circuit\u2019s remarkable decision to grant a one-sentence stay halting all construction in the Jefferson National Forest with no explanation,\u201d the company wrote in the statement.<\/p>\n<p>Not only does the court decision defy the will of Congress and the administration, but the court also \u201cexceeded its authority, as Congress expressly and plainly removed its jurisdiction,\u201d the company wrote.<\/p>\n<p>Equitrans said it is evaluating all its legal options, including potentially filing an emergency appeal to the U.S. Supreme Court.<\/p>\n<p>Unless the stay is reversed quickly, the company\u2019s ability to complete construction by the end of 2023 will be jeopardized, it said.<\/p>\n<h2>More Details<\/h2>\n<p>The coalition of environmental groups who sued included T<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A federal appeals court has halted the construction of a West Virginia natural gas pipeline, going against Congress&#8217; approval and angering Sen.
