King didn\u2019t know how he would be forced to deal with smears against his organization from the Southern Poverty Law Center, but that didn\u2019t stop him from filing a landmark lawsuit against one of the biggest anti-Christian, anti-conservative organizations in the nation.<\/p>\n<p>\u201cI\u2019m proud that we constructed a factual complaint that the <a href=\"https:\/\/first-heritage-foundation.s3.amazonaws.com\/live_files\/2023\/05\/King-v-SPLC-opinion-4242023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">judge observed<\/a> \u2018the plaintiff has the best argument,\u2019\u201d King told The Federalist. \u201cAll we did in the complaint was outline some \u2014 not all \u2014 of the facts of the case.\u201d<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-717854293\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-a8ebb8a6b158fb874cb60ca32a63a4bc fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-a8ebb8a6b158fb874cb60ca32a63a4bc\"><\/div>\n<p>The SPLC is known for\u00a0<a href=\"https:\/\/thefederalist.com\/tag\/southern-poverty-law-center\/\" target=\"_blank\" rel=\"noreferrer noopener\">tarnishing organizations<\/a>\u00a0with Christian missions or conservative ties by disseminating its 1,225-organization-long \u201c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gov-whitmer-media-caught-in-another-lie-anarchist-arrested-for-plot-to-kidnap-and-kill-whitmer-hates-president-trump-trump-is-a-tyrant-video\/\" title=\"Gov. The leftist activist organization has also gained infamy in recent years for galvanizing a\u00a0<a href=\"https:\/\/www.justice.gov\/usao-dc\/pr\/virginia-man-sentenced-25-years-prison-shooting-security-guard-family-research\" target=\"_blank\" rel=\"noreferrer noopener\">Virginia man<\/a>\u00a0to attack the Family Research Council and the behavior of its staff, like lawyer Thomas Webb Jurgens, who faces\u00a0<a href=\"https:\/\/www.dailysignal.com\/2023\/06\/26\/rogue-prosecutor-withdraws-splc-attorneys-domestic-terrorism-case-molotov-cocktail-riot\/\" target=\"_blank\" rel=\"noreferrer noopener\">domestic terrorism<\/a>\u00a0charges for targeting an Atlanta police training facility with rocks and incendiaries.<\/p>\n<p>An analysis of White House visitor logs by <a href=\"https:\/\/www.dailysignal.com\/2023\/07\/05\/white-house-records-biden-personally-met-splc-staff-6-times-foreshadowing-renewed-attacks-parent-groups\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Daily Signal<\/a> shows SPLC staff have met with President Joe Biden and members of his cabinet nearly a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/very-partisan-figure-bidens-budget-office-pick-grilled-over-past-social-media-conduct\/\" title=\"\u2018Very Partisan Figure\u2019: Biden\u2019s Budget Office Pick Grilled Over Past Social Media Conduct\">dozen times<\/a> since he took office. It was mere months after the SPLC\u2019s latest meeting at the executive mansion that it dubbed a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/goliath-smear-machine-splc-has-met-its-david\/\" title=\"The SPLC, a powerful 'Smear Machine', faces its downfall.\">dozen grassroots parents\u2019 rights organizations<\/a> as hate groups.<\/p>\n<p>Until the SPLC openly committed to continuing the <a href=\"https:\/\/thefederalist.com\/2023\/03\/22\/house-judiciary-finds-biden-doj-had-no-legitimate-basis-to-target-parents-as-terrorists\/\" target=\"_blank\" rel=\"noreferrer noopener\">Biden regime\u2019s crusade<\/a> against concerned parents like those at <a href=\"https:\/\/thefederalist.com\/2023\/06\/07\/after-splc-quietly-admits-subjectivity-corporate-media-amplify-baseless-smears-against-parents\/\" target=\"_blank\" rel=\"noreferrer noopener\">Moms For Liberty<\/a>, King said he believed his lawsuit was the only opportunity that \u201cnormal Americans and conservatives have to show the world who the Southern Poverty Law Center really is.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"K2Ca5FeNLkyXPsmfD0IYQxBwHO7EMRc6bz89gpjrGdq1VnSAv4oWu3hlZiUTJ\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Protesters confront <a href=\"https:\/\/twitter.com\/hashtag\/MomsForLiberty?src=hash&#038;ref_src=twsrc%5Etfw\">#MomsForLiberty<\/a> conference goers as they leave Mariott Hotel in Philadelphia <a href=\"https:\/\/twitter.com\/hashtag\/TODAY?src=hash&#038;ref_src=twsrc%5Etfw\">#TODAY<\/a> <a href=\"https:\/\/t.co\/muoQS0TCRl\">pic.twitter.com\/muoQS0TCRl<\/a><\/p>\n<p>\u2014 Oliya Scootercaster \ud83d\udef4 (@ScooterCasterNY) <a href=\"https:\/\/twitter.com\/ScooterCasterNY\/status\/1674952680400199684?ref_src=twsrc%5Etfw\">July 1, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p>In his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-faces-criticism-for-defending-president-trump\/\" title=\"DOJ faces criticism for defending President Trump\">defamation case brought<\/a> against the SPLC, King argued that the SPLC did not conduct a \u201cmeaningful fact finding or investigation\u201d before dubbing his organization a hate group for \u201cvilifying all immigrants\u201d in the SPLC\u2019s 2018, 2019, 2020, and 2021 annual Intelligence Report magazine.<\/p>\n<div class=\"fdrlst__b89e9-64630909a8e0ae46efdc291c709aa070 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-64630909a8e0ae46efdc291c709aa070\"><\/div>\n<p>King also noted that the SPLC was \u201caware of Mr. King\u2019s documented history of opposing only \u2018illegal immigration\u2019 through the \u2018enforcement of immigration laws\u2019 and of not opposing legal immigration\u201d and even\u00a0\u201c<a href=\"https:\/\/www.dailysignal.com\/2023\/06\/04\/emerging-evidence-makes-hate-group-defamation-case-splc-stronger\/\" target=\"_blank\" rel=\"noreferrer noopener\">explicitly stated<\/a>\u201d\u00a0that DIS was not a \u201chate group\u201d in 2011.<\/p>\n<p>Yet, the SPLC repeatedly refused to rescind its characterization of DIS as an \u201canti-immigrant hate group\u201d because it is \u201can expression of opinion protected under the First Amendment\u201d and \u201cnot capable of being empirically proven true or false.\u201d <\/p>\n<p>Judge William Keith Watkins of the U.S. District Court for Alabama\u2019s Middle District wasn\u2019t buying it and denied the SPLC\u2019s attempt to dismiss King\u2019s case. In a <a href=\"https:\/\/first-heritage-foundation.s3.amazonaws.com\/live_files\/2023\/05\/King-v-SPLC-opinion-4242023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">memorandum opinion<\/a> issued in April, Watkins confirmed that the radical organization, which still\u00a0<a href=\"https:\/\/www.splcenter.org\/fighting-hate\" target=\"_blank\" rel=\"noreferrer noopener\">boasts of<\/a>\u00a0being and is\u00a0<a href=\"https:\/\/www.cnn.com\/2017\/08\/17\/us\/hate-groups-us-map-trnd\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cwidely accepted\u201d as<\/a>\u00a0the preeminent national database that tracks \u201chate groups,\u201d nullifies the SPLC\u2019s claims that its words do not constitute an attack on DIS.<\/p>\n<p>The judge\u2019s decision, King recalled, was \u201cone of the happiest calls I\u2019ve ever received.\u201d<\/p>\n<div class=\"fdrlst__b89e9-889207b9d60c01e9a99f205a1dd248fc fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-889207b9d60c01e9a99f205a1dd248fc\"><\/div>\n<p>\u201cIf the SPLC was not supported and propelled by the mainstream, traditional media, they would just be another hate-mongering, money-making organization,\u201d King said.<\/p>\n<h2 class=\"wp-block-heading\">The Right Stones<\/h2>\n<p>As the SPLC admitted in its defense, there was no factual basis for calling DIS an \u201canti-immigrant hate group.\u201d So now it\u2019s up to King and DIS to use that to their advantage. <\/p>\n<p>\u201cWe have been defending immigrants here from the label of being mixed up with what are illegal aliens. We have been saying for years that we can\u2019t honor real immigrants like my adopted sister, by the way, unless we do what Barbara Jordan told Congress we should do and that is not mix up immigrants with illegal aliens,\u201d King said. <\/p>\n<p>Managing the fight against the SPLC hasn\u2019t been easy for King or DIS. To keep the case alive, King has not only solicited a <a href=\"https:\/\/www.gofundme.com\/f\/please-help-us-fight-the-splc\" target=\"_blank\" rel=\"noreferrer noopener\">trickle of GoFundMe donations<\/a> but personally financed part of the legal battle by taking out a third mortgage.<\/p>\n<p>\u201cWe have taken a Barbara Jordan approach to a pro-enforcement position on immigration and for our trouble, we have been labeled a bunch of nasty names. It is clearly defamation with intent. It\u2019s clearly actual malice, in my mind, and I intend to go to court to prove it,\u201d King said.<\/p>\n<p>Now armed with <a href=\"https:\/\/lc.org\/newsroom\/details\/071023-liberty-counsel-represents-immigration-policy-group-against-splc\" target=\"_blank\" rel=\"noreferrer noopener\">new legal counsel<\/a>, which recognizes the SPLC as intending to \u201c\u2018destroy\u2019 groups with which it disagrees,\u201d King just awaits a court date so he can showcase the SPLC\u2019s resolve to lump legitimate faith and conservative organizations into the same category as real threats like the Ku Klux Klan.<\/p>\n<p>\u201cI\u2019m sure if we win, Southern Poverty Law Center will use their vast holdings to file an appeal, but I\u2019m trying to clear my own name and those of the people on our board, including the immigrants on our board, and get some kind of justice out of this,\u201d King said.<\/p>\n<p>One of those immigrant board members, Mary Grabar, calls DIS\u2019s fight against the SPLC \u201ctruly a David and Goliath thing.\u201d<\/p>\n<p>\u201cTo me, you know, the SPLC is a despicable organization that\u2019s just a big smear machine,\u201d she told The Federalist, noting that the SPLC has millions to throw at legal battles like this one. <\/p>\n<p>\u201cThe SPLC needs to be seen for what they are,\u201d she added. \u201cThey are not a source of legitimate information. They are not a charity. They do not do the work of a 501(c)(3). It is a political machine.\u201d<\/p>\n<p>The SPLC is allowed to be critical, but Grabar said, \u201c[O]nce you start distorting what people say, you\u2019re getting out of legitimate discourse.\u201d<\/p>\n<p>\u201cIn order to survive, the SPLC is casting its net wider and wider and going after conservatives and people who just want to uphold the law, which is what D.A. wants to do,\u201d Grabar said. \u201cI\u2019ve known D.A. since I met him around 2004, and he does not deserve any of this. He is someone who is welcoming to everybody and stands up for legal immigration. He\u2019s a very brave man.\u201d<\/p>\n<p>Others have <a href=\"https:\/\/cis.org\/Litigation\/CIS-RICO-Lawsuit-SPLC\" target=\"_blank\" rel=\"noreferrer noopener\">tried and failed<\/a> to bring cases against the SPLC but King, Grabar, and the rest of the DIS board aren\u2019t giving up.<\/p>\n<p>\u201cIf we get a chance to tell this to a jury, I\u2019m confident that they will think the same.
