Doughty wrote that his order last week had created exceptions for communications for cyberattacks, election interference, and national security threats. The DOJ and Biden administration, he wrote, didn\u2019t provide any specific examples that \u201cwould provide grave harm to the American people or our democratic processes.\u201d<\/p>\n<p>\u201cAlthough this Preliminary Injunction involves numerous agencies, it is not as broad as it appears,\u201d Mr. Doughty wrote on July 10. \u201cIt only prohibits something the Defendants have no legal right to do\u2014contacting social media companies for the purpose of urging, encouraging, pressuring, or inducing in any manner, the removal, deletion, suppression, or reduction of content containing <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-bars-biden-press-secretary-from-flagging-posts-for-big-tech-to-censor-two-years-after-admin-bragged-about-it\/\" title=\"Judge prohibits Biden press secretary from flagging posts for Big Tech censorship, despite previous administration's pride in the practice.\">protected free speech posted<\/a> on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-markets-spooked-causing-problems-with-multiple-online-traders-and-trading-companies\/\" title=\"BREAKING: Markets Spooked Causing Problems with Multiple Online Traders and Trading Companies\">social-media platforms<\/a>.\u201d<\/p>\n<p>The judge further wrote that Republican attorneys general who brought the suit are most likely going to prevail in proving that federal agencies and officials \u201csignificantly encouraged,\u201d \u201ccoerced,\u201d or \u201cjointly participated\u201d in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-denies-dojs-request-for-stay-in-social-media-censorship-case\/\" title=\"Judge rejects DOJ's stay request in social media censorship case.\">allegedly suppressing social media posts<\/a> that included information critical of COVID-19 vaccines or questioned the outcome of the 2020 presidential election.<\/p>\n<p>In response, lawyers for the Biden administration\u2019s DOJ filed an emergency stay of the injunction at the 5th U.S. District Court of Appeals. They argued that Mr. Doughty\u2019s ruling was too vague and broad.<\/p>\n<p>\u201cThe district court identified no evidence suggesting that a threat accompanied any request for the removal of content. Indeed, the order denying the stay\u2014presumably highlighting the ostensibly strongest evidence\u2014referred to \u2018a series of public media statements,\u2019\u201d the administration wrote on July 10.<\/p>\n<p>It came as the attorneys general for Missouri and Louisiana have submitted a petition to oppose the Biden administration\u2019s motion to stay an injunction against its efforts allowing it to contact social media firms about a range of online content, including its efforts to flag so-called misinformation.<\/p>\n<p>Over the weekend, the two states filed (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lawd.189520\/gov.uscourts.lawd.189520.299.0.pdf\">pdf<\/a>) a memorandum of opposition to the administration\u2019s motion, coming days after a federal judge partially granted an injunction that blocks various Biden administration officials and government agencies such as the Justice Department and the FBI from working with big tech firms to censor posts on social media. It came in response to a lawsuit filed by the attorneys general, who accused the White House and various federal agencies of putting pressure on social media firms to take down posts or suspend accounts.<\/p>\n<p>\u201cEvidence in this case overwhelmingly shows that the way the Government supposedly \u2018prevent[s] grave harm to the American people and our democratic processes\u2019 is to pressure and induce social-media platforms to censor disfavored viewpoints on COVID-19, elections, and other core political speech,\u201d they wrote on July 9.<\/p>\n<p>\u201cIn the end, their position is fundamentally defiant toward the Court\u2019s judgment. It demonstrates that the Government will continue violating First Amendment rights by censoring core political speech on social media as soon as it can get away with it. The motion to stay should be denied.\u201d<\/p>\n<p>Mr. Doughty ruled on July 4 that the Biden administration must <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-denies-biden-admins-request-for-a-stay-of-social-media-censorship-case\/\" title=\"Judge denies Biden admin's request to halt social media censorship case.\">cease contacting social media companies<\/a> about a broad range of online content, including the administration\u2019s efforts to flag alleged misinformation. The judge said that some of the administration\u2019s past communications with social media companies violated the First Amendment and that during the pandemic, the government assumed a role similar to that of \u201can Orwellian Ministry of Truth.\u201d<\/p>\n<p>A Trump-appointed judge for the Western District of Louisiana, Mr. Doughty wrote on July 4 that the Cybersecurity and Infrastructure Security Agency, the Department of Homeland Security, the FBI, the Department of Justice, and the Centers for Disease Control and Prevention can\u2019t take a range of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/emergency-petition-filed-in-major-biden-admin-social-media-censorship-case\/\" title=\"Emergency petition filed in major Biden administration social media censorship case.\">actions targeting social media posts<\/a>.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>denying the DOJ&#8217;s request to stay the ruling on government communications with social media firms stands, despite the White House&#8217;s concerns about its impact on online law enforcement.
