You\u2019d gather with your family and friends to find out who the next president was going to be. It was a time to celebrate our republic as Americans went to have their voices heard at the ballot box. The Public Interest Legal Foundation, of which I am president, is fighting in federal court to restore the \u201cday\u201d in Election Day.<\/p>\n<p>We filed a <a href=\"https:\/\/publicinterestlegal.org\/wp-content\/uploads\/2023\/07\/North-Dakota-Election-Day-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">federal lawsuit<\/a> in North Dakota to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-tells-missouri-they-cant-disregard-federal-gun-laws\/\" title=\"DOJ Tells Missouri They Can\u2019t Disregard Federal Gun Laws\">enforce federal law<\/a> and stop the state from accepting ballots up to 13 days after Election Day. We allege that North Dakota\u2019s law allowing the election to drag on for almost two extra weeks conflicts with federal law.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1105420222\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-4de37a1249257f1981ca2dd3c6685a8b fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-4de37a1249257f1981ca2dd3c6685a8b\"><\/div>\n<p>This case doesn\u2019t claim that anyone stole the North Dakota election. Indeed, North Dakota is only involved in the case because it is one of the most extreme states in accepting ballots weeks after the election.<\/p>\n<p>The case challenging North Dakota\u2019s 13 extra election days is about helping to bring confidence back to elections nationwide. It\u2019s time Election Day means Election Day again.<\/p>\n<p>We have to stop the new normal of Election Day dragging on and on. Now Americans don\u2019t learn results for days, and sometimes weeks.<\/p>\n<p>For example, in 2022, the last <a href=\"https:\/\/ballotpedia.org\/United_States_Senate_election_in_Alaska,_2022#cite_note-17\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Senate<\/a> and <a href=\"https:\/\/ballotpedia.org\/Alaska_gubernatorial_and_lieutenant_gubernatorial_election,_2022\" target=\"_blank\" rel=\"noreferrer noopener\">gubernatorial<\/a> races were finally called on Nov. 23, a total of 15 days after Election Day. The U.S. House of Representatives was worse. The last House race was not called until <a href=\"https:\/\/publicinterestlegal.org\/wp-content\/uploads\/2023\/04\/Report-Worst_to_First-Web.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Dec. 13<\/a>, a total of 35 days after Election Day.<\/p>\n<div class=\"fdrlst__b89e9-7f054250f488b373299655cef05bfd4a fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-7f054250f488b373299655cef05bfd4a\"><\/div>\n<p>Americans now prepare themselves for weeks of uncertainty and anxiety as Election Day turns into Election Month. They see their preferred candidate\u2019s lead slowly erode. They have seen counts wildly change and don\u2019t understand why. This ultimately leads to an erosion of trust.<\/p>\n<p>So why has Election Day turned into Election Month? Why were we able to know our election results on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-has-election-day-turned-into-election-month\/\" title=\"Why has Election Day become a month-long affair?\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-real-clear-politics-say-they-never-called-pennsylvania\/\" title=\"BREAKING: Real Clear Politics -- SAY THEY NEVER CALLED PENNSYLVANIA\">election night<\/a> decades ago<\/a>, but now we are lucky if we know the results a week later?<\/p>\n<p>This problem isn\u2019t happening everywhere. For instance, in 2022, Florida managed to call all its U.S. House, Senate, and gubernatorial races within <a href=\"https:\/\/apnews.com\/hub\/2022-race-calls\" target=\"_blank\" rel=\"noreferrer noopener\">two hours of polls closing<\/a>. How can a state as large as Florida have a final count on election night but states like California, Nevada, and Colorado take weeks?<\/p>\n<p>Mail ballots are to blame, specifically how states\u2019 laws relate to the acceptance and tabulation of mail ballots.<\/p>\n<div class=\"fdrlst__b89e9-3ee5d03b9359d6b5bb11d7b789112060 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-3ee5d03b9359d6b5bb11d7b789112060\"><\/div>\n<h2 class=\"wp-block-heading\">Different State Laws on Mail Ballots<\/h2>\n<p>Florida requires all absentee ballots to arrive by Election Day. What this means in practice is that if a mail ballot arrives after Election Day, it will not be counted. This might seem drastic, but remember, mail voting is the exception, not the norm.<\/p>\n<p><a href=\"https:\/\/publicinterestlegal.org\/save-election-day\/\" target=\"_blank\" rel=\"noreferrer noopener\">North Dakota, along with 17 other states and the District of Columbia<\/a>, accepts ballots that arrive after Election Day. Some even accept ballots that arrive up to two weeks after Election Day.<\/p>\n<p>Accepting ballots that arrive after Election Day is the primary reason for the delay in election results. When a state allows ballots to roll in for weeks, results will be delayed for weeks.<\/p>\n<p>But it gets worse. Not only does accepting mail ballots that arrive after Election Day lead to delays in election results, but it also <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/group-our-vote-matters-is-suing-facebook-dominion-mark-zuckerberg-certain-state-officials-others-for-infringing-upon-right-to-vote-assemble-and-speak-freely-you-can-jo\/\" title=\"Group \u201cOur Vote Matters\u201d Is Suing Facebook, Dominion, Mark Zuckerberg, Certain State Officials, Others for Infringing Upon Right to Vote, Assemble and Speak Freely \u2013 You Can Join Too\">violates federal law<\/a>. The law requires a single national Election Day to be held on <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/2\/7\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cthe first Tuesday after the first Monday in November of every even-numbered year.\u201d<\/a><\/p>\n<p>That seems simple enough.<\/p>\n<p>Day is singular, not plural. Congress wanted a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/late-night-restaurant-owners-want-to-play-fair-so-far-they-say-newsom-hasnt\/\" title=\"Late-night restaurant owners want to play fair. So far, they say, Newsom hasn't\">single day<\/a> when the election was over, so the country could move from the fury of the election to governing.<\/p>\n<div class=\"fdrlst__b89e9-7b6c7ab70e578c87915854056e3bd6d7 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-7b6c7ab70e578c87915854056e3bd6d7\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Remember when Election Day was a single day?
