Bush appointee, <a href=\"https:\/\/www.opn.ca6.uscourts.gov\/opinions.pdf\/23a0146p-06.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a>, adding that \u201cTennessee is likely to succeed on its appeal of the preliminary injunction.\u201d<\/p>\n<\/blockquote>\n<h3>Court of Appeals Overrules Preliminary Injunction<\/h3>\n<p>On Saturday, the U.S. Court of Appeals for the Sixth Circuit ruled against the preliminary injunction by U.S. District Judge Eli Richardson that blocked portions of Tennessee\u2019s law that prevented transgender surgeries and hormone procedures on children. The appeals court\u2019s decision came after Tennessee Attorney General Jonathan Skrmetti <a href=\"https:\/\/www.dailywire.com\/news\/tennessee-moves-to-defend-laws-shielding-kids-from-trans-procedures-explicit-performances\" target=\"_blank\" rel=\"noopener\">filed a motion<\/a> for an emergency stay.<\/p>\n<p>Skrmetti, who has been Tennessee\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-ag-barr-authorizes-federal-prosecutors-to-pursue-substantial-allegations-of-voting-irregularities-before-2020-election-is-certified\/\" title=\"BREAKING: AG Barr Authorizes Federal Prosecutors to Pursue \"Substantial Allegations\" of Voting Irregularities Before 2020 Election is Certified\">attorney general<\/a> since September 2022, celebrated the court\u2019s decision in a statement on Saturday.\u00a0<\/p>\n<p>\u201cThe case is far from over, but this is a big win. The court of appeals lifted the injunction, meaning the law can be fully enforced, and recognized that Tennessee is likely to win the constitutional argument and the case,\u201d he <a href=\"https:\/\/twitter.com\/AGTennessee\/status\/1677681526593429505\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<h3>Protecting Children from Transgender Procedures<\/h3>\n<p>Tennessee\u2019s law was passed after an investigation from Daily Wire host <a href=\"https:\/\/www.dailywire.com\/news\/vanderbilt-pediatric-transgender-clinic-terminates-gender-affirming-care-before-tennessee-law-takes-effect-report\">Matt Walsh revealed<\/a> that transgender procedures were being performed on children at Vanderbilt\u2019s Pediatric Transgender Clinic. Great job [AG Skrmetti] and team,\u201d Lamberth <a href=\"https:\/\/twitter.com\/WilliamLamberth\/status\/1677689026172661760\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<h3>Considerations and Ruling<\/h3>\n<p>In his decision, Sutton wrote that health risks associated with puberty blockers and cross-sex hormones, which have been associated with future fertility problems, were a key consideration for the court. He was also skeptical of Richardson\u2019s claim that Tennessee\u2019s law violated the 14th Amendment.\u00a0<\/p>\n<p>\u201cThat prompts the question whether the people of this country ever agreed to remove debates of this sort \u2014 about the use of new drug treatments on minors \u2014 from the conventional place for dealing with new norms, new drugs, and new technologies: the democratic process,\u201d he wrote. \u201cLife-tenured federal judges should be wary of removing a vexing and novel topic of medical debate from the ebbs and flows of democracy by construing a largely unamendable federal constitution to occupy the field.\u201d<\/p>\n<p>The appeals court also ruled that states had the authority to regulate certain drugs.\u00a0<\/p>\n<p>\u201cIt is well within a State\u2019s police power to ban off-label uses of certain drugs.
