Supreme Court Justice Neil Gorsuch is a perfect example. His majority opinion in\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-476_c185.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>303 Creative v. Elenis<\/em><\/a>, issued on the last day of the court\u2019s term this year, fills in the gaps in decisions\u00a0regarding\u00a0same-sex marriage written by his former boss, Justice Anthony Kennedy.\u00a0\u00a0<\/p>\n<p>In writing for the 6-3 majority, Gorsuch explained why Lorie Smith, an evangelical Christian website designer from Denver with a traditional view of marriage, should not be compelled to create a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/colorado-web-designer-loses-same-sex-wedding-website-case\/\" title=\"Colorado Web Designer Loses Same-Sex Wedding Website Case\">wedding website<\/a> for a same-sex ceremony.\u00a0\u00a0<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-698040242\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-6e1692aff534bf704c68445355b0b02a fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-6e1692aff534bf704c68445355b0b02a\"><\/div>\n<p>The state of Colorado, he wrote, was using its Colorado Anti-Discrimination Act (CADA) to try to compel Smith to endorse same-sex marriages. Such \u201ccompelled speech,\u201d he explained, is inconsistent with the Constitution. And \u201cwhen a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/8-straight-fire-quotes-from-neil-gorsuchs-defense-of-free-speech-in-303-creative\/\" title=\"Neil Gorsuch passionately defended free speech in his defense of 303 Creative with these 8 powerful quotes.\">state <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/religious-freedom-advocates-celebrate-after-scotus-sides-with-catholic-group-on-gay-couple-foster-parents\/\" title=\"Religious Freedom Advocates Celebrate After SCOTUS Sides With Catholic Group On Gay Couple Foster Parents\">public accommodations law<\/a><\/a> and the Constitution collide, there can be no question which must prevail.\u201d\u00a0\u00a0<\/p>\n<p>Many Christians will be pleased by Gorsuch\u2019s unequivocal statement. The Trump-appointed justice has been viewed\u00a0by some\u00a0with suspicion since 2020, when he infamously authored the court\u2019s majority opinion in\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/19pdf\/17-1618_hfci.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Bostock v. Clayton County<\/em><\/a>. His opinion radically expanded Title VII\u2019s prohibition against discrimination\u00a0on the basis of\u00a0sex to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rep-taylor-greene-urges-lawmakers-to-oppose-unconstitutional-equality-act\/\" title=\"Rep. Taylor Greene urges lawmakers to oppose \u2018unconstitutional\u2019 Equality Act\">include sexual orientation<\/a> and gender identity, a decision guaranteed to divide Americans who take different views on this sensitive topic. He noted that the objecting employers did not raise any defenses based on the First Amendment\u2019s free exercise guarantee with the court and added, \u201cWe are also deeply concerned with preserving the promise of the free exercise of religion enshrined in our Constitution; that guarantee lies at the heart of our pluralistic society.\u201d\u00a0\u00a0<\/p>\n<p>Gorsuch\u2019s\u00a0<em>303 Creative v.\u00a0Elenis<\/em>\u00a0opinion should redeem him in the eyes of some of his critics. And, significantly, it will clear up some of the confusion created in 2015 by the Supreme Court\u2019s recognition of a right to same-sex marriage in\u00a0<a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/14-556#writing-14-556_OPINION_3\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Obergefell v. Hodges<\/em><\/a>, whose majority opinion was written by Justice Kennedy, for whom Gorsuch had been a law clerk.\u00a0\u00a0<\/p>\n<p>At the time, Kennedy stressed that \u201cthe First Amendment ensures that religious organizations and persons are given proper protection as they seek to teach the principles that are so fulfilling and so central to their lives and faiths, and to their own deep aspirations to continue the family structure they have long revered.\u201d Whether such protection should be defined broadly was left for another day.\u00a0\u00a0<\/p>\n<div class=\"fdrlst__b89e9-e504ecb8bc1cfa3fb11342a542a9e1d3 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-e504ecb8bc1cfa3fb11342a542a9e1d3\"><\/div>\n<p>Three years later, questions about the scope of such \u201cproper protection\u201d were raised with the court in\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/17pdf\/16-111_j4el.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Masterpiece Cakeshop v. Colorado Civil Rights Commission<\/em><\/a>. Kennedy, again writing the court\u2019s majority opinion, ruled in favor of Jack Phillips, a Colorado cake artist who refused to create custom wedding cakes for same-sex weddings.\u00a0But\u00a0rather than address the constitutional issues head-on, Kennedy side-stepped them, grounding his opinion in the extreme hostility of the state\u2019s civil rights commissioners to Phillips\u2019 Christian beliefs,\u00a0leaving the real issue of compelled speech up for debate. <\/p>\n<p>Now, unlike Kennedy, Gorsuch has stepped into the breach, affirming that the Constitution\u2019s free speech guarantee prevents the government from demanding ideological conformity in support of same-sex marriage.\u00a0\u00a0<\/p>\n<p>\u201cWe do not question the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gorsuch-wrote-the-opinion-kennedy-should-have-to-bolster-the-first-amendment\/\" title=\"Gorsuch's opinion strengthens the First Amendment, which Kennedy should have written.\">vital role public accommodations laws play<\/a> in realizing the civil rights of all Americans,\u201d\u00a0observed\u00a0Gorsuch. \u201cAt the same time, this Court has also recognized that no public accommodations law is immune from the demands of the Constitution.\u201d\u00a0\u00a0<\/p>\n<p>Just as Lorie Smith diligently brought her petition all the way to the Supreme Court, employers with traditional Christian views on the nature of the human person will soon be asking for the court\u2019s protection to\u00a0operate\u00a0consistent with their beliefs.\u00a0And it\u2019s a\u00a0comfort\u00a0to know that Gorsuch, along with a majority of his colleagues, is ready to respect their requests.\u00a0<\/p>\n<div class=\"fdrlst__b89e9-fe9f171f4c5bff5d609bafe7c8c807fb fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-fe9f171f4c5bff5d609bafe7c8c807fb\"><\/div>\n<div class=\"fdrlst__b89e9-e2565d0c3e0f780ac214a6f79baa5d8e fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-e2565d0c3e0f780ac214a6f79baa5d8e\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court Justice Neil Gorsuch, once a student, now masters the law.
