However, the Supreme Court ruled against it by a 6-3 margin, with Roberts emphasizing that Biden lacked the authority to act unilaterally on the issue under the COVID-era HEROES Act.<\/p>\n<blockquote>\n<p>&#8220;The Secretary asserts that the HEROES Act grants him the authority to cancel $430 billion of student loan principal. It does not. We hold today that the Act allows the Secretary to &#8216;waive or modify&#8217; existing statutory or regulatory provisions applicable to financial assistance programs under the Education Act, not to rewrite that statute from the ground up,&#8221;<\/p>\n<p>&#8211; Chief Justice John Roberts<\/p>\n<\/blockquote>\n<p>Roberts further supported his argument by referencing Pelosi&#8217;s own statement, where she acknowledged that Biden had the power to make changes in the time or manner of payments but not to waive them entirely. Pelosi had stated, &#8220;People think that the President of the United States has the power for debt forgiveness. He does not. He can postpone. He can delay. But he does not have that power.
