Reinforcing their opinion, the court\u2019s majority noted a July 28, 2021 press conference in which Pelosi also cast doubt on the possibility of student loan cancellation.<\/p>\n<blockquote>\n<p>\u201cAs then-Speaker of the House Nancy Pelosi explained: \u2018People think that the President of the United States has the power for debt forgiveness. He does not. He can postpone. He can delay. But he does not have that power. That has to be an act of Congress,&#8217;\u201d reads the majority opinion (<a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/22-506_nmip.pdf\">pdf<\/a>) as written by Chief Justice John Roberts.<\/p>\n<\/blockquote>\n<p>Roberts was joined in his decision by Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett.<\/p>\n<p>The Biden administration argued that the HEROES Act, which passed with unanimous support in 2003, enabled his administration to cancel student loans. The 2003 law states that the secretary of education, an executive branch office, has the authority to \u201cwaive or modify\u201d student loan repayments \u201cin connection with a war or other military operation or national emergency.\u201d<\/p>\n<p>The Biden administration argued that this ability to \u201cwaive or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-cites-nancy-pelosis-own-words-to-justify-blocking-bidens-student-loan-forgiveness-plan\/\" title=\"SCOTUS uses Pelosi's words to justify blocking Biden's student loan forgiveness plan.\">modify\u201d loan repayments includes<\/a> the ability to cancel student debt, and that COVID-19 was a qualifying emergency case for which such debt cancellation could occur. Last year, Biden Administration Education Secretary Miguel Cardona unveiled a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ocasio-cortez-fires-back-after-biden-rejects-proposal-to-cancel-50k-in-student-loan-debt\/\" title=\"Ocasio-Cortez Fires Back After Biden Rejects Proposal To Cancel K In Student Loan Debt\">student loan forgiveness program<\/a> that could have canceled as much as $20,000 in loans for 40 million borrowers.<\/p>\n<p>The Congressional Budget Office said the plan might have cost about $400 billion, but the Wharton School estimated the price tag could have ballooned past $1 trillion.<\/p>\n<p>In her dissenting opinion, Justice Elena Kagan wrote that \u201cStudent loans are in the [Secretary of Education\u2019s] wheelhouse. And so too, Congress decided, relief from those loan obligations in case of emergency.
