Elenis<\/em><\/a>, the high court cited the First Amendment, asserting that Lorie Smith cannot be compelled by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/activists-seek-to-resuscitate-1972-equal-rights-amendment\/\" title=\"Activists Seek to Resuscitate 1972 Equal Rights Amendment\">state civil rights law<\/a> to design websites that contradict her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/satanists-demand-religious-exemption-to-perform-abortion-ritual-illegal-under-texas-law\/\" title=\"Satanists Demand Religious Exemption To Perform \u2018Abortion Ritual\u2019 Illegal Under Texas Law\">deeply-held religious convictions<\/a>. Justice Neil Gorsuch, writing for the majority, emphasized that &#8220;no public accommodations law is immune from the demands of the Constitution.&#8221;<\/p>\n<p>&#8220;The First Amendment prohibits Colorado from forcing a website designer to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-sides-with-web-designer-who-didnt-want-to-create-pro-lgbt-messages\/\" title=\"Supreme Court supports web designer's right to decline pro-LGBT messages.\">create expressive designs speaking messages<\/a> with which the designer disagrees,&#8221; Gorsuch <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-476_c185.pdf\" target=\"_blank\" rel=\"noopener\">wrote<\/a>.<\/p>\n<p>Smith, the graphic designer, expressed her willingness to work with individuals of all sexual orientations but objected to being compelled to create wedding websites for same-sex couples due to her deeply-rooted beliefs.<\/p>\n<p>&#8220;There are some messages I can&#8217;t create no matter who requests them,&#8221; Smith <a href=\"https:\/\/www.cnn.com\/2022\/12\/05\/politics\/supreme-court-same-sex-couples-lorie-smith\/index.html\" target=\"_blank\" rel=\"noopener\">said<\/a> in December.<\/p>\n<p>Smith had delayed expanding her business out of concern that her beliefs would clash with Colorado&#8217;s public accommodations law. Colorado argued that Smith&#8217;s refusal amounted to discrimination against same-sex couples and contended that the law governs conduct rather than speech in the context of running a business in the state.<\/p>\n<p><strong><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1687972190386000&#038;usg=AOvVaw2poz7lKxiyhNV9ljBcMSzM\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/strong><\/p>\n<p>&#8220;Under Colorado&#8217;s logic, the government may compel anyone who speaks for pay on a given topic to accept all commissions on that same topic \u2014 no matter the message \u2014 if the topic somehow implicates a customer&#8217;s statutorily protected trait,&#8221; Gorsuch wrote on behalf of the majority.<\/p>\n<h3>Justice Sotomayor Dissents<\/h3>\n<p>Justice Sonia Sotomayor dissented, joined by Justices Elena Kagan and Ketanji Brown Jackson, denouncing the ruling as &#8220;profoundly wrong&#8221; and arguing that the Constitution does not grant the right to refuse service to a disfavored group.<\/p>\n<p>&#8220;Today is a sad day in American constitutional law and in the lives of LGBT people. The Supreme Court of the United States declares that a particular kind of business, though open to the public, has a constitutional right to refuse to serve members of a protected class. The Court does so for the first time in its history,&#8221; Sotomayor wrote.<\/p>\n<p>&#8220;The immediate, symbolic effect of the decision is to mark gays and lesbians for second-class status,&#8221; she added.<\/p>\n<p>Gorsuch took the opportunity to criticize Sotomayor&#8217;s dissent in his majority opinion.<\/p>\n<p>&#8220;It is difficult to read the dissent and conclude we are looking at the same case,&#8221; Gorsuch wrote.<\/p>\n<p>The central question at hand is whether a state can compel an individual who provides expressive services to abandon their conscience and convey a message they disagree with.
