Jean Carroll. Just two days after Trump countersued Carroll for defamation, the judge rejected Trump&#8217;s request to dismiss the charges against him.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.543790\/gov.uscourts.nysd.543790.172.0_4.pdf\" target=\"_blank\" rel=\"noopener\">46-page opinion<\/a>, the judge firmly denied Trump&#8217;s claims of &#8220;absolute presidential immunity&#8221; and refused to dismiss the case on any of the four grounds presented by Trump.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Carroll is suing Trump for defamation after he publicly declared in a 2019 <a href=\"https:\/\/thehill.com\/homenews\/administration\/450116-trump-vehemently-denies-e-jean-carroll-allegation-shes-not-my-type\/\" target=\"_blank\" rel=\"noopener\">interview<\/a> that she was lying about her allegation of rape against him in the 1990s.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Trump&#8217;s response to the allegation was, &#8220;I&#8217;ll say it with great respect: Number one, she&#8217;s not my type. Number two, it never happened. It never happened, okay?&#8221; However, a jury recently found Trump guilty of sexually assaulting Carroll and held him liable for defamation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/manhattan-da-moves-to-restrict-trumps-access-to-some-evidence\/\" title=\"Manhattan DA Moves To Restrict Trump\u2019s Access To Some Evidence\">legal battle continues<\/a> as Carroll filed a third defamation claim against Trump for his remarks during a CNN Town Hall in May. In response, Trump countersued Carroll for defamation over a <a href=\"https:\/\/www.cnn.com\/2023\/06\/28\/politics\/trump-e-jean-carroll-defamation\/index.html\" target=\"_blank\" rel=\"noopener\">comment she made on CNN<\/a> following the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dershowitz-chauvin-conviction-should-be-reversed-on-appeal-maxine-waters-used-kkk-playbook-to-intimidate-jury\/\" title=\"Dershowitz: Chauvin Conviction \u2018Should Be Reversed On Appeal,\u2019 Maxine Waters Used KKK \u2018Playbook\u2019 To Intimidate Jury\">jury verdict<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Trump argued for the dismissal of the claims, citing &#8220;non-waivable&#8221; presidential immunity. He claimed that his ability to govern the nation was threatened by Carroll&#8217;s accusations. However, U.S. District Court Judge Lewis Kaplan concluded that Trump failed to demonstrate a connection between Carroll&#8217;s statements and his official responsibilities as president.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Judge Kaplan also noted that even if presidential immunity did apply, Trump&#8217;s delay in invoking it when Carroll filed the suit weakened his argument.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Carroll&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rejects-trumps-bid-to-dismiss-defamation-lawsuit\/\" title=\"Judge denies Trump's request to dismiss defamation lawsuit.\">attorney expressed satisfaction<\/a> with the judge&#8217;s decision, stating that it removes another obstacle to the upcoming trial scheduled for January 15.<\/span><\/p>\n<p><span style=\"font-weight: 400\">With this rejection, the case will proceed to trial, adding to the list of pending cases against Trump, including an <a href=\"https:\/\/www.dailywire.com\/news\/breaking-trump-says-hes-been-indicted-in-federal-documents-investigation\" target=\"_blank\" rel=\"noopener\">indictment by the Department of Justice<\/a> over alleged mishandling of classified documents.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>defamation and the judge denied Trump&#8217;s request to dismiss the charges.
