On Thursday, the Supreme Court declared that Harvard\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ketanji-brown-jackson-will-recuse-herself-from-harvard-race-case\/\" title=\"Ketanji Brown Jackson Will Recuse Herself from Harvard Race Case\">affirmative action admissions policy<\/a> was in violation of Title VI of the Civil Rights Act, as it used race as a factor when determining admissions.<\/p>\n<p>While this ruling is undoubtedly a win for justice in America, it is important to not celebrate too soon, as the exact nature of the ruling suggests that universities have a chance to skirt the ruling.<\/p>\n<p>Turns out, there is nothing in the Supreme Court\u2019s ruling that prevents a university from <strong>\u201cconsidering an applicant\u2019s discussion of how race has affected the applicant\u2019s life.\u201d<\/strong><\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">So the old rule was schools can do affirmative action so long as they disguise it as being about the educational benefits of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/betsy-mccaughey-the-campus-diversity-scam\/\" title=\"Betsy McCaughey: The Campus Diversity Scam\">student body diversity<\/a> and the new rule is they can do it so long as they disguise it as being about considering how race affected applicants lives.  <a href=\"https:\/\/t.co\/MCEN3usKsY\">pic.twitter.com\/MCEN3usKsY<\/a><\/p>\n<p>\u2014 Matt Bruenig (@MattBruenig) <a href=\"https:\/\/twitter.com\/MattBruenig\/status\/1674427655624753156?\">June 29, 2023<\/a><\/p>\n<\/blockquote>\n<p>As one Twitter user pointed out, <strong>\u201cno law is without loopholes that can be exploited by a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/harvard-reveals-how-itll-use-loophole-to-skirt-supreme-court-ruling-we-will-certainly-comply\/\" title=\"Harvard to Comply with Supreme Court Ruling Using Loophole\">properly motivated administrative bureaucracy<\/a>.\u201d<\/strong><\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">It is undoubtedly a good thing AA is being overturned\u2013\u2013tearing down progressive idols is always worth doing\u2013\u2013but also, below is a good reminder that no law is without loopholes that can be exploited by a properly motivated administrative bureaucracy <a href=\"https:\/\/t.co\/id6MRICZC3\">https:\/\/t.co\/id6MRICZC3<\/a><\/p>\n<p>\u2014 Lomez (@L0m3z) <a href=\"https:\/\/twitter.com\/L0m3z\/status\/1674438780697346048?\">June 29, 2023<\/a><\/p>\n<\/blockquote>\n<p>Sure enough, Harvard has already stated that they are going to exploit the loophole to continue with a form of affirmative action.<\/p>\n<p>In a <a href=\"https:\/\/view.hu.harvard.edu\/?qs=eadb8f5246fa9767a1dd99781450e131a0c9fe09ed032c70073cf7cafef1ab01fbdb6d292cbdc8f660f65421949b337dea41158ef165ee2f774599e5744ec3223e15a2a701351bc16a39d000e1a5f806\" target=\"_blank\" rel=\"noopener\">statement<\/a> immediately following the ruling, one would have expected the school to make a big stink about it. Instead, Harvard readily announced that it would comply with the Supreme Court\u2019s ruling, and it cited the loophole as its reason for doing so.<\/p>\n<p>\u201cThe Court also ruled that colleges and universities may consider in admissions decisions \u2018an applicant\u2019s discussion of how race affected his or her life, be it through discrimination, inspiration, or otherwise,\u2019\u201d the statement read.<\/p>\n<p>\u201cWe will certainly comply with the Court\u2019s decision,\u201d it continued.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The Supreme Court gave universities a narrow opening, and Harvard just announced it\u2019s going to drive an affirmative action truck right through it. <a href=\"https:\/\/t.co\/Icj8ubIcpn\">https:\/\/t.co\/Icj8ubIcpn<\/a> <a href=\"https:\/\/t.co\/jBD2qCcRHt\">pic.twitter.com\/jBD2qCcRHt<\/a><\/p>\n<p>\u2014 William A. Jacobson (@wajacobson) <a href=\"https:\/\/twitter.com\/wajacobson\/status\/1674453147152965632?\">June 29, 2023<\/a><\/p>\n<\/blockquote>\n<p>It almost seems as if affirmative action was not completely ended, but instead, universities are adopting a sneakier form of it that does not make race a factor in the decision-making process but does still bring it into consideration.<\/p>\n<p>This has led many to wonder if this will just lead to colleges and universities simply lowering their standards, or finding all new metrics by which to measure a prospective student in order to keep a form of affirmative action alive.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">What comes next? Not merit-based university admissions.
