Court<\/h2>\n<blockquote>\n<p>On June 22, according to a report by <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4064299-supreme-court-rules-biden-administration-can-choose-who-to-deport\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>, SCOTUS ruled 8-1 that Texas and Louisiana lacked standing to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pences-former-chief-of-staff-there-were-significant-concerns-with-the-2020-election\/\" title=\"Pence\u2019s Former Chief of Staff: \u2018There Were Significant Concerns\u2019 With The 2020 Election\">bring legal challenges<\/a> against the Biden administration\u2019s deportation guidelines.<\/p>\n<\/blockquote>\n<p>Justice Brett Kavanaugh wrote the majority opinion.<\/p>\n<p>\u201cThe States essentially want the Federal Judiciary to order the Executive Branch to alter its arrest policy so as to make more arrests,\u201d <a href=\"https:\/\/www.westernjournal.com\/activists-mob-brett-kavanaughs-home-50th-anniversary-roe-v-wade\/\" target=\"_blank\" rel=\"noopener\">Kavanaugh<\/a> wrote.<\/p>\n<p>He added that SCOTUS \u201chas long held that \u2018a citizen lacks standing to contest the policies of the prosecuting authority when he himself is neither prosecuted nor threatened with prosecution.&#8217;\u201d<\/p>\n<p>In lower courts, Texas and Louisiana had successfully argued that the Biden administration\u2019s immigration policies placed undue burden on the states\u2019 law enforcement and social services budgets.<\/p>\n<p>Spencer Brown, managing editor for Townhall, <a href=\"https:\/\/townhall.com\/tipsheet\/spencerbrown\/2023\/06\/23\/supreme-court-upholds-biden-immigration-policy-on-a-technicality-n2624908\" target=\"_blank\" rel=\"noopener\">explained<\/a> that SCOTUS issued this decision \u201cWithout ruling on the merits of an immigration policy enacted by the Biden administration.\u201d<\/p>\n<p>Justice Samuel Alito dissented.<\/p>\n<p>\u201cThis sweeping Executive Power endorsed by today\u2019s decision may at first be warmly received by champions of a strong Presidential power,\u201d Alito wrote, \u201cbut if presidents can expand their powers as far as they can manage in a test of strength with Congress, presumably Congress can cut executive power as much as it can manage by wielding the formidable weapons at its disposal.\u201d<\/p>\n<p>Alito blasted his colleagues for shirking their constitutional duties.<\/p>\n<p>\u201cBut when we have jurisdiction, we have a \u2018virtually unflagging obligation\u2019 to exercise that authority,\u201d he added.<\/p>\n<p>Conservatives have good reason to feel frustrated.<\/p>\n<p>SCOTUS\u2019 \u201clacks standing\u201d excuse no doubt reminds readers of the Court\u2019s decision to weasel out of reviewing massive and widespread fraud allegations following the <a href=\"https:\/\/www.westernjournal.com\/official-election-data-drops-2020-bombshell-thousands-ballots-may-illegally-cast\/\" target=\"_blank\" rel=\"noopener\">2020 election<\/a>.<\/p>\n<p>It also might remind readers of the semantics Chief Justice John Roberts employed in 2012 when SCOTUS upheld the constitutionality of the 2010 Affordable Care Act.<\/p>\n<p>Some might believe that SCOTUS\u2019 recent landmark decisions on <a href=\"https:\/\/www.westernjournal.com\/happy-birthday-dobbs-tens-thousands-babies-saved-last-year-stats\/\" target=\"_blank\" rel=\"noopener\">abortion<\/a> and <a href=\"https:\/\/www.westernjournal.com\/breaking-supreme-court-deals-crushing-blow-affirmative-action-college-admissions\/\" target=\"_blank\" rel=\"noopener\">affirmative action<\/a> offset its dubious judgment in other cases.<\/p>\n<p>Contemporary political concerns aside, this case involves the oldest and deepest of constitutional issues.<\/p>\n<p>In short, the U.S. system of constitutional federalism, properly understood, gives Texas and Louisiana all the standing and redress they should need.<\/p>\n<p>The central question here has nothing to do with standing before SCOTUS.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-disses-states-again-latest-ruling-will-aid-bidens-steady-flow-of-illegals\/\" title=\"SCOTUS ruling supports Biden's immigration policies\">central question involves options<\/a> available to states when the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-attorney-general-to-sue-biden-admin-over-illegal-deportation-freeze\/\" title=\"Texas Attorney General to Sue Biden Admin Over \u201cIllegal Deportation Freeze\u201d\">federal government fails<\/a> to uphold the Constitution.<\/p>\n<p>In 1798, all three branches of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/leaked-email-alleges-arizona-gov-elect-katie-hobbs-twitter-employees-colluded-to-censor-election-related-misinformation\/\" title=\"Leaked Email Alleges Arizona Gov-Elect Katie Hobbs, Twitter Employees Colluded To Censor \u2018Election Related Misinformation\u2019\">federal government conspired<\/a> to trample the Bill of Rights by first adopting and then upholding the tyrannical Alien and Sedition Acts.<\/p>\n<p>Thomas Jefferson and <a href=\"https:\/\/www.westernjournal.com\/founders-sought-perfect-union-unleashed-unprecedented-liberty-process\/\" target=\"_blank\" rel=\"noopener\">James Madison<\/a> responded by arguing that when the federal government threatens the rights and liberties of the people, the states have a responsibility to intervene.<\/p>\n<p>Texas and Louisiana have proven that the Biden administration\u2019s deportation guidelines threaten the rights and liberties of the sovereign people of those two states.<\/p>\n<p>Texas and Louisiana need not appeal to SCOTUS. Texas and Louisiana may take action <a href=\"https:\/\/www.westernjournal.com\/fed-county-tells-illegals-free-rides-get-ready-deported\/\" target=\"_blank\" rel=\"noopener\">on their own<\/a>.<\/p>\n<p>This, I realize, might strike some readers as jarring and controversial, a callback to the days of nullification.<\/p>\n<p>If so, the jarring and controversial aspect stems not from the Constitution but from a two-centuries-old habit of deference to judicial review.<\/p>\n<p>The Constitution entrusts SCOTUS with final appellate jurisdiction, but it does not identify SCOTUS as the final word on the meaning of the Constitution.<\/p>\n<p>During the most vehement constitutional disputes of the 1790s, contestants on all sides adopted a variety of arguments.<\/p>\n<p>At no time, however, did they think to consult the Supreme Court for final word on the Constitution\u2019s meaning.<\/p>\n<p>Chief Justice John Marshall\u2019s Supreme Court smuggled the concept of judicial review into the Constitution beginning in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mansour-the-pilgrims-progress-honoring-our-forefathers-on-the-400th-anniversary-of-the-first-and-most-expensive-thanksgiving\/\" title=\"Mansour: The Pilgrims\u2019 Progress \u2013 Honoring Our Forefathers on the 400th Anniversary of the First (and Most Expensive) Thanksgiving\">early nineteenth century<\/a>.<\/p>\n<p>Since then, the Constitution\u2019s original intent has yielded to a much more expansive view of judicial power.<\/p>\n<p>There is irony in this analysis, of course, because SCOTUS\u2019 ruling against Texas and Louisiana seems at first glance an act of judicial restraint.<\/p>\n<p>The problem, however, as evidenced by the lower courts\u2019 acknowledgment of the burdens Biden\u2019s immigration policies have placed on those two states, is that according to the doctrine of judicial review the sovereign people of Texas and Louisiana now have nowhere to turn.<\/p>\n<p>In a system of constitutional federalism, that conclusion cannot stand.<\/p>\n<h3>Read More: <a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\/scotus-disses-states-latest-ruling-will-aid-bidens-steady-flow-illegals\/\">SCOTUS Disses States Again \u2013 Latest Ruling Will Aid Biden&#8217;s Steady Flow of Illegals<\/a><\/h3>\n<p>The post appeared first on <a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\">The Western Journal<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Conservatives may not be fully satisfied with their self-proclaimed &#8220;conservative&#8221; Supreme Court.
