In a filing submitted to federal court on Tuesday, the Department of Justice argued that the law is unconstitutional.<\/p>\n<p>The case, Shen v. Simpson, is currently being heard in the U.S. District Court for the Northern District of Florida. The Biden administration filed a &#8220;statement of interest&#8221; in support of the plaintiffs, a group of Chinese citizens residing in Florida, who are seeking to invalidate the law before it takes effect on Saturday.<\/p>\n<p>The DOJ&#8217;s filing states that the law violates the Equal Protection Clause of the 14th Amendment of the U.S. Constitution, as well as the Fair Housing Act, which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rutgers-law-drops-policy-requiring-student-groups-to-promote-critical-race-theory\/\" title=\"Rutgers Law Drops Policy Requiring Student Groups To Promote Critical Race Theory\">prohibits discrimination based<\/a> on national origin in property sales.<\/p>\n<p>The DOJ further argues that the law will cause harm to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-corporations-launder-their-race-discrimination-through-third-parties\/\" title=\"How Corporations Launder Their Race Discrimination Through Third Parties\">individuals based solely<\/a> on their national origin, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/big-tech-censorship-left-wing-violence-in-national-spotlight\/\" title=\"Big Tech censorship, left-wing violence in national spotlight\">undermine constitutional rights<\/a>, and fail to achieve its intended goal of increasing public safety.<\/p>\n<h3>Plaintiffs Likely to Succeed<\/h3>\n<p>The DOJ also expressed confidence that the plaintiffs will succeed in their lawsuit. The group of Chinese citizens operates brokerage businesses primarily serving Chinese and Chinese American clients.<\/p>\n<h3>DeSantis Responds<\/h3>\n<p>Florida Governor Ron DeSantis, a Republican who is running for president, responded to the DOJ&#8217;s submission on Twitter. They are represented by organizations such as the American Civil Liberties Union and the Asian American Legal Defense and Education Fund.<\/p>\n<p>Ashley Gorski, a senior staff attorney with the ACLU&#8217;s National Security Project, stated that the law is unfair, unjustified, and unconstitutional. She emphasized that everyone in the United States, including citizens of other countries, is entitled to equal protection under the law.<\/p>\n<h3>Florida&#8217;s Land Ownership Restrictions<\/h3>\n<p>Florida&#8217;s law prohibits Chinese citizens domiciled in China from purchasing land in the state. It also restricts citizens of other &#8220;countries of concern&#8221; from buying agricultural land or any real property within 10 miles of a military installation or critical infrastructure facility. The countries of concern include Russia, North Korea, Syria, Venezuela, Cuba, and Iran.
