Remember all that talk about Jackson\u2019s &#8220;<a href=\"https:\/\/reason.com\/2022\/12\/15\/ketanji-brown-jackson-and-the-future-of-progressive-originalism\/\" target=\"_blank\" rel=\"noreferrer noopener\">progressive originalism<\/a>?&#8221; It\u2019s not a thing.<\/p>\n<p>Instead, Jackson offered more than 9,000 overwrought words of leftist social commentary, &#8220;expound[ing] upon the universal benefits of considering race in this context.&#8221; Her embrace of identitarianism and her defense of Asian-American discrimination is jarring. Jackson believes state-funded institutions should judge Americans by their immutable characteristics and historical sins rather than their individual accomplishments and actions. It\u2019s really that simple.<\/p>\n<p>&#8220;With let-them<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/of-course-ketanji-brown-jackson-supports-affirmative-action-its-the-only-reason-shes-a-supreme-court-justice\/\" title=\"Ketanji Brown Jackson backs Affirmative Action, her path to Supreme Court.\">-eat-cake obliviousness<\/a>, today, the majority pulls the ripcord and announces &#8216;colorblindness for all&#8217; by legal fiat,&#8221; Jackson sarcastically wrote. I dunno; colorblindness seems like a worthy ambition. But the Supreme Court didn\u2019t institute &#8220;colorblindness for all.&#8221; It can\u2019t. What it did was reaffirm colorblindness <em>as a matter of law<\/em>. On this topic, the <a href=\"https:\/\/www.law.cornell.edu\/constitution\/amendmentxiv\" target=\"_blank\" rel=\"noreferrer noopener\">Fourteenth Amendment<\/a> and Title VI of the Civil Rights Act of 1964 is clear:<\/p>\n<blockquote>\n<p>No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.<\/p>\n<\/blockquote>\n<p>The Civil Rights Act does not make exceptions for disadvantaged groups, &#8220;lived experiences,&#8221; or race \u2014 quite the opposite. Using Jackson\u2019s logic, any institution could adopt any racial preferences they wanted. Though, in fairness, there isn\u2019t much logic to be had in progressive Calvinlaw.<\/p>\n<p>Moreover, as Jackson surely knows, the Supreme Court exists to use &#8220;legal fiat&#8221; to uphold the Constitution. Every opinion that Jackson has been on the majority has used this approach.<\/p>\n<p>It is worth reiterating that for every &#8220;affirmative&#8221; race-based admission to a college, there is an instance of race-based discrimination. Jackson argues that government-funded policies that are prejudiced against white and <a href=\"https:\/\/thefederalist.com\/2023\/01\/06\/americas-systemic-racism-problem-is-mostly-in-woke-anti-asian-education-bureaucracies\/\" target=\"_blank\" rel=\"noreferrer noopener\">Asian kids<\/a> \u2014 all of them, no matter how hard they work or what their backgrounds might be \u2014 are not only legal but necessary.<\/p>\n<p>Jackson barely bothers to wrestle with the legality of affirmative action in her commentary, instead creating two hypothetical strawstudents \u2014 John and James, one white and one black. Never once does the justice imagine that a white kid from, say, rural West Virginia might have overcome more societal barriers than a black kid from a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-global-investors-gobbling-up-single-family-homes-in-u-s-pushing-out-first-time-buyers-driving-up-housing-costs\/\" title=\"Report: Global Investors Gobbling Up Single Family Homes in U.S. Pushing out First-Time Buyers, Driving Up Housing Costs\">middle-class suburb<\/a> in Los Angeles. In her worldview, a black kid can\u2019t overcome barriers without a lowering of standards. That is an extraordinarily corrosive and demeaning position to take. And it also has nothing to do with the law. (It\u2019s worth remembering that it\u2019s highly <a href=\"https:\/\/thefederalist.com\/2022\/11\/03\/defenders-of-race-based-college-admissions-cant-explain-its-educational-benefits\/\" target=\"_blank\" rel=\"noreferrer noopener\">debatable<\/a> whether <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ketanji-brown-jacksons-dissent-is-an-argument-for-institutional-racism\/\" title=\"Ketanji Brown Jackson's dissent highlights institutional racism.\">affirmative action helps minority students<\/a>.)<\/p>\n<p>The hypothetical couple in Jackson\u2019s dissent <em>should be<\/em> James and the son of immigrants from India or Vietnam. Many Asians come to the United States from crushing generational poverty and racist caste systems. Many of these immigrants, as immigrants <a href=\"https:\/\/www.jewishvirtuallibrary.org\/harvard-s-jewish-problem\" target=\"_blank\" rel=\"noreferrer noopener\">in the past<\/a>, have proven that, despite all our well-documented imperfections, the United States is, at heart, a meritocracy. It\u2019s why people &#8220;of color&#8221; flood our borders. That\u2019s a highly inconvenient reality for the left.<\/p>\n<p>Jackson is free to make the case that our history has robbed black Americans of their agency, and so the Fourteenth Amendment should be rewritten. She is free to believe that Asian Americans and whites, and perhaps others, do not deserve equal protection under the law.
