And having so detached itself from this country\u2019s actual past and present experiences, the Court has now been lured into interfering with the crucial work that UNC and other institutions of higher learning are doing to solve America\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/i-battled-rhode-islands-cookie-police\/\" title=\"I Battled Rhode Island\u2019s Cookie Police\">real-world problems<\/a>.\u201d<\/p>\n<\/blockquote>\n<p>Jackson\u2019s assertion that the Students for Fair Admissions decision is \u201ctruly a tragedy for us all\u201d is not the least bit surprising considering that her ascent to the bench reeked of race-based choosing.<\/p>\n<p>No matter how hard the left tries to paint Jackson\u2019s rise as \u201cmonumental,\u201d there\u2019s no denying that the Biden administration handed Jackson a position in the highest court in the land based on her sex and race.<\/p>\n<p>Even before he became president, Biden made it clear that nominating a black woman to Supreme Court was a top priority. When the time came to fill a spot on the bench, Biden did not offer a list of potential SCOTUS picks.<\/p>\n<p>Instead, he reaffirmed his commitment to nominating someone based on her chromosomes and skin color.<\/p>\n<p><strong>[READ: Biden\u2019s Pledge To Nominate A Black Woman For SCOTUS Is Racist And Sexist]<\/strong><\/p>\n<p>Jackson had a myriad of judicial shortcomings and a strong partisan background that should have disqualified her from a SCOTUS shortlist. Since she was only one of a handful of judges who fit the bill and the Biden administration had no problems with adding an activist to the bench, Jackson received the nomination.<\/p>\n<p>During Jackson\u2019s confirmation hearings, Democrats and corporate media pretended that Biden\u2019s sexist and racist pledge was rooted not in identity politics, but in the search for merit and skill.<\/p>\n<p>\u201cIt is about time that we have a highly qualified, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/day-one-biden-nominee-promises-to-defend-the-constitution-as-republicans-take-aim-at-her-record\/\" title=\"Day One: Biden Nominee Promises To Defend The Constitution As Republicans Take Aim At Her Record\">highly accomplished black woman serving<\/a> on the Supreme Court,\u201d Sen. Mazie Hirono proclaimed at Jackson\u2019s opening remarks.<\/p>\n<p>It was in those same hearings that Jackson admitted she couldn\u2019t define what a woman is because she\u2019s \u201cnot a biologist.\u201d<\/p>\n<p>With the help of Republicans, who received praise from the president for flip-flopping on Jackson\u2019s confirmation, Jackson was eventually installed on the court. Suddenly, the same Senate Democrats who shunned Republicans for calling out Biden\u2019s race-baiting celebrated Jackson\u2019s ascent as \u201chistoric\u201d and ceiling-shattering because she was a black woman.<\/p>\n<p>As the court\u2019s majority demonstrated on Thursday, the affirmative action Jackson benefits from is destructive because, as Justice Clarence Thomas wrote, \u201cany sorting mechanism that takes race into account in any way \u2026 has discriminated based on race to the benefit of some races and the detriment of others.\u201d<\/p>\n<p>Jackson\u2019s attempt to paint the \u201cmajority\u2019s judgment\u201d as something that \u201cstunts that progress without any basis in law, history, logic, or justice\u201d earned her several scoldings in footnotes penned by Thomas and Chief Justice John Roberts.<\/p>\n<p>Both noted the shortcomings not just of Jackson\u2019s dissent but also of her \u201crace-infused world view\u201d more than a dozen times.<\/p>\n<p>Roberts pointed out that Jackson tried to \u201cminimize the role that race plays in UNC\u2019s admissions\u201d even though she later \u201cacknowledges that race\u2014and race alone\u2014explains the admissions decisions for hundreds if not thousands of applicants to UNC each year.\u201d<\/p>\n<p>Roberts also warned that Jackson\u2019s assertion that the court \u201cmust \u2018get out of the way,\u2019 \u2018leav[e] well enough alone,\u2019 and defer to universities and \u2018experts\u2019 in determining who should be discriminated against\u201d essentially \u201cadvocates abandoning the demands of strict scrutiny.\u201d<\/p>\n<p>\u201cAn opinion professing fidelity to history (to say nothing of the law) should surely see the folly in that approach,\u201d Roberts retorted.<\/p>\n<p>Thomas, similarly, said Jackson\u2019s belief that \u201calmost all of life\u2019s outcomes may be unhesitatingly ascribed to race\u201d actually \u201cfalls flat at each step.\u201d<\/p>\n<p>\u201cAs she sees things, we are all inexorably trapped in a fundamentally racist society, with the original sin of slavery and the historical subjugation of black Americans still determining our lives today,\u201d Thomas wrote. \u201cThe panacea, she counsels, is to unquestioningly accede to the view of elite experts and reallocate society\u2019s riches by racial means as necessary to \u2018level the playing field,\u2019 all as judged by racial metrics.\u201d<\/p>\n<p>Thomas \u201cstrongly disagree[s]\u201d with that assertion.<\/p>\n<p>\u201cThen as now, not all disparities are based on race; not all people are racist; and not all differences between individuals are ascribable to race,\u201d Thomas wrote.<\/p>\n<p>Yet, that\u2019s the exact ideology Jackson espouses in her dissent \u2014 and the exact ideology Democrats used to elevate her to the bench.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court Justice Ketanji Brown Jackson criticizes her colleagues&#8217; decision deeming Harvard and UNC&#8217;s affirmative action admissions programs unconstitutional.
