Penny, who is free on bond, only uttered the words \u201cnot guilty\u201d before he left the courtroom with his lawyers.<\/p>\n<p>Penny was initially arrested on the <a href=\"https:\/\/www.westernjournal.com\/breaking-alec-baldwin-learns-fate-manslaughter-case\/\" target=\"_blank\" rel=\"noopener\">manslaughter<\/a> charge in May, but a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/deshaun-watson-accusers-sitting-down-for-hbo-interview\/\" title=\"Deshaun Watson Accusers Sitting Down for HBO Interview\">grand jury earlier<\/a> this month added the negligent homicide count, potentially giving a trial jury the option of finding him guilty of the lesser charge.<\/p>\n<p>To get a manslaughter conviction, prosecutors would have to prove Penny recklessly caused Neely\u2019s death while being aware of the risk of serious harm. It could carry a prison sentence of up to 15 years. A conviction for criminally negligent homicide would require the jury to find that Penny unjustifiably put Neely at risk of death, but failed to perceive that risk. The maximum penalty would be four years in prison.<\/p>\n<p>Penny, who served in the Marines for four years and was discharged in 2021, has said he acted to protect himself and others from Neely, who shouted \u201cI\u2019m gonna\u2019 kill you\u201d and said he was \u201cready to die\u201d or go to jail for life.<\/p>\n<p>\u201cHe was yelling in their faces saying these threats,\u201d Penny said in a video released by his attorneys. \u201cI just couldn\u2019t sit still.\u201d<\/p>\n<h3>Was it wrong for prosecutors to charge Daniel Penny?<\/h3>\n<ul>\n<li>Yes<\/li>\n<li>No<\/li>\n<\/ul>\n<p>Neely\u2019s family members and their supporters have said <a href=\"https:\/\/www.westernjournal.com\/retired-marine-daniel-penny-appears-video-tells-world-really-happened-nyc-subway\/\" target=\"_blank\" rel=\"noopener\">Neely<\/a>, who struggled with mental illness and homelessness, was crying out for help and was met with violence.<\/p>\n<p>\u201cWhat happened to Jordan was a crime, and this family shouldn\u2019t have to stand by themselves,\u201d Rev. Al Sharpton said at Neely\u2019s May 19 funeral.<\/p>\n<p>Neely\u2019s death aboard an F train in <a href=\"https:\/\/www.westernjournal.com\/trump-shares-went-inside-manhattan-courthouse-arrest-people-crying\/\" target=\"_blank\" rel=\"noopener\">Manhattan<\/a> quickly became a flashpoint in the nation\u2019s debates over racial justice and crime.<\/p>\n<p>Republican politicians, including Florida Gov.
