Witnesses said Neely was <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ben-shapiro-explains-how-daniel-penny-case-illustrates-two-tiered-justice-system-in-blue-cities\/\" title=\"Ben Shapiro highlights Daniel Penny case as proof of unequal justice in blue cities.\">making threatening comments<\/a> toward passengers on board the vehicle, prompting the former U.S. marine to subdue Neely.<\/p>\n<p>\u201cHe was pacing back and forth on the car,\u201d Penny said. \u201cI came from behind and put him in a chokehold. People in the subway were afraid for their safety.\u201d<\/p>\n<p>Court documents filed on Wednesday reported by the <a href=\"https:\/\/nypost.com\/2023\/06\/28\/daniel-penny-pleads-not-guiltyto-manslaughter-charge\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a> said prosecutors claim they obtained at least five other cellphone videos from three separate witnesses in the deadly incident, which they plan to use as evidence in an upcoming trial.<\/p>\n<p>The documents also state prosecutors have two witnesses\u2019 videotaped statements, two MTA surveillance videos, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/i-fueled-the-wrong-conversation-about-makhia-bryant-lebron-james-avoids-responsibility-portrays-bryant-as-a-victim\/\" title=\"\u2018I Fueled The Wrong Conversation About Ma\u2019Khia Bryant\u2019: LeBron James Avoids Responsibility, Portrays Bryant As A Victim\">police body camera footage<\/a>. Other disclosures in the documents from prosecutors include a videotaped statement that Penny made to police the day of the incident before authorities released him without charges.<\/p>\n<p>\u201cHe came on, threw all his s*** down, was very aggressive, going crazy,\u201d Penny told police, according to the court document. \u201cI was behind him, put him in a choke,\u201d adding Neely was \u201cacting irate, dropping things on the floor, saying he doesn\u2019t care if he goes to jail.\u201d<\/p>\n<p>Neely, a homeless man with over 40 arrests, had a known history of mental issues before he died. His most recent arrest happened in November 2021, when authorities charged him with felony assault after being accused of \u201cslugging a 67-year-old female stranger in the face.\u201d<\/p>\n<p>After pleading guilty to the latter charge, Neely reportedly failed to appear in court, leading to an active warrant for his arrest at the time of his death.<\/p>\n<p><b data-stringify-type=\"bold\"><\/b><\/p>\n<p>After Neely\u2019s death, Penny surrendered to authorities on May 12.<\/p>\n<p>Penny was indicted on June 14 after New York officials promised to investigate the incident. He pled not guilty to second-degree manslaughter and negligent homicide before being freed on $100,000 bail.<\/p>\n<p>\u201cDaniel Penny stands indicted for Manslaughter after allegedly putting Jordan Neely in a deadly chokehold for several minutes until and after he stopped moving,\u201d Manhattan District Attorney Alvin L. Bragg said in a <a href=\"https:\/\/manhattanda.org\/d-a-bragg-announces-manslaughter-indictment-of-daniel-penny-for-the-death-of-jordan-neely\/\" target=\"_blank\" rel=\"noopener\">news release.<\/a> \u201cI hope Mr. Neely\u2019s loved ones are on the path towards healing as they continue to mourn this tragic loss.\u201d<\/p>\n<p>Penny faces up to 19 years in prison if convicted on both counts.<\/p>\n<p>\u201cWe are a long way off from trial, but all the evidence we\u2019ve seen is that our client acted under the law,\u201d said Thomas Keniff, a lawyer for Penny.<\/p>\n<p>Penny\u2019s defense team has consistently maintained his innocence, saying the evidence is in their favor.<\/p>\n<p>\u201cWhile we respect the decision of the grand jury to move this case forward to trial, it should be noted that the standard of proof in a grand jury is very low, and there has been no finding of wrongdoing,\u201d Steven Raiser, also an attorney for Penny, said. \u201cWe\u2019re confident that when a trial jury is tasked with weighing the evidence, they will find Daniel Penny\u2019s actions on that train were fully justified.\u201d<\/p>\n<p>Attorneys for Neely\u2019s family praised the indictment.<\/p>\n<p>\u201cThe grand jury\u2019s decision tells our city and our nation that \u2018no one is above the law\u2019 no matter how much money they raise, no matter what affiliations they claim, and no matter what distorted stories they tell in interviews,\u201d Neely\u2019s family lawyers said.<\/p>\n<p>Penny is scheduled to appear in court next on October 25.<\/p>\n<p><em>Leif Le Mahieu contributed to this report.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Prosecutors in marine veteran Daniel Penny&#8217;s case, who pleaded not guilty in Jordan Neely&#8217;s subway chokehold death, possess more cellphone footage from witnesses.
