(Photo by MANDEL NGAN \/ AFP) (Photo by MANDEL NGAN\/AFP via Getty Images)<\/figcaption><\/figure>\n<h2>OAN\u2019s\u00a0<a href=\"https:\/\/www.oann.com\/tag\/noah-herring\">Noah Herring<\/a><br \/>2:41 PM \u2013 Wednesday, June 28, 2023<\/h2>\n<p>A New York appeals court dismissed Ivanka Trump from New York Attorney General Letitia James\u2019 civil fraud lawsuit against former President Donald Trump, his adult children, and the Trump Organization.\u00a0<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The lawsuit, which was filed in September, alleged that Trump and his three adult children, as well as the Trump organization, were involved in \u201cexpansive fraud\u201d lasting more than 10 years to enrich the former president\u2019s pockets.\u00a0<\/p>\n<p>The New York Appellate Division\u2019s First Department dismissed claims against Ivanka on Tuesday ruling that the statutes of her case had expired since she was not a part of the Trump Organization after 2016.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe record before us\u2026indicates that defendant Ivanka Trump was no longer within the agreement\u2019s definition of \u2018Trump Organization\u2019 by the date the tolling agreement was executed,\u201d the order states. \u201cThe allegations against defendant Ivanka Trump do not support any claims that accrued after February 6, 2016. Thus, all claims against her should have been dismissed as untimely.\u201d<\/p>\n<\/blockquote>\n<p>The filed lawsuit is seeking $250 million in financial penalties and the court was asked to ban Trump and his three adult children, Donald Trump Jr., Ivanka Trump, and Eric Trump, from serving as directors or officers in any corporation that is registered in the state. The court was also requested to bar Trump and the organization from purchasing any real estate in New York or from applying for loans from any financial institution for the next five years.\u00a0<\/p>\n<p>A motion to dismiss the lawsuit was rejected last year by New York Supreme Court Justice Arthur Engoron who ruled that Trump\u2019s legal team\u2019s arguments were \u201cfrivolous.\u201d\u00a0<\/p>\n<p>A spokesperson for James\u2019 office claimed that there was a \u201cmountain of evidence\u201d remaining in their lawsuit against the former president.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWe sued Donald Trump and the Trump Organization after <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ivanka-trump-dismissed-from-ny-ags-lawsuit-against-trump-family\/\" title=\"Ivanka Trump no longer part of NY AG's lawsuit against Trump family.\">uncovering extensive financial fraud<\/a> that continues to this day,\u201d the spokesperson said. \u201cThere is a mountain of evidence that shows Mr. Trump and the Trump Organization falsely and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senate-democrats-believe-bidens-justice-department-will-prosecute-trump-warn-it-could-backfire\/\" title=\"Senate Democrats Believe Biden\u2019s Justice Department Will Prosecute Trump, Warn It Could Backfire\">fraudulently valued multiple assets<\/a> and misrepresented those values to financial institutions for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ivanka-trump-dismissed-from-new-york-attorney-general-letitia-james-fraud-lawsuit\/\" title=\"Ivanka Trump removed from NY AG Letitia James' fraud case.\">significant economic gain<\/a>. Those facts haven\u2019t changed.
