In the audio, Trump confidently states that the document &#8220;totally wins my case.&#8221; He supposedly presented the document while denying allegations that Chairman of the Joint Chiefs Mark Milley restrained him from attacking Iran during his final days in office.<\/p>\n<p>A source familiar with the matter informed <a href=\"https:\/\/www.cbsnews.com\/news\/iran-memo-not-among-the-31-records-underlying-charges-in-trump-federal-indictment\/\" target=\"_blank\" rel=\"noopener\">CBS News<\/a> that the document in question is not part of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/50-year-old-illegal-alien-charged-with-rape-of-minor-says-he-sees-girl-as-a-woman-and-the-devil-made-him-do-it\/\" title=\"50-Year-Old Illegal Alien Charged With Rape Of Minor, Says He Sees Girl As A \u2018Woman\u2019 And \u2018The Devil\u2019 Made Him Do It\">charging document filed<\/a> in a federal court in Florida. The indictment charges Trump with 37 counts, including 31 counts of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-didnt-charge-trump-over-alleged-iran-document-in-audio-recording-report\/\" title=\"DOJ didn't accuse Trump of Iran document in audio: Report.\">willfully retaining national security information<\/a>.<\/p>\n<p>The 31 counts related to national security information briefly describe the underlying documents, but they do not include the alleged Iran attack document mentioned by Trump in the recording, according to CBS News.<\/p>\n<p>Sources previously revealed to CBS News that a document like the one featured in the audio recording was never recovered. Trying to prosecute Trump over a document that was never found would be akin to &#8220;proving a murder case without a body,&#8221; as stated by a former senior Department of Justice official, according to CBS&#8217;s Catherine Herridge.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Multiple sources previously told CBS News defense attorneys were not certain the memo in question was ever recovered and returned to the government.
