The incident led to the death of Neely.<\/p>\n<p>Manhattan District Attorney said that Penny stands \u201cindicted for Manslaughter\u201d and that he hopes \u201cNeely\u2019s loved ones are the path towards healing.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cDaniel Penny stands indicted for Manslaughter after allegedly putting Jordan Neely in a deadly chokehold for several minutes until and after he stopped moving,\u201d Bragg said in a statement. \u201cI hope Mr. Neely\u2019s loved ones are on the path towards healing as they continue to mourn this tragic loss.\u201d<\/p>\n<\/blockquote>\n<p>Penny, who was on his way to the gym that afternoon, said that he did what he felt he had to do out of self-defense and the defense of others on the train. He said that he believed Neely would have \u201ckilled somebody\u201d if he had carried out his threats.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIf [Neely] had carried out his threats, he would have killed somebody,\u201d he told Fox News Digital. \u201cI was scared, I looked around, and I saw older women and children, and they were terrified.\u201d<\/p>\n<\/blockquote>\n<p>Other passengers on the train reported that Neely was being erratic and threatening passengers on the train.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cI don\u2019t care if I have to kill an F, I will,\u201d Neely ranted, according to witnesses. \u201cI\u2019ll go to jail, I\u2019ll take a bullet.\u201d<\/p>\n<\/blockquote>\n<p>Police had questioned and released the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nc-dem-senate-challenger-votes-against-bipartisan-school-reopening-bill\/\" title=\"NC Dem Senate Challenger Votes Against Bipartisan School Reopening Bill\">marine veteran<\/a> after the incident and did not arrest him until May 12<sup>th<\/sup>.<\/p>\n<p>Penny faces 19 years in prison if he is convicted on both charges of second-degree manslaughter and criminally negligent homicide.<\/p>\n<p>Stay informed!
