(Photo by Joe Raedle\/Getty Images)<\/figcaption><\/figure>\n<h2>OAN\u2019s\u00a0<a href=\"https:\/\/www.oann.com\/tag\/noah-herring\">Noah Herring<\/a><br \/>3:52 PM \u2013 Tuesday, June 27, 2023<\/h2>\n<p>Florida Governor Ron DeSantis asked a federal judge on Monday to dismiss the lawsuit that was filed against him by Walt Disney Co. in their battle over the company\u2019s special tax status in the state of Florida.\u00a0<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The motion to Judge Allen Winsor, who was appointed by former President Donald Trump, claims that DeSantis has immunity under the law and cannot be held responsible for the alleged harm that Disney is suing for.\u00a0<\/p>\n<p>The lawsuit, brought forth by Disney, accused DeSantis and his office of engaging in \u201ca targeted campaign of government retaliation\u201d that was \u201corchestrated at every step by Governor DeSantis as punishment for Disney\u2019s protected speech.\u201d<\/p>\n<p>The case was originally assigned to Mark Walker, who was appointed by former President Barack Obama. However, he recused himself from the case citing his reason being that a distant relative of his has stock in the company. <\/p>\n<p>DeSantis and Disney have been in conflict since 2022, when the company publicly stood against the governor\u2019s <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2022\/1557\/BillText\/er\/PDF\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a>. In response, DeSantis looked to disband Reedy Creek, the special tax district in the Orlando area that allowed the company to \u201cself-govern\u201d its operations there. <\/p>\n<p>DeSantis replaced the board overseeing the district with his own appointees.\u00a0<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote data-service=\"twitter\" data-category=\"marketing\" data-placeholder-image=\"https:\/\/c3.oann.com\/wp-content\/plugins\/complianz-gdpr\/assets\/images\/placeholders\/twitter-minimal.jpg\" class=\"cmplz-placeholder-element twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Political strategists say DeSantis going after Disney was a dumb fight but idk man the base seems to love it <a href=\"https:\/\/t.co\/4ouVRlcaZi\">pic.twitter.com\/4ouVRlcaZi<\/a><\/p>\n<p>\u2014 Brendon Leslie (@BrendonLeslie) <a href=\"https:\/\/twitter.com\/BrendonLeslie\/status\/1672287590551093248?ref_src=twsrc%5Etfw\">June 23, 2023<\/a><\/p><\/blockquote>\n<p><script type=\"text\/plain\" data-service=\"twitter\" data-category=\"marketing\" async data-cmplz-src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script> <\/div>\n<\/figure>\n<p>The motion that was filed on Monday called Disney\u2019s special tax district a \u201csweetheart deal.\u201d The state argued that DeSantis and Meredith Ivey, secretary for Florida\u2019s Department of Economic Opportunity, technically do not enforce the changes to Disney\u2019s district since it is the job of the board that he appointed.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cDisney lacks standing to sue the Governor and Secretary, who are also immune from suit,\u201d they argued in the filing.\u00a0<\/p>\n<p>\u201cSigning a law is not \u2018enforcing\u2019 a law,\u201d they continued, adding that \u201cDisney\u2019s claims against the Governor run square into his legislative immunity\u201d and its \u201callegations of retaliatory intent do not change the analysis.\u201d<\/p>\n<\/blockquote>\n<p>Disney originally filed its First Amendment lawsuit in federal court in late April. Just a few days later, the DeSantis-appointed board counter-sued in state court. Disney then filed a bid in May to dismiss that state-level suit.<\/p>\n<p>Stay informed!
