Wade?<\/h2>\n<blockquote>\n<p>More than a year has passed since the Supreme Court overturned <em><a href=\"https:\/\/www.dailywire.com\/topic\/roe-v-wade\" target=\"_blank\" rel=\"noopener\">Roe v. Wade<\/a> <\/em>in its 6-3 ruling in<a href=\"https:\/\/www.dailywire.com\/news\/read-it-supreme-courts-213-page-decision-overturning-roe-v-wade\" target=\"_blank\" rel=\"noopener\"><em> Dobbs v. Jackson Women\u2019s Health Organization<\/em><\/a>, and while pro-life Americans cheer the ruling, some believe that the High Court didn\u2019t go far enough.<\/p>\n<\/blockquote>\n<p>Hadley Arkes, the Edward N. Ney Professor of Jurisprudence and American Institutions, Emeritus at Amherst College, recently <a href=\"https:\/\/www.thecatholicthing.org\/2023\/06\/26\/dobbs-a-year-later-the-lady-in-the-hat-and-the-vase\/\" target=\"_blank\" rel=\"noopener\">published<\/a> a column for The Catholic Thing in which he harangued the SCOTUS for not having the guts to weigh in on the \u201cmoral substance of the case.\u201d<\/p>\n<p>\u201cIt wasn\u2019t a matter of inadvertence: the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pro-life-professor-breaks-down-why-supreme-court-didnt-go-far-enough-when-it-overturned-roe\/\" title=\"Pro-life prof explains why Supreme Court fell short in overturning 'Roe'.\">conservative majority deliberately withheld<\/a> the premises that are vital to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/covid-has-killed-her-hundreds-of-thousands-but-abortion-has-killed-her-tens-of-millions\/\" title=\"COVID Has Killed Her Hundreds of Thousands, But Abortion Has Killed Her Tens of Millions\">pro-life movement<\/a> in going forward now, in the States as well at the federal level, in acting through Congress,\u201d Arkes said of the majority\u2019s opinion.\u201dMost notably, the majority held back from recognizing the human standing of the child in the womb.\u201d<\/p>\n<p>Arkes, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tebow-im-grateful-my-mom-gave-me-a-chance-at-life\/\" title=\"Tebow: I\u2019m grateful my mom gave me a chance at life\">pro-life advocate<\/a> since the 1960s, argued that the <em>Roe<\/em> decision altered American morals, while <em>Dobbs<\/em> will have no such effect.<\/p>\n<p>\u201c<em>Roe<\/em> not merely created a right to abortion; it changed the culture,\u201d he said. \u201cIt converted abortion from a thing to be abhorred, discouraged, and forbidden, into something approved, celebrated, and encouraged.\u201d<\/p>\n<p>In other words, as it relates to abortion, politics wasn\u2019t downstream from culture. The culture was downstream from politics.<\/p>\n<p>\u201cThe conservative justices in <em>Dobbs<\/em> did nothing to start undoing those moral lessons,\u201d the <a href=\"https:\/\/www.nationalreview.com\/magazine\/2023\/07\/10\/anchoring-originalism\/\" target=\"_blank\" rel=\"noopener\">author<\/a> of the book \u201c<span id=\"productTitle\" class=\"a-size-extra-large\">Mere Natural Law: Originalism and the Anchoring Truths of the Constitution\u201d argued<\/span>.<\/p>\n<p>There was one highlight for Arkes \u2014 but even here, it fell short of his desired goal.<\/p>\n<p>\u201cThe redeeming part of the decision would be found in Justice Alito\u2019s opinion for the majority. He managed to show that there was no principled ground for regarding the small being in the womb as anything less than human,\u201d Arkes said.<\/p>\n<p>However, if the baby is a human, then a reasonable conclusion would be that it deserves the inalienable rights afforded to all other humans.<\/p>\n<p><b data-stringify-type=\"bold\"><\/b><\/p>\n<p>\u201c[Alito] would leave it to others to draw that moral conclusion, whether people in elective offices or perhaps conservative judges in the courts below,\u201d Arkes noted.<\/p>\n<p>He concluded that ultimately \u2014\u00a0 because Republican politicians and conservative judges at-large are squeamish on the issue of abortion \u2014 Justice Samuel Alito might have to take \u201cthat next step\u201d in affirming the \u201chuman standing of the child in the womb.\u201d This would come in a subsequent case dealing with the issue, potentially regarding the abortion pill.<\/p>\n<p>Arkes presents and articulates a thought-provoking viewpoint that articulates why for all its success, <em>Dobbs<\/em> left much to be desired.<\/p>\n<p><em>The views expressed in this piece are the author\u2019s own and do not necessarily represent those of The Daily Wire.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>It has been over a year since the Supreme Court&#8217;s 6-3 ruling in Dobbs v.
