indeed, the States cite no precedent for a lawsuit like this.\u201d<\/span><\/li>\n<\/ul>\n<h3>Justice Alito&#8217;s Dissent<\/h3>\n<ul>\n<li><span style=\"font-weight: 400\">Justice Samuel Alito argued that Texas did have standing to challenge the policy, saying that the majority opinion harmed the ability of the states to push back on executive authority.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\">The decision, \u201cholds that the only limit on the power of a President to disobey a law like the important provision at issue is Congress\u2019s power to employ the weapons of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-makes-decision-on-republican-ags-challenge-to-biden-deportation-policy\/\" title=\"Supreme Court rules on GOP AG's challenge to Biden's deportation policy.\">inter-branch warfare \u2014 withholding funds<\/a>, impeachment and removal, etc,\u201d Alito wrote in his dissent. \u201cI would simply apply settled law, which leads ineluctably to the conclusion that Texas has standing.\u201d<\/span><\/li>\n<li><span style=\"font-weight: 400\">Alito argued that the decision was \u201cdeeply flawed\u201d and could prevent states from protecting their \u201cvital interests.\u201d<\/span><\/li>\n<li><span style=\"font-weight: 400\">\u201cIf a President fails or refuses to enforce the immigration laws, the States must simply bear the consequences. That interpretation of executive authority and Article III\u2019s case or controversy requirement is deeply and dangerously flawed,\u201d he added.\u00a0<\/span><\/li>\n<\/ul>\n<p><b data-stringify-type=\"bold\"><\/b><\/p>\n<h3>The Policy and Legal Proceedings<\/h3>\n<ul>\n<li><span style=\"font-weight: 400\">The policy that prompted the suit was outlined in a <a href=\"https:\/\/www.ice.gov\/doclib\/news\/guidelines-civilimmigrationlaw.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">September 2021 memorandum<\/span><\/a><span style=\"font-weight: 400\"> from Secretary of Homeland Security Alejandro Mayorkas.<\/span><\/li>\n<li><span style=\"font-weight: 400\">\u201cThe fact an individual is a removable noncitizen therefore should not alone be the basis of an enforcement action against them,\u201d Mayorkas said, claiming that the DHS did not have the resources to deport everyone illegally entering the country.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400\">The <a href=\"https:\/\/www.dailywire.com\/news\/scotus-takes-up-major-immigration-case-between-texas-and-biden-administration\" target=\"_blank\" rel=\"noopener\">memo was vacated<\/a> by the U.S. District Court for the Southern District of Texas before the U.S. Court of Appeals for the 5th Circuit refused to put the ruling on hold while the Biden administration appealed the decision.
