Held: Texas and Louisiana lack Article III standing to challenge immigration Guidelines. 8-1 on result, but 5-justice majority. <a href=\"https:\/\/t.co\/lz3rMcbZx6\">https:\/\/t.co\/lz3rMcbZx6<\/a><\/p>\n<p>\u2014 Ed Whelan (@EdWhelanEPPC) <a href=\"https:\/\/twitter.com\/EdWhelanEPPC\/status\/1672244657047175168?ref_src=twsrc%5Etfw\">June 23, 2023<\/a><\/p><\/blockquote>\n<p><script type=\"text\/plain\" data-service=\"twitter\" data-category=\"marketing\" async data-cmplz-src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script> <\/div>\n<\/figure>\n<p>In <em><a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/united-states-v-texas-5\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. v Texas,<\/a><\/em> in which Republican states challenged the narrowing of Immigration and Customs Enforcement (ICE) priorities for arrests and deportations, the Justices found that the states did not have the standings to challenge policy in a ruling of 8-1.<\/p>\n<p>The <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/22-58_i425.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">opinion<\/a>, which was written by Justice Brett Kavanaugh, said that the States brought an \u201cextraordinarily unusual lawsuit.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIn sum, the States have brought an extraordinarily unusual lawsuit,\u201d the opinion said. \u201cThey want a federal court to order the Executive Branch to alter its arrest policies so as to make more arrests. Federal courts have not traditionally entertained that kind of lawsuit; indeed, the States cite no precedent for a lawsuit like this.\u201d<\/p>\n<\/blockquote>\n<p>However, Kavanaugh wrote that \u201cother forums remain open\u201d for the states if they wish to press their concerns, pointing towards Congress.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWe do not opine on whether any such actions are appropriate in this instance,\u201d he wrote.<\/p>\n<\/blockquote>\n<p>Justice Samuel Alito was the only dissenter and said that the court found that \u201cthe only limit on the power of a president to disobey a law like the important provision at issue is Congress\u2019 power to employ the weapons of inter-branch warfare.\u201d<\/p>\n<p>In 2021, President Joe Biden had announced his plan towards <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/illegal-immigrants-guilty-of-dui-assault-will-not-be-deported-under-biden-plan\/\" title=\"Illegal Immigrants Guilty of DUI, Assault Will Not Be Deported Under Biden Plan\">illegal immigration enforcement<\/a>, which was a different approach from the hardline enforcement that 45<sup>th<\/sup> President Donald Trump had taken while he was in office. <\/p>\n<p>The Biden administration said that with the estimated 11 million immigrants in the U.S. illegally, the government needs to prioritize certain cases because they did not have the resources to process everyone.<\/p>\n<p>The administration had issued new enforcement guidelines by the Department of Homeland Security which required all ICE agents to target only three types of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/its-happening-president-trump-issues-warning-swing-states-that-found-massive-voter-fraud-which-is-all-of-them-cannot-legally-certify-these-votes\/\" title=\"IT\u2019S HAPPENING: President Trump Issues Warning \u2013 Swing States that Found MASSIVE VOTER FRAUD, which is all of them, CANNOT LEGALLY CERTIFY these votes\">illegal immigrants<\/a>, those who had most recently crossed the border, the ones who pose as a threat to public safety, and threats to national security.<\/p>\n<p>Texas and Louisiana were the first states to challenge the policy arguing that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-hands-biden-major-win-on-immigration\/\" title=\"Supreme Court grants Biden significant immigration victory.\">federal law requires illegal immigrants<\/a>, particularly ones convicted of aggravated felonies, human trafficking, and gun crimes, must be detained after their release from criminal custody.<\/p>\n<p>U.S. District Judge Drew Tipton had sided with the states and said that they had standing because they could show cases where immigrants who should have been detained under federal law, were free in those states and had committed crimes.<\/p>\n<p>Tipton said that Biden\u2019s policy was unlawful and that the Biden administration had failed to follow the correct procedure in implementing it.<\/p>\n<p>The Biden administration had appealed to the Supreme Court to immediately restore the policy in 2022, arguing that the president has broad discretion to set his enforcement policies. <\/p>\n<p>The Supreme Court had rejected the request in July 2022 by a vote of 5-4, however the justices had agreed to take up the government\u2019s appeal.<\/p>\n<p>Stay informed!
