EEOC<\/strong>.<\/p>\n<p><a href=\"https:\/\/www.reuters.com\/legal\/christian-owned-texas-business-shielded-lgbt-bias-claims-appeals-court-2023-06-20\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a> reported that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dem-amnesty-would-protect-domestic-abusers-republicans-say\/\" title=\"Dem Amnesty Would Protect Domestic Abusers, Republicans Say\">appeals court found<\/a> that Christian-owned Braidwood Management, which runs a wellness center in Texas, \u201c<strong>cannot be sued by the U.S. Equal Employment Opportunity Commission over its policy that employees who engage in homosexual or gender non-conforming conduct will be fired.<\/strong>\u201d<\/p>\n<p>According to Reuters, Braidwood sought exemption from EEOC enforcement of a 2021 U.S. Supreme Court ruling that said bias against gay and transgender workers is a form of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/aclu-presses-supreme-court-to-end-men-only-draft\/\" title=\"ACLU Presses Supreme Court to End Men-Only Draft\">unlawful sex discrimination<\/a> under Title VII of the <a href=\"https:\/\/www.westernjournal.com\/op-ed-1-month-biden-essentially-canceled-1964-civil-rights-act\/\" target=\"_blank\" rel=\"noopener\">Civil Rights Act of 1964<\/a>.<\/p>\n<p>Braidwood sued the EEOC under the 1993 Religious Freedom Restoration Act.<\/p>\n<p>The appeals court <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca5\/22-10145\/22-10145-2023-06-20.html\" target=\"_blank\" rel=\"noopener\">determined<\/a> that the \u201cEEOC\u2019s opposing arguments are uncompelling.\u201d The court added that the EEOC \u201chas presented no evidence indicating Braidwood\u2019s individual compliance with EEOC guidance is not a substantial burden on its religious practice.\u201d<\/p>\n<p>The three-judge panel did rule, however, that Braidwood could not bring its suit on behalf of other Christian-owned companies. This reversed an earlier U.S. District Court ruling.<\/p>\n<p>On the whole, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/third-degree-murder-charge-against-ex-cop-derek-chauvin-reinstated-by-appeals-court\/\" title=\"Third-Degree Murder Charge Against Ex-Cop Derek Chauvin Reinstated By Appeals Court\">appeals court\u2019<\/a>s ruling represents a victory for <a href=\"https:\/\/www.westernjournal.com\/hs-tennis-stars-notch-religious-liberty-win-penalized-observing-sabbath\/?ff_source=Email&#038;ff_medium=newsletter-WJ&#038;ff_campaign=dailyam&#038;ff_content=western-journal\" target=\"_blank\" rel=\"noopener\">religious liberty<\/a>.<\/p>\n<p>No individual, business owner or otherwise, should be compelled to acquiesce in behavior he or she regards as sinful.<\/p>\n<h3>The Issue at Hand: Discrimination or Religious Freedom?<\/h3>\n<p>A common argument against Braidwood and other Christian-owned businesses is that discrimination on the basis of sexual orientation is akin to <a href=\"https:\/\/www.westernjournal.com\/civil-rights-complaint-filed-university-restricts-summer-program-non-white-applicants\/\" target=\"_blank\" rel=\"noopener\">discrimination<\/a> on the basis of race.<\/p>\n<p>Landlords cannot refuse housing, and businesses cannot refuse service, to those whose skin color they dislike. Why, then, should discrimination on the basis of sexual orientation be permissible?<\/p>\n<p>Surely these are not analogous situations.<\/p>\n<p>For one thing, there is no choice involved in skin color.<\/p>\n<p>Some might argue that sexual orientation also is not a matter of choice. It is not necessary to acknowledge or refute this assertion to prove that skin color and sexual orientation are definitively not the same things.<\/p>\n<p>Even if sexual orientation, to a certain degree, is not a matter of choice, it cannot be argued that sexual orientation, like skin color, is <strong>never<\/strong> a matter of choice.<\/p>\n<p>LGBT activists\u2019 own arguments refute the notion. After all, it is impossible even to discuss things like \u201cidentity\u201d or \u201cfluidity\u201d without introducing the element of <a href=\"https:\/\/www.westernjournal.com\/growing-body-evidence-shows-really-causing-rapid-onset-gender-dysphoria-teens\/\" target=\"_blank\" rel=\"noopener\">choice<\/a>.<\/p>\n<p>We do not need to determine the <strong>extent<\/strong> to which choice dictates sexual orientation. We only need to show that sexual orientation, unlike skin color, is at least <strong>to some degree<\/strong> a product of choice.<\/p>\n<p>Once we have done this, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/christian-company-victorious-against-biden-admins-lgbt-rules-in-federal-appeals-court\/\" title=\"Christian company wins against Biden admin's LGBT rules in federal court.\">civil-rights-style comparisons<\/a> between skin color and sexual orientation evaporate.<\/p>\n<p>This does not mean that Christians have cause to persecute those whose professed sexual orientation they regard as sinful.<\/p>\n<p>Neither, though, does it empower any government to mandate practices that require a wholesale suspension of religious beliefs.<\/p>\n<p>The post <a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\/christian-company-victorious-biden-admins-lgbt-rules-federal-appeals-court\/\">Christian Company Victorious Against Biden Admin&#8217;s LGBT Rules in Federal Appeals Court<\/a> appeared first on <a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\">The Western Journal<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The federal government&#8217;s attack on religious liberty has encountered limits.
