Titanic \u2014 even as the submersible carrying five people to do just that remains missing with just a <a href=\"https:\/\/www.dailywire.com\/news\/coast-guard-estimates-missing-titanic-sub-has-40-hours-of-breathable-air-left\" target=\"_blank\" rel=\"noopener\">few more hours<\/a> of breathable air.<\/p>\n<p>\u201cNext time some rich white person wants to take Sam Alito on an expensive trip, please take him to see the Titanic,\u201d Mystal tweeted.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Next time some rich white person wants to take Sam Alito on an expensive trip, please take him to see the Titanic.<\/p>\n<p>\u2014 Elie Mystal (@ElieNYC) <a href=\"https:\/\/twitter.com\/ElieNYC\/status\/1671540056287244289?ref_src=twsrc%5Etfw\">June 21, 2023<\/a><\/p>\n<\/blockquote>\n<h3>Mystal&#8217;s Response to a ProPublica Report<\/h3>\n<p>Mystal\u2019s tweet appeared to be a response to a <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4060023-alito-propublica-report-on-luxury-vacation-misleading\/\" target=\"_blank\" rel=\"noopener\">ProPublica report<\/a> claiming that Alito had not properly reported a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-samuel-alito-accepted-luxury-vacation-from-billionaire-with-cases-before-supreme-court-report\/\" title=\"Justice Samuel Alito reportedly accepted luxury vacation from billionaire with cases before Supreme Court.\">luxury fishing trip<\/a> he took to Alaska in 2008 \u2014 a trip during which he was flown on a private jet with hedge fund billionaire Paul Singer. The report also claimed that cases involving Singer had come before the court, suggesting that Alito should have recused himself and did not.<\/p>\n<p>Alito <a href=\"https:\/\/www.wsj.com\/articles\/propublica-misleads-its-readers-alito-gifts-disclosure-alaska-singer-23b51eda\" target=\"_blank\" rel=\"noopener\">responded to the report<\/a> in a Wall Street Journal op-ed, saying, \u201cNeither charge is valid.\u201d<\/p>\n<p>\u201cI had no obligation to recuse in any of the cases that ProPublica cites. First, even if I had been aware of Mr. Singer\u2019s connection to the entities involved in those cases, recusal would not have been required or appropriate,\u201d Alito wrote, adding, \u201cProPublica suggests that my failure to recuse in these cases created an appearance of impropriety, but that is incorrect. \u2018There is an appearance of impropriety when an unbiased and reasonable person who is aware of all relevant facts would doubt that the Justice could fairly discharge his or her duties\u2019 (Statement on Ethics Principles and Practices appended to letter from the Chief Justice to Senator Durbin, April 25, 2023). No such person would think that my relationship with Mr. Singer meets that standard.\u201d<\/p>\n<p><b data-stringify-type=\"bold\"><\/b><\/p>\n<p>He went on to explain that he was not obligated to report the travel under his financial disclosures because items that fell under the heading of \u201chospitality\u201d had not been subject to reporting requirements until just a few <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/msnbc-contributor-exploits-missing-sub-tragedy-to-wish-death-on-scotus-justice\/\" title=\"MSNBC contributor exploits submarine tragedy to express desire for SCOTUS justice's demise.\">months earlier \u2014 years<\/a> after the trip in question occurred.<\/p>\n<p>\u201cUntil a few months ago, the instructions for completing a Financial Disclosure Report told judges that \u2018[p]ersonal hospitality need not be reported,\u2019 and \u2018hospitality\u2019 was defined to include \u2018hospitality extended for a non-business purpose by one, not a corporation or organization, \u2026 on property or facilities owned by [a] person \u2026\u2019 Section 109(14).
