Gov. Cuomo doubles down on nursing home COVID orders\">credit report<\/a> that some of his loans were overdue, damaging his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/this-is-torch-and-pitchfork-mentality-run-amuck-guest-on-malzbergs-eat-the-press-discusses-the-cancel-culture-in-the-us-today\/\" title=\"\u201cThis is Torch and Pitchfork Mentality Run Amuck\u201d \u2013 Guest on Malzberg\u2019s \u201cEat the Press\u201d Discusses the Cancel Culture in the US Today\">credit score<\/a>.<\/p>\n<p>At issue is whether Congress waived the United States\u2019 sovereign immunity from lawsuits when it <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-to-decide-if-us-is-immune-from-lawsuits\/\" title=\"Supreme Court to rule on US immunity from lawsuits.\">modified consumer protection laws<\/a> nearly 30 years ago.<\/p>\n<p>Kirtz sued the USDA in 2020, alleging that the agency violated the <strong>Fair Credit Reporting Act (FCRA)<\/strong>, which Congress amended decades ago to impose new requirements on lenders.<\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justices-question-maine-tuition-program-that-excludes-religious-schools\/\" title=\"Justices Question Maine Tuition Program That Excludes Religious Schools\">district court sided<\/a> with the USDA and dismissed Kirtz\u2019s complaint on the premise that Congress did not intend to waive the federal government\u2019s immunity from lawsuits.<\/p>\n<p>Kirtz appealed and the U.S. Court of Appeals for the Third Circuit ruled in his favor, prompting the USDA to file a petition (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22-846\/266965\/20230516131807520_22-846%20USDA%20v.%20Kirtz%20reply.pdf\">pdf<\/a>) with the U.S. Supreme Court, arguing that the lower court\u2019s decision is incorrect.<\/p>\n<p>After considering the matter, the Supreme Court justices announced on Tuesday in an order list (<a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/062023zor_4gc5.pdf\">pdf<\/a>) that they would hear the case, which will likely happen within several months.<\/p>\n<p>The question <a href=\"https:\/\/www.supremecourt.gov\/qp\/22-00846qp.pdf\">presented before<\/a> the high court is whether the civil-liability provisions of the Fair Credit Reporting Act \u201cunequivocally and unambiguously waive the sovereign immunity of the United States.\u201d<\/p>\n<h2>More Details<\/h2>\n<p>Kirtz\u2019s attorneys filed a petition (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22-846\/265981\/20230502163807883_Kirtz%20BIO%20FINAL.pdf\">pdf<\/a>) with the Supreme Court in May that argued that the Third Circuit was correct in ruling that the Fair Credit Reporting Act waives the sovereign immunity of the federal government by authorizing consumers to sue federal agencies for violations of the act.<\/p>\n<p>The alleged violation was that the USDA failed to correct an inaccurate statement that wrongly reported that Kirtz\u2019s account was 120 days past due on a loan made to him by the USDA, damaging his credit score.<\/p>\n<p>When Kirtz first went to federal court in 2020, he accused the USDA of violating the Fair Credit Reporting Act, but the USDA asked the district court to dismiss the case.<\/p>\n<p>The USDA argued that the Fair Credit Reporting Act did not clearly indicate that Congress meant to waive the federal government\u2019s immunity from lawsuits.<\/p>\n<p>The district court sided with the USDA but that decision was later reversed on appeal.<\/p>\n<p>Kirtz\u2019s team argued that the USDA incorrectly suggested that Congress must enact an explicit statutory waiver of sovereign immunity for a waiver to be effective.<\/p>\n<p>In siding with Kirtz, the Third Circuit Court of Appeals pointed to the definition of \u201cperson\u201d in the Fair Credit Reporting Act, which includes \u201cany \u2018government or governmental subdivision or agency.\u201d<\/p>\n<p>Further, the appeals court said that, because the federal government is the largest employer and creditor in the United States, allowing lawsuits against it would be in line with Congress\u2019s aim to protect consumers.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. Supreme Court will review a case determining if the government can be sued for monetary damages.
