During the episode, Neely <a href=\"https:\/\/townhall.com\/tipsheet\/mattvespa\/2023\/06\/11\/daniel-penny-reveals-what-jordan-neely-said-that-caused-him-to-placed-in-a-chokehold-n2624360\" target=\"_blank\" rel=\"noreferrer noopener\">allegedly<\/a> kept repeating the phrases, \u201cI\u2019m going to kill you,\u201d \u201cI\u2019m prepared to go to jail for life,\u201d and \u201cI\u2019m willing to die.\u201d<\/p>\n<p>In response, Penny and two of his fellow passengers attempted to restrain Neely, which involved the former placing the latter in a headlock. Neely ultimately died during the encounter, with NYC\u2019s medical examiner <a href=\"https:\/\/www.foxnews.com\/us\/marine-veteran-daniel-penny-indicted-subway-chokehold-death-jordan-neely-sources\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> the death a homicide.<\/p>\n<p>According to sources who spoke with <a href=\"https:\/\/www.foxnews.com\/us\/marine-veteran-daniel-penny-indicted-subway-chokehold-death-jordan-neely-sources\" target=\"_blank\" rel=\"noreferrer noopener\">Fox News<\/a>, Penny is being indicted \u201con one count each of criminally negligent homicide and second-degree manslaughter.\u201d If convicted of the latter charge, Penny could face five to 15 years in prison.<\/p>\n<h2>Penny\u2019s Prosecution Deserves Widespread Outcry<\/h2>\n<p>While egregious, Penny\u2019s indictment has largely been overshadowed by news that the Biden Department of Justice is <a href=\"https:\/\/thefederalist.com\/2023\/06\/09\/biden-doj-indicts-former-president-donald-trump-over-classified-documents-squabble\/\" target=\"_blank\" rel=\"noreferrer noopener\">charging<\/a> former President Donald Trump for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-launches-2024-presidential-bid\/\" title=\"Trump Launches 2024 Presidential Bid\">allegedly mishandling classified documents<\/a>. The announcement \u2014 which came the same <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/daniel-pennys-indictment-deserves-the-level-of-outrage-trumps-got\/\" title=\"Daniel Penny's indictment deserves the same level of outrage as Trump's.\">week credible allegations surfaced<\/a> that President Joe Biden was <a href=\"https:\/\/thefederalist.com\/2023\/06\/15\/the-bidens-coerced-burisma-to-pay-10-million-in-bribes-says-credible-fbi-source\/\" target=\"_blank\" rel=\"noreferrer noopener\">involved<\/a> in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/grassley-burisma-exec-behind-biden-bribery-scandal-allegedly-kept-17-recordings-of-talks-with-joe-hunter\/\" title=\"Grassley claims Burisma exec had 17 recordings of talks with Joe and Hunter related to bribery scandal.\">multimillion-dollar bribery scheme<\/a> during his time as vice president \u2014 represents the first publicly known attempt by America\u2019s intel agencies to <a href=\"https:\/\/thefederalist.com\/2023\/06\/09\/doj-declares-war-on-2024-with-trump-indictment-hours-after-biden-bribery-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">interfere<\/a> in the 2024 election.<\/p>\n<p>Make no mistake. The DOJ\u2019s indictment of a former president and the current president\u2019s leading 2024 rival is an extraordinary abuse of government power that deserves widespread outrage. Conservatives were justified in their immediate denouncement of the charges as politically motivated and a sign of America\u2019s <a href=\"https:\/\/thefederalist.com\/2023\/06\/09\/second-trump-indictment-is-proof-of-two-tiered-justice-system\/\" target=\"_blank\" rel=\"noreferrer noopener\">two-tiered justice system<\/a>. Especially when considering that figures such as <a href=\"https:\/\/thefederalist.com\/2023\/01\/16\/5-times-media-ran-cover-for-biden-in-classified-documents-scandal\/\" target=\"_blank\" rel=\"noreferrer noopener\">Biden<\/a> and <a href=\"https:\/\/thefederalist.com\/2022\/09\/06\/hillary-keeps-shamelessly-lying-about-her-emails\/\" target=\"_blank\" rel=\"noreferrer noopener\">Hillary Clinton<\/a> \u2014 both of whom have mishandled classified information \u2014 have yet to face such charges.<\/p>\n<p>On their own merits, the Penny and Trump indictments symbolize the increasing weaponization of law enforcement agencies against anyone who refuses to bend the knee to leftism. But unlike the reaction to the DOJ\u2019s targeting of Trump, the overall response to Penny\u2019s indictment has been mum by comparison.<\/p>\n<p>While it\u2019s understandable for a presidential primary contender to generate a larger following than a former Marine, it\u2019s precisely for this reason that Penny\u2019s unjust prosecution should be shouted from the rooftops. Unlike Trump, a guy like Penny likely doesn\u2019t possess the financial or legal resources necessary to engage in a prolonged legal fight against a system that\u2019s rigged against him. And it\u2019s for this reason that all conservatives and common-sense Americans must rally to his defense.<\/p>\n<p>A conviction of Penny would further entrench Democrats\u2019 attempts to criminalize self-defense and give leeway to leftist prosecutors seeking to charge any citizen not \u201cdown\u201d for their Marxist revolution. Yes, the DOJ\u2019s targeting of Trump is horrific.
