Is it based on a search and seizure not in accord with the Constitution\u2019s Fourth Amendment?<\/p>\n<blockquote>\n<p>\u201cThe right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.\u201d<\/p>\n<\/blockquote>\n<p>Looks like this indictment is unconstitutional. Looks like it\u2019s a cleverly convoluted and culpable exercise in unlawful and unjustified confiscation and entrapment.<\/p>\n<h3>How did this happen?<\/h3>\n<p>Justice Benjamin Curtis, in his famous dissent from <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/60\/393\/#tab-opinion-1964281\" target=\"_blank\" rel=\"noopener\">Dred Scott<\/a> (1857), appealed to the Fifth Amendment\u2019s due process, which, he said, is not peculiar to the Constitution of the United States:<\/p>\n<p>\u201cIt was borrowed from Magna Charta; was brought to America by our ancestors, as part of their inherited liberties, and has existed in all the States, usually in the very words of the great charter.\u201d<\/p>\n<p>Regrettably, the Department of Justice has deteriorated into a Department of Petty Prosecutions operating arbitrarily, in league with a ruling party every bit as crooked and corrupt as the infamous King John.<\/p>\n<p>The U.S. legal system has reneged on the Magna Carta principle that applies common law protections to all \u201c<em>per legem terr\u00e6<\/em>,\u201d i.e., according to the law of the land \u2014 and not at the mere will of a corrupted Justice Department in cooperation with a political party wielding despotic power.<\/p>\n<h3>Selective application of the law<\/h3>\n<p>Special counsel Jack Smith is not impartial.<\/p>\n<p>When he <a href=\"https:\/\/www.forbes.com\/sites\/mollybohannon\/2023\/06\/09\/special-counsel-smith-on-trump-indictment-we-have-one-set-of-laws-in-this-country-and-they-apply-to-everyone\/?sh=224256fc26b8\" target=\"_blank\" rel=\"noopener\">says<\/a>, \u201cWe have one set of laws in this country and they apply to everybody,\u201d he is being disingenuous. He is ignoring the selective application of the law utilized scandalously to indict the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/moscow-murders-the-danger-of-standing-up-to-the-russian-regime\/\" title=\"Moscow Murders: The Danger Of Standing Up To The Russian Regime\">leading political opponent<\/a> of the Democratic Party.<\/p>\n<p>The sprawling charges (37 counts of criminal acts, sufficient to put Trump in jail for 400 years) are suspiciously capacious. Why? To ensure that there is one that can be contrived somehow to stick?<\/p>\n<p>The 14th Amendment\u2019s equality clause was explained in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/257\/312\/\" target=\"_blank\" rel=\"noopener\">Truax v. Corrigan<\/a> (1921): \u201cOur whole system of law is predicated on the general fundamental principle of equality of application of the law.\u201d<\/p>\n<p>\u201cThe framers and adopters of this amendment were not content to depend on a mere minimum secured by the due process clause, or upon the spirit of equality which might not be insisted on by local public opinion. They therefore embodied that spirit in a specific guaranty.\u201d<\/p>\n<p>That \u201cguaranty\u201d was to protect against, inter alia, \u201chostile discrimination.\u201d<\/p>\n<p>Justice Stanley Matthews, in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/118\/356\/\" target=\"_blank\" rel=\"noopener\">Yick Wo v. Hopkins<\/a> (1886), spoke to both the due process and equality clauses of the Fourteenth Amendment:<\/p>\n<p>\u201cThese provisions are universal in their application to all persons within the territorial jurisdiction \u2026\u00a0and the equal protection of the laws is a pledge of the protection of equal laws.\u00a0\u201d<\/p>\n<p>In other words, due process alone is not enough.<\/p>\n<p>In going so rashly after Trump, the DOJ has abandoned its most serious obligation to provide the additional guarantee of the equality clause.<\/p>\n<h3>Equality before the law is not \u201cwhataboutism.\u201d<\/h3>\n<p>When someone raises unfair inequalities in the way Trump is being treated, it is disparaged as \u201cwhataboutism.\u201d<\/p>\n<p>It\u2019s not.<\/p>\n<p>It\u2019s about the serious legal obligation to hold every person to the same standard.<\/p>\n<p>Wrongdoers pointing out others breaking the law does not make them less criminal. But when we tolerate and apply two standards of justice, we can engineer and condone just such an anomaly.<\/p>\n<p>A politicized DOJ can magnify an indiscreet and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/top-republican-requests-ig-probe-into-bidens-potentially-unlawful-actions-placing-activists-in-regulatory-agency\/\" title=\"Top Republican Requests IG Probe Into Biden\u2019s Potentially \u2018Unlawful Actions\u2019 Placing Activists In Regulatory Agency\">possibly unlawful action<\/a> by Trump into a prosecutable and punishable crime. At the same time, by employing a different standard of justice, it can continue to ignore indiscreet and dangerously unlawful practices by then-Vice President Joe Biden and then-Secretary of State Hilary Clinton.<\/p>\n<p>Currently exacerbating this problem of two standards of justice is the establishment media\u2019s political bias, which overwhelmingly sides with the Biden administration and refuses to pressure it for accountability.<\/p>\n<h3>Where is the justification?<\/h3>\n<p>We can\u2019t have two conflicting standards of justice and say that justice is done.<\/p>\n<p>Democracy can\u2019t survive if machinations like these at the highest levels of the law are allowed to continue, irrespective of whichever party is in power.<\/p>\n<p>The DOJ\u2019s unjustified targeting of the opposition party\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kenyan-ministers-rally-around-metas-facebook-after-watchdogs-ultimatum\/\" title=\"Kenyan ministers rally around Meta\u2019s Facebook after watchdog\u2019s ultimatum\">leading presidential candidate<\/a> on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/joseph-trumps-indictment-coincides-with-the-anniversary-of-an-event-that-should-have-made-it-impossible\/\" title=\"Joseph: Trump's indictment aligns with an event that should have rendered it impossible.\">flimsy issues constitutes unwarranted interference<\/a> in a presidential election. This phony prosecution of Trump extends from the Russia collusion hoax and amounts to political persecution.<\/p>\n<p>Why was Trump indicted on the same day the House released <a href=\"https:\/\/www.westernjournal.com\/burisma-exec-17-items-insurance-policy-joe-hunter-biden-senator-grassley\/\" target=\"_blank\" rel=\"noopener\">evidence<\/a> that Biden and his son each got $5 million in bribes from Burisma?\u00a0 Why have the investigations of Biden family corruption been blocked repeatedly by the DOJ?<\/p>\n<p>Trump retained documents that were never used to inflict harm.
