However, in practice, this has led to situations where adoptive parents can have their children taken away from them, causing immense pain and disruption.<\/p>\n<p>What makes the ICWA particularly controversial is that it prioritizes the wishes of Indian tribes over the best interests of the child. This means that children can end up in unfamiliar and often disadvantaged environments, far away from the only parents they&#8217;ve ever known.<\/p>\n<p><strong>[READ: <a href=\"https:\/\/thefederalist.com\/2022\/11\/01\/scotus-to-decide-if-american-indian-babies-can-be-ripped-from-adoptive-parents-on-the-basis-of-skin-color\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Indian Child Welfare Act Is Institutionalized Racism<\/a>]<\/strong><\/p>\n<p>In the case of <em>Haaland v. Brackeen<\/em>, plaintiffs argued that the ICWA violated the Equal Protection clause and exceeded congressional authority. While the Supreme Court upheld Congress&#8217; power to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-upholds-institutionalized-racism-with-ruling-on-indian-child-welfare-act\/\" title=\"Supreme Court supports racism in Indian Child Welfare Act ruling.\">regulate child custody claims<\/a>, it did not address the racial implications of the law.<\/p>\n<p>Justice Amy Coney Barrett, who authored the majority opinion, emphasized that Congress has the authority to regulate child custody cases, even though it lacks a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/aoc-slams-republicans-for-using-statistics-and-studies-to-debunk-her-green-new-deal-claims\/\" title=\"AOC Slams Republicans For Using \u2018Statistics\u2019 And \u2018Studies\u2019 To Debunk Her Green New Deal Claims\">general power<\/a> over domestic relations.
