Penny was indicted Wednesday on one count of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/prison-guard-allegedly-watched-man-hang-himself-wouldnt-allow-other-guards-to-cut-him-down-for-15-minutes\/\" title=\"Prison Guard Allegedly Watched Man Hang Himself, Wouldn\u2019t Allow Other Guards To Cut Him Down For 15 Minutes\">criminally negligent homicide<\/a> and one count of second-degree manslaughter, the <a href=\"https:\/\/nypost.com\/2023\/06\/14\/daniel-penny-indicted-in-chokehold-death-of-jordan-neely\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a> and <a href=\"https:\/\/www.foxnews.com\/us\/marine-veteran-daniel-penny-indicted-subway-chokehold-death-jordan-neely-sources\" target=\"_blank\" rel=\"noopener\">Fox News<\/a> each reported, citing sources it did not name.<\/p>\n<p>Penny could face up to 15 years in prison if convicted on a second-degree manslaughter charge.<\/p>\n<p>Penny is accused of killing <a href=\"https:\/\/www.westernjournal.com\/uncle-jordan-neely-arrested-day-took-shot-marine-vet-daniel-penny-report\/\" target=\"_blank\" rel=\"noopener\">Jordan Neely<\/a>, a homeless man, by putting him in a chokehold. Because Penny is white and Neely is black, the case convulsed New York City with protests and allegations that the incident was racial in nature.<\/p>\n<p>According to <a href=\"https:\/\/abcnews.go.com\/US\/grand-jury-indicts-daniel-penny-chokehold-death-jordan\/story?id=100077897\" target=\"_blank\" rel=\"noopener\">ABC<\/a>, citing police sources it did not name, neither Penny nor anyone else on the car was specifically threatened by Neely as Neely was ranting and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/grand-jury-makes-indictment-decision-for-marine-veteran-daniel-penny\/\" title=\"Marine Veteran Daniel Penny Faces Indictment Decision by Grand Jury\">making general threats<\/a>.<\/p>\n<p>Assistant District Attorney Joshua Steinglass said Penny held Neely for several minutes and that at some point Neely no longer was moving.<\/p>\n<p>Rev. Al Sharpton was <a href=\"https:\/\/www.westernjournal.com\/watch-al-sharpton-takes-disgusting-swipe-desantis-jordan-neelys-funeral\/\" target=\"_blank\" rel=\"noopener\">pleased<\/a> at the indictment.<\/p>\n<p>\u201cThe National Action Network has stood in support of Jordan\u2019s family since day one.
