At the time, Penny did not enter a plea and was released on $100,000 bail. A conviction on a manslaughter charge could put Penny in prison for up to 15 years.<\/p>\n<p>Attorneys representing Penny had said they \u201cfully expect that Danny will be exonerated of all charges,\u201d according to ABC News.<\/p>\n<p>Penny and some witnesses claimed Neely, a homeless man known for his dancing Michael Jackson impersonations, as well as <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/9-year-old-girl-pepper-sprayed-during-interaction-with-rochester-police\/\" title=\"9-Year-Old Girl Pepper Sprayed During Interaction With Rochester Police\">mental health issues<\/a> and an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/prosecutions-star-witness-in-kyle-rittenhouse-trial-has-a-lengthy-criminal-record\/\" title=\"Prosecution\u2019s Star Witness in Kyle Rittenhouse Trial Has a Lengthy Criminal Record\u00a0\">extensive criminal history<\/a>, was shouting and threatening riders aboard a subway train on May 1.<\/p>\n<p>Bystander video showed a man, later identified as Penny, already restraining Neely in a headlock on the floor of a subway train with the help of others. Neely appeared to lose consciousness and was pronounced dead after being taken to a hospital, according to the Associated Press. New York City\u2019s medical examiner ruled Neely\u2019s death a homicide due to \u201ccompression of neck (chokehold),\u201d but the ruling did not determine culpability.<\/p>\n<p>Lawyers representing Neely\u2019s family have picked up on the claim that Penny held Neely in a headlock for 15 minutes and demanded Penny face a more serious murder charge. \u201cDaniel Penny wasn\u2019t attacked, he wasn\u2019t hit. But he put him [Neely] in a chokehold. He came up from behind and he didn\u2019t let Jordan go for 15 minutes,\u201d attorney Donte Mills said, according to local news station PIX11.<\/p>\n<p><b data-stringify-type=\"bold\"><\/b><\/p>\n<p>In video clips released by his lawyers over the weekend, Penny said he jumped into action to protect himself and commuters. I\u2019m trying to restrain him from being able to carry out the threats.\u201d<\/p>\n<p>In addition, Penny denied that race was a motivating factor. He called such claims \u201cabsolutely ridiculous,\u201d adding, \u201cI didn\u2019t see a black man threatening passengers.
