Instead, as members of the Senate Judiciary Committee <a href=\"https:\/\/www.judiciary.senate.gov\/oversight-of-section-702-of-the-foreign-intelligence-surveillance-act-and-related-surveillance-authorities\" target=\"_blank\" rel=\"noreferrer noopener\">demonstrated on Tuesday<\/a>, it\u2019s become a proven loophole that lets <a href=\"https:\/\/thefederalist.com\/2023\/05\/17\/6-freshly-documented-instances-of-systemic-pro-democrat-fbi-corruption\/\" target=\"_blank\" rel=\"noreferrer noopener\">verifiably corrupt bureaucrats<\/a> spy on Americans.<\/p>\n<\/blockquote>\n<p>Nearly two decades after its inception, Section 702 has easily become the security apparatus\u2019 favorite excuse to conduct backdoor, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cnn-biden-admin-considering-using-private-firms-to-conduct-warrantless-surveillance-of-u-s-citizens\/\" title=\"CNN: Biden Admin Considering Using Private Firms To Conduct Warrantless Surveillance Of U.S. Citizens\">warrantless surveillance<\/a> on American citizens. The FBI\u2019s <a href=\"https:\/\/thefederalist.com\/2023\/05\/15\/durham-report-reveals-fbi-vendetta-against-carter-page-behind-fisa-warrants\/\" target=\"_blank\" rel=\"noreferrer noopener\">infamous and illegal<\/a> targeting of 2016 Trump campaign adviser Carter Page is one of the most prominent examples of this trend.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-90632047\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<p>If the <a href=\"https:\/\/www.politico.com\/news\/2023\/06\/13\/section-702-senate-judiciary-hearing-00101689\" target=\"_blank\" rel=\"noreferrer noopener\">Biden administration<\/a>, the <a href=\"https:\/\/www.justice.gov\/oip\/page\/file\/1570411\/download\" target=\"_blank\" rel=\"noreferrer noopener\">officials<\/a> in the corrupt agencies that benefit from the statute, and establishment legislators have anything to say about it, the bureaucrats at the center of the weaponization fight could get permission to keep spying on Americans without retribution.<\/p>\n<h2 class=\"wp-block-heading\">Power Grab<\/h2>\n<p>If anything was <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-ag-nominee-wont-commit-to-keeping-durham-as-special-counsel\/\" title=\"Biden\u2019s AG nominee won\u2019t commit to keeping Durham as special counsel\">made abundantly clear<\/a> during the course of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-were-on-a-mission-advocacy-groups-behind-push-to-save-womens-sports-campaign-against-trans-surgeries-for-minors\/\" title=\"EXCLUSIVE: \u2018We\u2019re On A Mission\u2019: Advocacy Groups Behind Push To Save Women\u2019s Sports Campaign Against Trans Surgeries For Minors\">hours-long hearing<\/a>, the last thing bureaucrats responsible for decades of power abuses want to see is the policy that harbors those abuses to die. The high-level FBI, CIA, DOJ, DNI, and NSA witnesses spent most of their testimonies begging Congress to keep Section 702 intact.<\/p>\n<p>Without Section 702, specifically, NSA Deputy Director George Barnes claimed, \u201cour ability to preserve the nation\u2019s security would be significantly impaired.\u201d<\/p>\n<p>\u201cLast year, nearly every item in the presidential[] intelligence priorities list was addressed in some way, shape, or form by 702. It\u2019s not replaceable. NSA could not replicate intelligence from 702 using other authorities,\u201d Barnes asserted. \u201cIt\u2019s agile, specific, and efficient.\u201d<\/p>\n<div class=\"fdrlst__b89e9-0ca6f0481e981c9fe351806b3de77072 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-0ca6f0481e981c9fe351806b3de77072\"><\/div>\n<p>Rumblings amongst the establishment wings of the Republican party similarly suggest that some legislators may seek a straight reauthorization of FISA in its current iteration. Among those publicly against assertions that the only way to fix Section 702 is by eliminating it are some of Senate Minority Leader Mitch McConnell\u2019s closest allies.<\/p>\n<p>Sen. Lindsey Graham opened his line of questioning by trying to sell Americans, who hold a deep distrust of the <a href=\"https:\/\/thefederalist.com\/2022\/08\/09\/4-in-5-americans-see-two-tiered-justice-system-poll\/\" target=\"_blank\" rel=\"noreferrer noopener\">DOJ<\/a> and <a href=\"https:\/\/thefederalist.com\/2023\/06\/05\/majority-of-americans-want-corrupt-fbi-to-be-reformed-or-shut-down\/\" target=\"_blank\" rel=\"noreferrer noopener\">FBI<\/a> following its partisan actions in recent years, on the idea that foreign adversaries like ISIS, China, and Russia will be unchecked if Congress meddles with Section 702.<\/p>\n<p>\u201cI guess what I\u2019m trying to tell my constituents back home [is] the threats to the country are growing; they\u2019re not lessening,\u201d the South Carolina Republican said.<\/p>\n<p>Sens. John Cornyn and Thom Tillis echoed Graham and the witnesses\u2019 claims that Section 702 is \u201cessential to our national security\u201d and questioned witnesses on whether they would be open to changes designed to address the abuses tainting the Section\u2019s chances of automatic renewal.<\/p>\n<div class=\"fdrlst__b89e9-9adafafcbcf986f38404ded55c1ff5a9 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-9adafafcbcf986f38404ded55c1ff5a9\"><\/div>\n<p>Democrats like Durbin and Sen. Mazie Hirono agreed that Section 702 at least needs to be remarkably reformed before getting Congress\u2019 approval.<\/p>\n<p>\u201cI will only support the reauthorization of section 702 if there are significant, significant reforms,\u201d Senate Judiciary Committee Chairman Dick Durbin said.<\/p>\n<p>During the hearing, Deputy Director FBI Paul Abbate claimed his agency already began rolling out reforms such as a \u201cthree-strike rule\u201d that will carry \u201crapidly escalating consequences\u201d for those agents who supposedly initiate queries, a process that gives officials warrantless access to data collected under FISA, \u201cunintentionally.\u201d<\/p>\n<p>Some of the intelligence bureaucrats <em>claimed<\/em> to be open to even more reforms, but that\u2019s contradicted by several of their actions. Months before the hearing, witness Assistant Attorney General Matt Olsen of the DOJ\u2019s National Security Division lobbied for the rubber stamping of Section 702 without any changes.<\/p>\n<p>\u201cWhat keeps me up at night is thinking about what will happen if we fail to renew Section 702 of FISA,\u201d he <a href=\"https:\/\/www.justice.gov\/opa\/speech\/assistant-attorney-general-matthew-g-olsen-delivers-remarks-brookings-institution-section\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> at a Brookings Institution event in February. \u201cThis law will expire on December 31st\u00a0of this year if Congress doesn\u2019t act to reauthorize it. If 702 expires or is watered down, the United States will lose critical insights we need to protect the country.\u201d<\/p>\n<h2 class=\"wp-block-heading\">Congress Cannot Keep Enabling Corruption<\/h2>\n<p>The hearing made it clear that Section 702 is a dangerous loophole that allows corrupt bureaucrats to spy on Americans. The FBI, CIA, DOJ, DNI, and NSA are all begging Congress to keep it intact, claiming that it\u2019s essential to national security. However, Democrats like Durbin and Sen. Mazie Hirono agree that Section 702 needs significant reforms before getting Congress\u2019 approval. It\u2019s time for Congress to stop enabling corruption and start protecting the rights of American citizens.<\/p>\n<p> to the possibility of reforms, no self-respecting congressman should approve modifications that they know, when attached to Section 702 in previous years, never took root.<\/p>\n<p>Congress attempted to introduce FISA reforms dedicated to advancing \u201cthe protection of individual privacy and civil liberties\u201d <a href=\"https:\/\/thefederalist.com\/2018\/03\/15\/a-2015-fisa-reform-raises-questions-about-courts-handling-of-carter-page\/\" target=\"_blank\" rel=\"noreferrer noopener\">in 2015<\/a>. A recently declassified <a href=\"https:\/\/www.washingtonpost.com\/documents\/adb47f54-b772-4099-b0c9-adf24ef64faa.pdf?itid=lk_inline_manual_2\" target=\"_blank\" rel=\"noreferrer noopener\">Foreign Intelligence Surveillance Court opinion<\/a> from 2022 confirmed that those were practically worthless because the FBI was still able to use Section 702 to justify what the FISC called a \u201cpattern of conducting broad, suspicionless queries.\u201d<\/p>\n<p>Suddenly, the \u201cagility\u201d and \u201cefficiency\u201d intelligence officials like Barnes brag about really means that the government initiated <a href=\"https:\/\/cdn.arstechnica.net\/wp-content\/uploads\/2023\/05\/US-Foreign-Intelligence-Surveillance-Court-Section-702-FBI-report-4-21-2022.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">hundreds of thousands of breaches<\/a> of Americans\u2019 private information, data, and messages without consent or consequence. Based on that number, Senate Judiciary Committee Chairman Dick Durbin estimated that \u201cbillions\u201d more \u201ccommunications are collected and stored on government databases\u201d each year under the same rationale.<\/p>\n<p>As Republican Sen. Ted Cruz said during the hearing. \u201cYou don\u2019t believe you\u2019re accountable to the United States Congress, and you don\u2019t believe you\u2019re accountable to the American people, and you are doing damage.\u201d<\/p>\n<p>Over and over and over, Republicans on the Senate Judiciary Committee questioned why the FBI <a href=\"https:\/\/thefederalist.com\/2023\/05\/31\/breadcrumbs-from-a-buried-fbi-source-may-lead-to-a-bigger-biden-scandal\/\" target=\"_blank\" rel=\"noreferrer noopener\">covered up<\/a> the FD-1023 form that details a \u201c<a href=\"https:\/\/thefederalist.com\/2023\/06\/05\/highly-credible-source-reveals-scandal-bigger-than-biden-bribery-fbi-election-interference\/\" target=\"_blank\" rel=\"noreferrer noopener\">highly credible<\/a>\u201d confidential human source\u2019s allegations that Vice President Joe Biden\u00a0arranged to receive $5 million from a foreign national in exchange for pushing certain policy positions. One day prior to the Senate Judiciary Hearing, Sen. Chuck Grassley revealed that a Burisma executive is in possession of 17 audio recordings about the Biden family, two of which were between him and President Biden.<\/p>\n<p>\u201cWill you commit to releasing this unclassified document that alleges that the President of the United States, the President of the United States, has taken $5 million or more in bribes from a foreign nation?\u201d Hawley asked.<\/p>\n<p>\u201cWill you release the document to the public?\u201d Hawley continued. \u201cIt\u2019s unclassified. Don\u2019t you think the American people have a right to see it?\u201d<\/p>\n<p>Over and over and over again, Abbate failed to answer questions about the FBI\u2019s ongoing cover-up campaign directly. Instead, he focused his efforts on claiming to\u201creject your assertion that the FBI is politicized.\u201d<\/p>\n<p>It was only after multiple Republicans harped on the FBI mouthpiece that he claimed, \u201cI have no idea if there are recordings or not.\u201d<\/p>\n<p>\u201cThere are not two standards of justice. There is only one. It\u2019s applied equally to each and every person,\u201d Abbate insisted.<\/p>\n<p>\u201cYou\u2019re back in front of us asking for the reauthorization of extraordinary authorities. Multiple courts have uncovered extraordinary abuses perpetrated by your agency. You are at the same time concealing information about serious allegations made against the president of the United States, even as your institution also targets his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/josh-hawley-calls-for-ag-garlands-impeachment-after-mar-a-lago-raid\/\" title=\"Josh Hawley Calls For AG Garland\u2019s Impeachment After Mar-a-Lago Raid\">chief political opponent<\/a> in an unprecedented way.
