(Photo by Fabrice COFFRINI \/ AFP) (Photo by FABRICE COFFRINI\/AFP via Getty Images)<\/figcaption><\/figure>\n<p>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/daniel-baldwin\">Daniel Baldwin<\/a><br \/>12:27 PM \u2013 Tuesday, June 6, 2023<\/p>\n<p>A decade-old legal case that could exonerate former President Donald Trump has been buried by legacy media.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201c[Special counsel] Jack Smith is terrified of the only standing legal case decision from a court concerning the Presidential Records Act,\u201d said Chris Farrell, Director of Investigations at Judicial Watch.<\/p>\n<\/blockquote>\n<h3>The &#8220;Clinton Sock Drawer&#8221; Case<\/h3>\n<p>The case Farrell is referring to is titled <em>Judicial Watch v. National Archives and Records Administration<\/em> \u2013 also known as the \u201cClinton sock drawer\u201d case. Former President Bill Clinton created White House audio tapes with historian Taylor Branch and stored them in his sock drawer. Judicial Watch sued to obtain access to the tapes and lost.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cHe took them from the White House with him into private life,\u201d said Farrell. \u201cThere\u2019s classified material on those tapes and arguably it\u2019s the sort of running stream of consciousness record of Bill Clinton\u2019s presidency. Pretty important stuff.\u201d<\/p>\n<\/blockquote>\n<p>Special counsel Jack Smith is currently investigating the 45th president for his handling of classified documents since departing the White House. But Farrell says the ruling in this specific case from 2012 exonerates Trump from any alleged wrongdoing.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cAmy Berman Jackson, the judge presiding on that case, said a couple of very important things,\u201d said Farrell. \u201cThat the president had an absolute, unreviewable right to take any records or documents that he wants when he leaves office. \u201c<\/p>\n<p>\u201cNo one can come back and second guess or double think or ask questions about what the president elects to take with him,\u201d Farrell continued.<\/p>\n<\/blockquote>\n<p>In her ruling, Jackson wrote that \u201cthe President enjoys unconstrained authority to make decisions regarding the disposal of documents: \u2018[a]lthough the President must notify the Archivist before disposing of records . . . neither the Archivist nor Congress has the authority to veto the President\u2019s disposal decision.\u2019\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cAnd that has been the standing law unchallenged for the United States for something like 10 or 11 years,\u201d said Farrell. \u201cNo one challenged it \u2013 unreviewable absolute authority to take whatever [the president] wants and no one can second guess it.\u201d<\/p>\n<\/blockquote>\n<p>Trump claimed Smith\u2019s investigation into his documents was all about \u201celection interference.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIt\u2019s all about ELECTION INTERFERENCE,\u201d Trump said on Truth Social. \u201cThey don\u2019t want to run against me. I ran twice, I did much better the second time, getting millions and millions more votes than the first, a record for a sitting President, and am leading Biden in the polls, by a lot. They are the Party of Disinformation! They are using the DOJ &#038; FBI against me to Rigg the 2024 Election. They\u2019ll hit Hunter with something small to make their strike on me look \u201cfair.\u201d Nothing about these Fascists is fair or honest. FIGHT!\u201d<\/p>\n<\/blockquote>\n<p>Farrell claims this classified documents investigation is yet another example of the double standard that exists in the U.S. justice system.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThat\u2019s the legal standard,\u201d Farrell said. \u201cAnd that\u2019s okay for Bill Clinton, but when you apply the same standard to Donald Trump, suddenly everybody develops amnesia. Nobody knows what you\u2019re talking about.\u201d<\/p>\n<\/blockquote>\n<p>So that\u2019s the hypocrisy and that\u2019s the phony double talk that no one will go anywhere near or talk about,\u201d Farrell continued.\u201d<\/p>\n<p>Trump\u2019s defense regarding his conduct has been consistent with this legal precedent.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cI have the absolute right to do whatever I want with them,\u201d Trump told CNN in its town hall in May 2023.<\/p>\n<\/blockquote>\n<p>President Joe Biden is facing a separate investigation regarding classified documents from his days as vice president and senator. Biden\u2019s documents were found in numerous locations, including his Wilmington, Delaware home and the Penn Biden Center in Washington, D.C.<\/p>\n<h3>Other News<\/h3>\n<ul>\n<li>Robert F.
