Is it something where it is a slam-dunk case, where some of these things could be interpreted a few different ways?\u201d he said. \u201cAnd also, when it comes to a specific issue like this where we are talking about <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ex-trump-lawyer-predicts-former-president-may-not-be-prosecuted-for-classified-documents\/\" title=\"Ex-Trump lawyer thinks former president won't face charges for classified documents.\">potentially national defense information<\/a>, is it the type of thing where they want to declassify these things, if they haven\u2019t already been declassified, and put them out publicly?\u201d<\/p>\n<\/blockquote>\n<p>The attorney added that such considerations had also informed his opinion that the Justice Department made the right call in 2016 in declining to prosecute former Secretary of State Hillary Clinton in connection with her use of a private server for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/aoc-progressive-colleagues-argue-aggravated-felonies-label-punishes-asylum-seekers\/\" title=\"AOC, Progressive Colleagues Argue \u2018Aggravated Felonies\u2019 Label Punishes \u2018Asylum Seekers\u2019\">transmitting classified information<\/a>.<\/p>\n<p>\u201cClassification is not binding on the jury,\u201d he noted. \u201cYou have to actually take these documents, show them to the jury, and then prove to them that it constitutes national defense information.\u201d<\/p>\n<p>Parlatore represented Trump in the legal case before leaving the former president\u2019s legal team in May over <a href=\"https:\/\/www.theepochtimes.com\/trump-legal-team-responds-to-former-members-claims-of-infighting-categorically-false_5280876.html\">disagreements with other members<\/a> of the team. His comments followed the Department of Justice\u2019s (DOJ) recent closure of its investigation into former Vice President Mike Pence over the handling of classified documents.<\/p>\n<h3>Allegations of Bias<\/h3>\n<p>Smith was appointed in November to lead the DOJ\u2019s investigations into whether Trump mishandled classified documents and whether he or others interfered in the peaceful transfer of power after the 2020 election.<\/p>\n<p>Smith\u2019s appointment followed the 45th president\u2019s launch of his third presidential campaign.
