DeSantis Case<\/h2>\n<p>A First Amendment lawsuit filed by Walt Disney Parks against Florida Governor Ron DeSantis and others has hit a snag as the chief U.S. District Judge Mark Walker overseeing the case has disqualified himself. However, it&#8217;s not because of the bias concerns raised by the Republican governor, but because a relative owns 30 shares of Disney stock.<\/p>\n<blockquote>\n<p>\u201cEven though I believe it is highly unlikely that these proceedings will have a substantial effect on The Walt Disney Company, I choose to err on the side of caution \u2014 which, here, is also the side of judicial integrity \u2014 and disqualify myself,\u201d said Walker.<\/p>\n<\/blockquote>\n<p>DeSantis&#8217; lawyers had filed a motion to disqualify Walker last month because he had referenced the ongoing dispute between the DeSantis administration and Disney during hearings in two lawsuits before him dealing with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-coronavirus-rules-are-stifling-free-speech-on-campus\/\" title=\"Report: Coronavirus Rules Are Stifling Free Speech On Campus\">free speech issues<\/a> and fear of retaliation for violating new laws championed by the governor and Republican lawmakers.<\/p>\n<blockquote>\n<p>The filing said Walker\u2019s remarks \u201ccould reasonably imply that the Court has prejudged the retaliation question here.\u201d<\/p>\n<\/blockquote>\n<p>Disney had opposed the governor\u2019s motion, claiming the judge had shown no bias. The judge on Thursday called DeSantis\u2019 arguments \u201cwithout merit.\u201d<\/p>\n<h3>The Feud Between DeSantis and Disney<\/h3>\n<p>The feud between DeSantis and Disney started last year after the entertainment giant lobbied against <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/obama-appointed-federal-judge-backs-out-of-disney-v-desantis-case-after-governors-complaint\/\" title=\"Judge appointed by Obama withdraws from Disney v. DeSantis case due to governor's objection.\">legislation banning lessons<\/a> on sexual orientation and gender identity in early grades. Conservatives described it as an \u201canti-groomer\u201d bill. The governor and GOP legislators responded by taking over Disney World\u2019s self-governing district and appointing a new board of supervisors.<\/p>\n<blockquote>\n<p>Before the new board came in, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/microsoft-offers-eu-remedies-seeking-ok-on-activision-deal\/\" title=\"Microsoft offers EU remedies seeking OK on Activision deal\">company signed agreements<\/a> with the old board made up of Disney supporters that stripped the new supervisors of design and construction authority.<\/p>\n<\/blockquote>\n<p>In response, the Republican-controlled Legislature passed legislation allowing the DeSantis-appointed board to repeal those agreements and made the theme park resort\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/desantis-signs-florida-transportation-bill-with-provision-aimed-at-disneys-monorail\/\" title=\"DeSantis signs Florida transportation bill targeting Disney's monorail.\">monorail system subject<\/a> to state inspection.<\/p>\n<p>Disney filed the First Amendment lawsuit against the Florida governor and the DeSantis-appointed board in April, claiming violations of free speech and the contracts clause.
