However, Bragg argued that Trump is not entitled to a venue change for the state criminal case because the former president is not a federal officer.<\/p>\n<p>A Trump spokesperson said in a statement that Bragg\u2019s case \u201chas no factual or legal merit, having been brought by a District Attorney who ran on a platform of \u2018Get Trump.&#8217;\u201d<\/p>\n<blockquote>\n<p>\u201cAn impartial judge is vital to stop this travesty of justice,\u201d the spokesperson added.<\/p>\n<\/blockquote>\n<p>Bragg said in the filing that Trump\u2019s lawyers failed to establish that the former president meets any one of three criteria that would justify a federal-officer removal to a federal court.<\/p>\n<ul>\n<li>Federal-officer removal is available only when:<\/li>\n<li>A federal officer<\/li>\n<li>Faces criminal charges for conduct arising under color of his office<\/li>\n<li>Identifies a colorable federal defense<\/li>\n<\/ul>\n<p>\u201cBecause defendant has failed to identify a colorable ground for federal-officer removal, this criminal prosecution should be returned to New York state court,\u201d the filing reads.<\/p>\n<p>Trump\u2019s indictment by Bragg earlier this year became the first time a sitting or former president was charged criminally.<\/p>\n<figure id=\"attachment_5177331\" style=\"width: 640px\" class=\"wp-caption alignnone\">\n\t\t<a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2023\/04\/06\/id5177331-Donald-Trump-court-1200x801.jpg\"><br \/>\n\t\t\t<img decoding=\"async\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2023\/04\/06\/id5177331-Donald-Trump-court-1200x801.jpg\" alt=\"Former President Donald Trump sits at the defense table with his defense team in a Manhattan court, Tuesday, April 4, 2023, in New York. (AP Photo\/Seth Wenig)\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a><br \/>\n\t<\/figure>\n<h2>Trump Appears for Hearing<\/h2>\n<p>Recently, Trump appeared remotely in the Manhattan Criminal Court to hear a judge\u2019s instructions on the former president\u2019s handling of discovery evidence in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-big-problem-with-the-stormy-daniels-hush-money-case-against-trump\/\" title=\"The Big Problem With The Stormy Daniels Hush Money Case Against Trump\">hush money case<\/a>.<\/p>\n<p>The hearing was Trump\u2019s first appearance after he pleaded not guilty in April to multiple counts of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rep-jordan-subpoenas-former-manhattan-prosecutor-who-pushed-for-trump-indictment\/\" title=\"Rep. Jordan Subpoenas Former Manhattan Prosecutor Who Pushed for Trump Indictment\">falsifying business records related<\/a> to alleged payments made to Daniels.<\/p>\n<p>The judge told Trump and his lawyer that a violation of the protective order could result in sanctions, including charging Trump with contempt of court, which is a criminal charge that could result in fines or imprisonment.<\/p>\n<p>Prosecutors from Bragg\u2019s office argued in a court filing on April 26 that Trump should be forbidden from sharing discovery evidence with the media or the public.<\/p>\n<p>Blanche said during the hearing that because Trump is \u201crunning for the President of the United States, he very much is concerned that his first amendment rights are being violated.\u201d<\/p>\n<p>The judge said in response that the protective order is \u201ccertainly not a gag order\u201d and that it is not his intention to impair Trump\u2019s ability to campaign for president.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Manhattan DA Alvin Bragg opposes Trump&#8217;s attempt to move a &#8220;hush money&#8221; case to federal court.
