The rule was slated to go into effect Thursday, but owners of the pistol stabilizing braces would have to register their weapons with the ATF or face possible felony charges.<\/p>\n<blockquote>\n<p>The ATF has said that noncompliance would result in fees as well as \u201cup to 10 years\u2019 imprisonment or $10,000 in fines or both.\u201d<\/p>\n<\/blockquote>\n<p>Judge Drew B. Tipton of the U.S. District Court for the Southern District of Texas granted the injunction against enforcing the rule against individuals associated with the plaintiffs in the case, i.e. employees of the state of Texas and Gun Owners of America members.<\/p>\n<h3>What is a Pistol Stabilizing Brace?<\/h3>\n<p>According to the ATF\u2019s definition, a stabilizing brace \u201cprovides a surface area that allows the weapon to be fired from the shoulder, so long as other factors that indicate that the firearm is designed, made, and intended to be fired from the shoulder,\u201d essentially turning a pistol, according to the ATF\u2019s argument, into a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-biden-announces-executive-order-crackdown-on-guns-new-anti-gun-atf-director\/\" title=\"BREAKING: Biden Announces Executive Order Crackdown On Guns, New Anti-Gun ATF Director\">short-barreled rifle<\/a>.<\/p>\n<p>Congress considers short-barreled rifles more dangerous than other firearms because they are both more accurate that pistols and more easily concealed than other rifles.<\/p>\n<p>President Joe Biden announced the push against such braces two years ago, after one was used by a gunman in a Boulder, Colorado, store who killed 10 people.<\/p>\n<h3>Response to the Injunction<\/h3>\n<p>Groups like Gun Owners of America have sued the federal government over the rule, arguing that a requirement for millions of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/us-had-a-record-number-of-mass-shootings-in-2020\/\" title=\"US Had A Record Number Of Mass Shootings In 2020\">legal gun owners<\/a> to register with the government is unconstitutional.<\/p>\n<blockquote>\n<p>\u201cThis assault on millions of Americans was just the latest example of President Biden trying to weaponize the DOJ against <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-axes-gun-permit-requirement\/\" title=\"Utah Axes Gun-Permit Requirement\u00a0\">law-abiding gun owners<\/a>, and we doubt it will be the last.<\/p>\n<p>\u201cWe are incredibly grateful to Judge Tipton for hearing the pleas of our members who were facing serious prosecution simply for owning a piece of plastic \u2014 all because of an arbitrary reclassification by the ATF.<\/p>\n<p>\u201cGOA and our millions of members nationwide will continue to fight back against this <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-blocks-biden-administrations-new-gun-restriction-hours-before-it-was-to-take-effect\/\" title=\"Biden's new gun restriction blocked by federal judge just before implementation.\">rogue anti-gun administration<\/a> at every turn in defense of our rights,\u201d he said.<\/p>\n<\/blockquote>\n<p>Sam Paredes of the Gun Owners Foundation, another plaintiff in the suit, said: \u201cWhile Congress was slow to act on this wide-reaching rule, GOF stepped in to defend the millions of Americans facing legal jeopardy.<\/p>\n<p>\u201cWe are proud to have helped partially halt this rule, and hope it sends a message to anti-gunners hellbent on continuing the assault on the Second Amendment.\u201d<\/p>\n<p>The exact number of guns potentially affected by the ATF\u2019s new rule, should it go into effect, is unknown.
