But Slate\u2019s Mark Joseph Stern is now accusing Samuel Alito of \u201cviolating\u201d completely imaginary SCOTUS ethic \u201crules\u201d in a case involving Phillips 66.<\/p>\n<p>According to Stern, even when originalist justices properly disclose all their investments and then <em>recuse<\/em> themselves, they\u2019re still corrupt. Why?<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1911222522\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<blockquote class=\"wp-block-quote\">\n<p>The justice did not explain his reason for recusing, one of Roberts\u2019 promised \u201cpractices.\u201d To obtain that information, you must dig through his\u00a0<a href=\"https:\/\/aboutblaw.com\/6AX\" target=\"_blank\" rel=\"noreferrer noopener\">financial disclosures<\/a>, which reveal that he holds up to $50,000 of stock in Phillips 66, one of the parties. Alito is one of two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/smear-campaign-leftist-activists-seek-to-intimidate-justices-control-the-court-experts-say\/\" title=\"\u2018Smear Campaign\u2019: Leftist Activists Seek To Intimidate Justices, Control The Court, Experts Say\">sitting justices<\/a> who still holds individual stocks (as opposed to conflict-free assets like mutual funds).<\/p>\n<\/blockquote>\n<p>First off, an explanation for recusal <em>is not<\/em>, in fact, one of \u201cRoberts\u2019 promised \u201cpractices.\u201d The \u201c<a href=\"https:\/\/s3.documentcloud.org\/documents\/23789633\/letter-to-chairman-durbin-04252023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Statement on Ethics Principles and Practices<\/a>\u201d plainly states that in \u201cmany instances, the grounds for recusal will be obvious,\u201d but that justices \u201c<em>may<\/em> provide a summary explanation of a recusal decision\u201d or \u201c<em>may<\/em> provide an extended explanation for any decision to recuse or not recuse.\u201d There is no \u201crule.\u201d<\/p>\n<p>The above italics are mine. Because the word <em>may, <\/em>meaning \u201cto express the possibility,\u201d has a different definition than words like \u201cwill\u201d or \u201cmust,\u201d which denote an obligation or duty. So, for example, one <em>may<\/em> refer to a person who <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-campaign-to-destroy-scotus-is-getting-increasingly-stupid\/\" title=\"Efforts to Destroy SCOTUS are Becoming More Foolish.\">cynically delegitimizes constitutional governance<\/a> for the sake of power as an \u201cirredeemable authoritarian hack masquerading as a journalist,\u201d but one is not <em>required<\/em> to do so.<\/p>\n<p>The word \u201cmay\u201d does not appear in a document drafted by Supreme Court justices by accident. As Roberts explains in the letter cited by Slate, compelling an explanation for every recusal \u201cmight encourage strategic behavior by lawyers who may seek to prompt recusals in future cases.\u201d<\/p>\n<p>Indeed, Stern\u2019s attack rests on the rickety notion that Alito is trying to conceal something from the public. When he claims, \u201cyou must dig through [Ailito\u2019s] financial disclosures,\u201d what he really means is opening the \u201c<a href=\"https:\/\/fixthecourt.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Fix the Court<\/a>\u201d website (or just following the<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Slate&#8217;s Mark Joseph Stern is accusing Samuel Alito of violating non-existent SCOTUS ethics rules in a case involving Phillips 66.
