Veteran attorney Steven Schwartz included a series of case law citations in a brief for an injury suit against Avianca Airlines earlier this year, according to <a href=\"https:\/\/abc7chicago.com\/chatgpt-lawyer-steven-schwartz-ai\/13313071\/\" target=\"_blank\" rel=\"noopener\">WLS-TV<\/a>. The fake case law originated from the artificial intelligence program ChatGPT.<\/p>\n<p>The program generated a series of <a href=\"https:\/\/www.westernjournal.com\/sausage-maker-gets-rid-fake-meat-damning-results-believed-written-press\/\" target=\"_blank\" rel=\"noopener\">fake<\/a> court decisions that ultimately were included in Schwartz\u2019s legal arguments. Judge Kevin Castel of the Southern District of New York eventually realized neither the cases themselves or the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-can-ketanji-brown-jackson-rule-in-sex-discrimination-cases-if-she-cant-define-woman\/\" title=\"How Can Ketanji Brown Jackson Rule In Sex Discrimination Cases If She Can\u2019t Define \u2018Woman\u2019?\">internal citations<\/a> were real, stating that they \u201cappear to be bogus judicial decisions with bogus quotes and bogus internal citations.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">A lawyer used ChatGPT to do \u201clegal research\u201d and cited a number of nonexistent cases in a filing, and is now in a lot of trouble with the judge  <a href=\"https:\/\/t.co\/AJSE7Ts7W7\">pic.twitter.com\/AJSE7Ts7W7<\/a><\/p>\n<p>\u2014 Daniel Feldman (@d_feldman) <a href=\"https:\/\/twitter.com\/d_feldman\/status\/1662308313525100546?\">May 27, 2023<\/a><\/p>\n<\/blockquote>\n<p>The fake cases included Varghese v. China South Airlines, Martinez v. Delta Airlines, Shaboon v. EgyptAir, Petersen v. Iran Air, Miller v. United Airlines and Estate of Durden v. KLM Royal Dutch Airlines. Judge Castel proved unable to find legal documents associated with any of the case law, spurring skepticism over their existence.<\/p>\n<p>Schwartz is facing a sanctions hearing on June 8 \u2014 and he\u2019s taking responsibility for the legal goof. The lawyer admitted he was a novice to ChatGPT in a subsequent affidavit \u2014 explaining that he \u201cwas unaware of the possibility that its content could be false.\u201d<\/p>\n<p>Schwartz \u201cgreatly regrets having <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawyer-faces-sanctions-after-admitting-using-chatgpt-for-bogus-legal-research\/\" title=\"Lawyer may be punished for using ChatGPT for fake legal research.\">utilized generative artificial intelligence<\/a> to supplement the legal research performed herein and will never do so in the future without absolute verification of its authenticity,\u201d according to a pre-sanctions hearing filing.<\/p>\n<h3>AI Replacing Human Lawyers?<\/h3>\n<p>The faulty use of the program could suggest that predictions of ChatGPT replacing human lawyers may be premature, according to The New York Times. The program has been criticized for <a href=\"https:\/\/www.westernjournal.com\/elon-musk-planning-challenge-popular-woke-ai-chatbot-venture-report\/\" target=\"_blank\" rel=\"noopener\">political bias<\/a>, as well as an imperfect record in providing its users with accurate information.<\/p>\n<h3>Judge Orders Schwartz to Show Cause<\/h3>\n<p>The lawyer\u2019s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.575368\/gov.uscourts.nysd.575368.32.1.pdf\" target=\"_blank\" rel=\"noopener\">affidavit<\/a> included screenshots of him asking ChatGPT whether the bogus cases were real \u2014 a question to which the program responded in the affirmative. The judge has ordered Schwartz to show cause why he shouldn\u2019t be punished \u201cfor the use of a false and fraudulent notarization\u201d in the sanctions hearing.<\/p>\n<p>It&#8217;s a cautionary tale for lawyers and AI enthusiasts alike.
