Two of the students were injured but survived, the Los Angeles District Attorney\u2019s Office said in <a href=\"https:\/\/da.lacounty.gov\/media\/news\/district-attorney-gasc-n-announces-exoneration-man-custody-over-33-years\" target=\"_blank\" rel=\"noopener\">a press release<\/a>. Two people were said to have been the shooters, mistaking the teens for gang members.<\/p>\n<p>Even though it was believed two people were the shooters, Saldana and two others were charged with six counts of attempted murder and one count of shooting at an occupied vehicle, the district attorney\u2019s office said. Saldana, who was 22 at the time of the shooting and working full time as a construction worker, was convicted and sentenced to 45 years to life in state prison.<\/p>\n<p>In 2017, one of the other men convicted of the crime said at his parole hearing that Saldana wasn\u2019t involved in any way and wasn\u2019t present for the shooting, according to the DA\u2019s office. A former deputy district attorney who was present at the hearing reportedly did not share the information with Saldana or his attorney.<\/p>\n<p>That information was finally shared with the DA\u2019s office in February 2023, and the district attorney\u2019s office launched an official investigation. The office\u2019s Conviction Integrity Unit prioritized their investigation, and after a \u201cthorough investigation,\u201d along with an investigation by the DA\u2019s office with the Baldwin Park Police Department, it was determined that Saldana had not committed the crime.<\/p>\n<p>\u201cAs prosecutors, our duty is not simply to secure convictions but to seek justice. When someone is wrongfully convicted, it is a failure of our justice system and it is our responsibility to right that wrong. We owe it to the individual who was wrongfully convicted and to the public that justice is served,\u201d Los Angeles District Attorney Gasc\u00f3n said in a statement.<\/p>\n<p>At a press conference on Thursday, Saldana and Gasc\u00f3n discussed the exoneration, with Saldana saying he was grateful to those who set him free.<\/p>\n<p>\u201cIt\u2019s a struggle, every day waking up knowing you\u2019re innocent and here I am locked up in a cell, crying for help,\u201d Saldana said, <a href=\"https:\/\/www.cbsnews.com\/news\/daniel-saldana-california-man-cleared-shooting-freed-33-years-prison\/\" target=\"_blank\" rel=\"noopener\">according to CBS News<\/a>.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1685202016677000&#038;usg=AOvVaw3BHv9qMQC3OwHMBCkGZXpF\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>Gasc\u00f3n also apologized to Saldana and his family.<\/p>\n<p>\u201cI know that this won\u2019t bring you back the decades you endured in prison,\u201d he said. \u201cBut I hope our apology brings some small comfort to you as you begin your new life.\u201d<\/p>\n<p>Gasc\u00f3n did not elaborate on what evidence concluded Saldana was innocent, and his office didn\u2019t respond to a Daily Wire request for more information prior to press time.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A California man convicted of attempted murder in 1990 has been declared innocent and released from prison.
