John Eastman argues that those decisions harm the former president\u2019s presidential aspirations.<\/p>\n<blockquote>\n<p>\u201ccreated a stigma for both Petitioner and his client, the former President of the United States and current candidate for the presidency.\u201d<\/p>\n<\/blockquote>\n<p>A petition (<a href=\"https:\/\/www.documentcloud.org\/documents\/23824325-john-eastman-cert-petition\">pdf<\/a>) filed by John Eastman with the Supreme Court argued that a March 2022 ruling handed down by Judge David O. Carter, an appointee of former President Bill Clinton, \u201ccreated a stigma for both Petitioner and his client, the former President of the United States and current candidate for the presidency.\u201d<\/p>\n<h3>Corruption Allegations<\/h3>\n<p>Carter had written last year that his court found it \u201cmore likely than not that President Trump corruptly attempted to obstruct the Joint Session of Congress on January 6, 2021\u201d along with Eastman. Both Trump and Eastman have denied wrongdoing, while Trump has often pointed to public statements he made on Jan. 6 that protesters should demonstrate peacefully and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-trump-lawyer-files-petition-with-us-supreme-court\/\" title=\"Ex-Trump Lawyer Petitions US Supreme Court.\">respect local law enforcement officials<\/a>.<\/p>\n<p>The California-based judge, who ran unsuccessfully as a Democrat for California\u2019s 38th Congressional District years ago, also claimed that the \u201cillegality of the plan was obvious\u201d and said the United States was \u201cfounded on the peaceful transition of power, epitomized by George Washington laying down his sword to make way for democratic elections.\u201d<\/p>\n<h3>Attorney-Client Privilege<\/h3>\n<p>Eastman had <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/six-things-trumps-attorney-was-ordered-to-testify-on\/\" title=\"Six things Trump's attorney was ordered to testify on\">claimed <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attorney-client-privilege-federal-prosecutors-for-sdny-working-to-seize-rudy-giulianis-emails\/\" title=\"\u201cAttorney-Client Privilege?\u201d \u2013 Federal Prosecutors for SDNY Working to Seize Rudy Giuliani\u2019s Emails\">attorney-client privilege<\/a><\/a>, but Carter rejected the claim and ruled that attorney-client privilege does not apply if the discussion involved an alleged crime.<\/p>\n<p>At the time, he ordered Eastman to <a href=\"https:\/\/www.cnbc.com\/2022\/10\/19\/john-eastman-ordered-to-give-more-emails-to-jan-6-capitol-riot-probe.html\">turn over<\/a> documents and electronic communications to the House Jan. 6 committee, which was scrapped after Republicans took control of the lower congressional chamber earlier this year. He alleged that 33 documents were emails that allegedly demonstrated \u201can effort by President Trump and his attorneys to press false claims in federal court for the purpose of delaying\u201d the Jan. 6 certification.<\/p>\n<h3>Legal Strategy Memo<\/h3>\n<p>That was in connection to Eastman having written a memo outlining a legal strategy for Vice President Mike Pence to reject the Electoral College votes for then-candidate Joe Biden while he presided over the Jan. 6 session. Pence did not ultimately go through with what was outlined in Eastman\u2019s document, and Trump\u2014now a 2024 presidential candidate\u2014criticized Pence on social media for the move. Pence is reportedly slated to announce a presidential bid of his own in the coming weeks.<\/p>\n<p>In late 2022, Trump criticized Carter for what he described as a partisan ruling.<\/p>\n<blockquote>\n<p>\u201cWho\u2019s this Clinton appointed \u2018Judge,\u2019 David Carter, who keeps saying, and sending to all, very nasty, wrong, and ill informed statements about me on rulings, or a case (whatever!), currently going on in California, that I know nothing about\u2014nor am I represented,\u201d Trump wrote on social media. \u201cWith that being said \u2026 he shouldn\u2019t be making statements about me until he understands the facts, which he doesn\u2019t!\u201d<\/p>\n<\/blockquote>\n<figure id=\"attachment_4562867\" style=\"width: 600px\" class=\"wp-caption alignnone\">\n\t\t<a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/06\/28\/GettyImages-1241438456-1200x800.jpg\"><br \/>\n\t\t\t<img decoding=\"async\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/06\/28\/GettyImages-1241438456-1200x800.jpg\" alt=\"John Eastman, former lawyer of former President Donald Trump, appears on screen during the fourth hearing by the House Select Committee in the Cannon House Office Building in Washington, on June 21, 2022.\" \/><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a><br \/>\n\t<\/figure>\n<h2>Petition<\/h2>\n<p>In his Supreme Court petition, Eastman argued that the \u201crespondent committee\u2019s action of accessing disputed documents while a motion to stay was pending, and then publishing in a public filing a live link to the confidential documents that were the subject of the appeal, deprived Petitioner (Eastman) of the opportunity to show that the \u2018crime-fraud\u2019 conclusions of the District Court were clearly erroneous, thus clearing his name and that of his former client, former President Trump,\u201d according to his petition.<\/p>\n<p>\u201cBecause the law i<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Former Trump lawyer John Eastman has petitioned the US Supreme Court to overturn lower court rulings that allowed the House January 6 committee to access information, claiming it harms Trump&#8217;s presidential aspirations.
