This comes after slow and difficult negotiations with House Speaker Kevin McCarthy on a debt limit increase. Biden had publicly considered whether he could invoke the amendment\u2019s fourth section to unilaterally pay U.S. creditors without congressional authorization. <\/p>\n<p>The plan was criticized by Republicans and some Democrats, and Treasury Secretary Janet Yellen and Biden have since decided against doing so, according to Deputy Treasury Secretary Wally Adeyemo. \u201cThe 14th Amendment can\u2019t solve our challenges now. Ultimately, the only thing that can do that is Congress \u2026 raising the debt limit,\u201d he said.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">\u201cNo.\u201d Deputy Treasury Secretary <a href=\"https:\/\/twitter.com\/wallyadeyemo?\">@wallyadeyemo<\/a> tells me definitely the Biden administration will not invoke the 14th Amendment even if there is no deal to raise the debt ceiling by June 1st. <a href=\"https:\/\/twitter.com\/USTreasury?\">@USTreasury<\/a> <a href=\"https:\/\/t.co\/9EldBpMYhC\">pic.twitter.com\/9EldBpMYhC<\/a>\n<\/p>\n<p>\u2014 Poppy Harlow (@PoppyHarlowCNN) <a href=\"https:\/\/twitter.com\/PoppyHarlowCNN\/status\/1662060636325519360?\">May 26, 2023<\/a><\/p>\n<\/blockquote>\n<p>Several Senate Democrats wrote a letter to Biden urging him to \u201cprepare to exercise your authority under the 14th Amendment \u2026 preventing a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/taiwan-is-joe-bidens-carter-conundrum\/\" title=\"Biden faces a dilemma with Taiwan like Carter did.\">global economic catastrophe<\/a>.\u201d However, Republicans and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-backs-down-will-not-invoke-nuclear-option-if-debt-negotiations-fail\/\" title=\"Biden won't use nuclear option if debt talks fail.\">legal experts condemned<\/a> the measure and said it would lead to severe consequences for the president.<\/p>\n<p>Support for invoking the 14th Amendment to avoid a debt default came from Harvard Law School professor Laurence Tribe, a constitutional law scholar who wrote a New York Times essay in favor of invocation. Tribe claimed that \u201cCongress \u2014 after passing the spending bills that created these debts in the first place \u2014 [cannot] invoke an arbitrary dollar limit to force the president and his administration to do its bidding.\u201d<\/p>\n<p>However, Richard Epstein of New York University Law School, a constitutional scholar, told the Daily Caller News Foundation that an invocation would risk an \u201cimpeachable offense.\u201d Meanwhile, Andrew McCarthy of National Review Institute said that \u201cany debt [Biden] issued based on this deeply flawed interpretation of the amendment would be worthless.\u201d Jonathan Turley, a law professor at George Washington University, said it would \u201creduce the separation of powers doctrine to junk bond status.\u201d<\/p>\n<p>Senate Minority Leader Mitch McConnell warned Biden that doing so was \u201cnot an option,\u201d while Republican Rep. Lauren Boebert of Colorado said that \u201cCongress \u2014 not the President \u2014 has the power to enforce Section 4.\u201d<\/p>\n<p>Biden and McCarthy remain in negotiations over a deal, with House Republicans declining to approve any measure that does not have sufficient cuts to public spending and other policy measures.
