However, courts and regulators have been grappling for decades over how much of a connection with a waterway a property must have in order to require a permit.<\/p>\n<\/blockquote>\n<h3>The Sacketts&#8217; Case<\/h3>\n<blockquote>\n<p>The Sacketts&#8217; case centered on whether their property near Priest Lake contained wetlands protected by the Clean Water Act. The San Francisco-based 9th U.S. Circuit Court of Appeals had relied on a test by retired Justice Anthony Kennedy, who said the law extended to areas that had a &#8220;significant nexus&#8221; to a waterway.<\/p>\n<p>However, Justice Samuel Alito, writing for a five-member majority, embraced the &#8220;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-decision-repeals-wetlands-protections-from-clean-water-act\/\" title=\"Supreme Court ends Clean Water Act's Wetlands Protections.\">continuous surface connection<\/a>&#8221; test for determining if adjacent wetlands are covered by the law. &#8220;The wetlands on the Sacketts&#8217; property are distinguishable from any possibly covered waters,&#8221; Alito wrote.<\/p>\n<p>Three justices &#8211; conservative Justices Clarence Thomas and Brett Kavanaugh, and liberal Justice Elena Kagan &#8211; wrote separate concurring opinions.<\/p>\n<\/blockquote>\n<h3>The Future of EPA Regulation<\/h3>\n<blockquote>\n<p>The Supreme Court&#8217;s ruling in favor of the Sacketts comes as President Joe Biden&#8217;s administration has finalized a rule expanding the definition of waterways that are protected under the Clean Water Act, in a reversal from former President Donald Trump&#8217;s era. However, a federal judge in North Dakota has temporarily blocked implementation of the rule in 24 states in response to a lawsuit by mostly Republican-led states.
