In the court\u2019s 5-4 decision, the conservative majority limited the definition of federal waterways that fall under the purview of the EPA to enforce the law as wetlands with a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/no-dry-land-isnt-navigable-water-for-federal-bureaucrats-to-regulate-and-scotus-must-say-so\/\" title=\"No, Dry Land Isn\u2019t \u2018Navigable Water\u2019 For Federal Bureaucrats To Regulate, And SCOTUS Must Say So\">continuous surface water connection<\/a> to larger streams, lakes, and rivers.<\/p>\n<p>\u201cThe uncertain meaning of \u2018the waters of the United States\u2019 has been a persistent problem, sparking decades of agency action and litigation,\u201d the court acknowledged in <em>Sackett v. EPA<\/em>.<\/p>\n<p>Despite the split decision over the Clean Water Act, the nine<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-strikes-another-blow-to-administrative-state-narrows-clean-water-act\/\" title=\"Supreme Court limits Clean Water Act, weakens administrative state.\">-member panel ruled unanimously<\/a> on behalf of the plaintiffs\u2019 case to push the EPA off their property.<\/p>\n<p>The Supreme Court\u2019s Thursday ruling marks the latest strike against the administrative state with new limits to rein in bureaucratic abuses now routine among the executive branch.<\/p>\n<hr>\n<h3>The Sackett Family&#8217;s Decade-Long Battle<\/h3>\n<p>The Sackett family has spent more than a decade navigating the rules of the Clean Water Act over the course of construction for the couples\u2019 dream home near Priest Lake in Bonner County, Idaho. Months after their 2004 purchase, the EPA shut down the project claiming wetlands on their property were covered under the Clean Water Act as \u201cwaters of the United States.\u201d<\/p>\n<p>The Sackett family fought the EPA\u2019s joint decision with the Army Corps of Engineers all the way up to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hollywood-celebs-rage-in-defeat-after-barrett-confirmation-revolting-disgraceful-unconscionable\/\" title=\"Hollywood Celebs Rage in Defeat After Barrett Confirmation: 'Revolting. Disgraceful. Unconscionable'\">high court<\/a>, which heard the case in October. The nine justices agreed that the Sackett\u2019s wetlands did not fall under federal protections allowing the EPA to step in and halt the project.<\/p>\n<h3>Conservative Majority Rules<\/h3>\n<p>Justice Samuel Alito wrote the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-to-revise-church-restrictions-after-supreme-court-ruling\/\" title=\"California To Revise Church Restrictions After Supreme Court Ruling\">majority opinion<\/a>. He was joined by Justices Clarence Thomas, Amy Coney Barrett, Neil Gorsuch, and John Roberts.
