Levin, who worked in the Reagan Justice Department, reviewed the powers granted by the Constitution to Congress and the president in relation to these matters on his program &#8220;Life, Liberty &#038; Levin&#8221; on Sunday.<\/p>\n<p>Levin cited <a href=\"https:\/\/constitution.congress.gov\/browse\/article-1\/section-8\/clause-1\/\" target=\"_blank\" rel=\"noopener\">Article I, Section 8, Clause 1<\/a>, which provides, \u201cThe Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense.\u201d He noted that this is a primary, core duty of the Congress, and specifically the House of Representatives.<\/p>\n<p>Meanwhile, <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artII-S3-3-1\/ALDE_00001160\/\" target=\"_blank\" rel=\"noopener\">Article II, Section 3<\/a> requires the president to \u201ctake care that the laws be faithfully executed,\u201d including those related to the nation\u2019s finances.<\/p>\n<p>Biden has said he is considering invoking the 14th Amendment if he cannot reach an agreement with <a href=\"https:\/\/www.westernjournal.com\/mccarthy-us-now-owes-entire-economy-makes-year-cant-continue-way\/\" target=\"_blank\" rel=\"noopener\">House Republicans<\/a>. Levin called such an interpretation of the 14th Amendment \u201cpreposterous,\u201d pointing out that the provision was passed in the immediate aftermath of the Civil War for a very specific purpose.<\/p>\n<h3>What Does the 14th Amendment Say?<\/h3>\n<p><a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-14\/#:~:text=No%20State%20shall%20make%20or,equal%20protection%20of%20the%20laws.\" target=\"_blank\" rel=\"noopener\">Section 4<\/a> of the 14th Amendment states, \u201cThe validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.\u201d<\/p>\n<p>Levin elaborated that the amendment\u2019s purpose was to provide that all expenses incurred by the Union to put down the Confederate states\u2019 rebellion would be paid, but any expenses racked up by the Confederacy would not.<\/p>\n<p>George Washington University law professor Jonathan Turley reached a similar conclusion. \u201cThe drafters of this amendment did not want Congress to simply dismiss its obligations to pay off the Union\u2019s debts from the Civil War. Although the amendment is not limited to those debts, it has nothing to do with debt ceilings set by Congress,\u201d he wrote in a Saturday <a href=\"https:\/\/thehill.com\/opinion\/white-house\/4012134-congressional-democrats-beg-biden-to-nullify-their-existence\/\" target=\"_blank\" rel=\"noopener\">opinion piece<\/a> for The Hill.<\/p>\n<h3>What Does the Wall Street Journal Say?<\/h3>\n<p>The Wall Street Journal editorial board <a href=\"https:\/\/www.wsj.com\/articles\/what-the-14th-amendment-really-says-debt-ceiling-biden-shut-down-default-constitution-78b24824\" target=\"_blank\" rel=\"noopener\">contended<\/a> that under the 14th Amendment, the Biden administration has a positive duty to pay the nation\u2019s outstanding debt, but the president has not been granted the authority to bypass Congress to accrue new debt.<\/p>\n<p>The board went on to note that the Treasury has more than enough revenue coming to finance the debt. \u201cFederal tax receipts in March were $313 billion and interest payments were $67 billion, according to Treasury\u2019s monthly report on revenue and outlays. In April receipts were $639 billion and interest was $62 billion,\u201d the editors wrote.<\/p>\n<h3>What is the GOP&#8217;s Plan?<\/h3>\n<p>Last month, the GOP-controlled House passed the <a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/2811\" target=\"_blank\" rel=\"noopener\">Limit, Save, Grow Act<\/a>. The Congressional Budget Office estimated that the Republicans\u2019 plan would save <a href=\"https:\/\/www.cbo.gov\/publication\/59102\" target=\"_blank\" rel=\"noopener\">$4.8 trillion<\/a> in federal spending over the next decade.<\/p>\n<p>The bill suspends the nation\u2019s debt ceiling through March 2024 or until the debt increases by $1.5 trillion, whichever comes first, in exchange for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mccarthy-us-now-owes-more-than-entire-economy-makes-in-year-cant-continue-this-way\/\" title=\"US debt exceeds annual economy, unsustainable - McCarthy\">setting fiscal year 2024 discretionary federal spending<\/a> at fiscal year <a href=\"https:\/\/www.crfb.org\/blogs\/cbo-scores-limit-save-grow-act\" target=\"_blank\" rel=\"noopener\">2022 levels<\/a>. It also sets a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/schumer-rules-out-recovering-unspent-covid-relief-funds-in-debt-ceiling-fight\/\" title=\"Schumer Rules Out Recovering Unspent COVID-Relief Funds in Debt-Ceiling Fight\">1 percent growth cap<\/a> on federal spending over the next decade and includes a work requirement for some who receive welfare payments.<\/p>\n<p>House Speaker Kevin McCarthy highlighted that Biden\u2019s 2024 budget calls for <a href=\"https:\/\/www.nytimes.com\/2023\/03\/09\/us\/politics\/biden-budget.html\" target=\"_blank\" rel=\"noopener\">$6.8 trillion<\/a> in federal spending, which is <a href=\"https:\/\/www.cbo.gov\/publication\/57170\" target=\"_blank\" rel=\"noopener\">$200 billion more<\/a> than what was spent at the height of the pandemic in 2020.<\/p>\n<p>The CBO projected this month that the deficit will be <a href=\"https:\/\/www.cbo.gov\/publication\/59096\" target=\"_blank\" rel=\"noopener\">$1.5 trillion<\/a> for the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/most-of-bidens-1-9-trillion-coronavirus-relief-bill-has-nothing-to-do-with-public-health\/\" title=\"Most Of Biden\u2019s .9 Trillion Coronavirus Relief Bill Has Nothing To Do With Public Health\">current fiscal year<\/a>, up from February\u2019s <a href\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mark Levin, a Fox News host and former Reagan Justice Department employee, discredited President Biden&#8217;s plan to use the 14th Amendment if he fails to reach a debt ceiling agreement with House Republicans.
