Zooey Zephyr from returning to the floor of the Montana House of Representatives for the duration of the 2023 session, according to KSMP-TV.<\/p>\n<p> Zephyr was banned from the House floor for conduct unbecoming of a state legislator.<\/p>\n<p>  The progressive Democrat claimed that Republican members of the Montana House had \u201cblood on your hands\u201d in an April floor speech defending sex change surgeries for minors.<\/p>\n<p>     A two-thirds majority in the Montana House voted to (temporarily) suspend Zephyr from the House floor for violating the legislature\u2019s decorum rules after he accused his peers of carrying out \u201ctorture\u201d against transgender persons.<\/p>\n<p>  Zephyr\u2019s speaking privileges were earlier revoked until he apologized for his allegations of violence.<\/p>\n<p> Zephyr sued the state of Montana, state House Speaker Matt Regier and the state legislature\u2019s sergeant-at-arms in a bid to overturn the body\u2019s disciplinary actions toward him, according to ABC News.<\/p>\n<p> However, District Court Judge Mike Menahan said that he didn\u2019t have the power to restore Zephyr\u2019s floor privileges at the state house in a May 2 ruling, according to KSMP.<\/p>\n<p> Doing so \u201cwould require this court to interfere with legislative authority in a manner that exceeds this court\u2019s authority,\u201d Menahan explained.<\/p>\n<p> The judge pointed to the legal concept of separation of powers in his five-page ruling \u2014 defending the Montana House\u2019s constitutional privilege to discipline its own members independently of the state judicial branch.<\/p>\n<p>  Montana Attorney General Austin Knudsen hailed Menahan\u2019s ruling for defending the timeless American legal concept.<\/p>\n<p> \u201cToday\u2019s decision is a win for the rule of law and the separation of powers enshrined in our Constitution,\u201d Knudsen said in a statement.<\/p>\n<p>  Zephyr slammed the ruling in a tweet after his ban from the legislature was affirmed.<\/p>\n<p> \u201cIf we can\u2019t get justice in the courts, we will get it in the ballot box,\u201d the progressive urged.<\/p>\n<p>    Since his ban, Zephyr has participated in legislative proceedings of the Montana House remotely, according to ABC.<\/p>\n<p>       Tags:<\/p>\n<p> attorney general, Constitution, Court, Fight, House of Representatives, Justice, law, Montana, Progressive, speech, torture, transgender, US news<\/p>\n<p>   SummaryRecent PostsContact<\/p>\n<p> Richard Moorhead is a conservative journalist, a graduate of Arizona State University, Army Infantryman, Gold Star grandson, and guitar player.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>News \u00a0By Richard Moorhead \u00a0May 16, 2023 at 4:21pm A transgender Montana Democrat can forget about returning to the state legislature after a judge\u2019s ruling.
